robert mueller is deploying more manpower in the russia investigation. catherine herridge looking at what it might mean for the probe. >> robert mueller making more use of justice department lawyers and us attorneys, they believe the expanded team is an indicator that cases are not related to the russia collusion probe. critics point to paul manafort who is facing money laundering and tax fraud allegations the pre-the presidential election, michael cohen under investigation by new york's public collection unit calling business interests to the $100 payment, to stormy daniels. >> they are spinning off more cases, found different things, ready to indicts in cases but they are not cases to trump russia collusion, they are dragging a little prosecutors, to shut down. >> a spokesman for robert mueller declined to comment on staffing, this came in dc court tuesday for rare public status hearing but delay sentencing national security adviser mike flynn. >> donald trump taking shots at the doj, the campaign event tonight starting with remarks directed at hillary clinton.

as part of his plea deal, flynn agreed to cooperate in special counsel robert mueller's special investigation. catherine herridge is live in washington. >> i was in the courtroom this morning. the hearing was short-lasting. flynn stood silently as his lawyer did all of the talking, telling the former national security adviser is eager to wrap up and very much does want to bring this chapter to a close. based on the plea agreement that the government controls the timing but he does not believe the facts surrounding the case but will likely change in the future. flint's lawyer did not -- said the investigation is probably complete at this point. judge sullivan sits on the national surveillance court suddenly recused himself without explanation. it's not known whether the recusal is connected to the russia probe. he's not comfortable going to the sentencing phase without meeting with flynn and the lawyers first. there's very little that was said by the two lawyers for the special counsel. the maximum is five years in prison but no jail time is anticipated. in the last hour, the wall street is confirming th

. >> melissa: catherine herridge, terrific reporting as always, thank you. let's bring in robertl, a former justice department official, thank you so much for joining us. what do you make of this? is he able to just refuse, can he refuse? >> in the short term he can refuse, it's going to be up to the judiciary committee whether they want to vote to hold him in contempt and forced him to testify, either under threat of arrest or other compulsory means. it won't happen tomorrow or the next day, there is another step in the process that goes on on these kind of things when someone doesn't want to testify before a committee on the hill. >> melissa: is his lawyer right in saying these committees have become too politically minded? >> i don't know if his lawyer's right or not, i tend to think -- it's certainly not a legal basis, i would never had a client who testified on the hill if preening congressmen were reason to not testify. that's kind of the nature of the game when you take someone on the hill to testify. usually people have a more recent objection, i am going to plead the fif

(catherine) on a day when president trump was having tea and inspecting troops with england's queen elizabeth... some very distracting news was breaking back in washington.. a dozen russians are being formally accused of hacking into networks connected to democrats.....and presidential candidate hillary clinton. they're charged with conspiracy. the deputy attorney general says they also stole the personal identities of roughly half a million americans...using a scheme known as 'spear fishing." deputy attorney general - which involves sending misleading email messages and tricking users into disclosing their passwords and security information. the defendants hacked into comptuer networks and installed malicious software that allowed them to spy on uers, take screenshots and remove data from those computers. of course the russians indicted today will never seethe inside of an american courtroom... but the charges will at least limit their travel options.

catherine herridge, thank you very much. we appreciate the reporting period stephen mulroy, university of memphis law perforce -- professor joins us now, you say that robert likely to wrap up the investigation without interviewing the president of the united states, why not? >> i think that to the extent that there are any indications or any questions that he has about the president trump's own actions, the firing of fbi director comey, the way that he handled the news about the trump tower meeting in various things. he is not going to want to completely close the seal on his investigative report until he has had a chance to talk to them about that. among the list of questions that he has said to trump's lawyers are things that only trump can answer about his state of mind and his motivations and what exactly he did or said on certain dates. i do not think that mr. mueller will be satisfied with closing the lid on the investigation without at least taking a run at answering those questions from mr. trump. >> harris: i'm sure that the viewers do not miss this, he understands the politics at play. he said that he would sit down for months now, but he is goi
