see the crowd dissipate when you're getting close to the curfew hour. >> so then what happens next, cedric, if these people don't get off the streets? >> well, that's going to be interesting to see. i would imagine if they don't leave at 12:00 or shortly thereafter, maybe charlotte will begin to move in and help to disburse them as gingerly as they can, but i think we have to take into account, if it hits midnight and there's indication that they are leaving the area, then you continue to let them leave the area and try not to provoke a situation that would be totally unnecessary. >> might neil franklin, the national guard be more aggressive than the charlotte police? >> i don't think so. what we saw in baltimore with the national guard is they were pretty much holding territory. they weren't very active at all in moving the crowd, engaging the crowd. it was the police department. so when the curfew time arrived in baltimore, the police department game the people somewhat of a grace period. as long as they were moving and appeared to be leaving the areas, the police allowed them to do that

cedric alexander, paul cowen and other guests about police conduct across the country. talk about release of a videotape, we're in an era of police transparency. if you want trust between police and communities there has to be that transparency. not so an incident can be prejudged, i agree a video provides one sort of perspective of something and there's more information to be gathered but you need the public involved. you need the public's perspective and need them to work and trust the police. i think not releasing it presents a problem. specifically on the issue of you see the gun right there, yeah, you do. but the fact is, as a person, may or may not have a gun. the issue become what's they were doing with the gun at the time they were shot. was there an immediacy of danger such that the police had to use excessive force? perhaps that was the case here. and if it was, then the case will go accordingly, but i think in order to get the full scale of this out and to get the community involved and to stop, you know, the protesting that is so vociferous the community nee

cedric, i'll go to you first. were there enough police officers on the street to gain control? >> i think under the issu circumstances in which they were working you have to be very methodical and you have to put the number of police officers out there that's needed. you can't understaff and at the same time, you don't want to overstaff either. so i think under the situation in which we're seeing now, there appears to be some calm. that particular team that's out there tonight, did their job and did it well. they tried to protect life and property as much as they were able to, and i think we need to applaud them on that, in terms of what they had to deal with in that community there tonight, so i think they did an appropriate job and i think they had adequate resources but i am without a shadow of a doubt very sure, as well, there in charlotte. they have a great leadership there in that police department that they needed -- they had it -- all the resources they needed and -- and moere resourcs if they needed to call. >> neil franklin, there has been a death and it is said to be
