the first one suggests that ingmar guandique murdered chandra levy in the course of kidnapping chandra levy there in rock creek park. there's another first-degree felony murder charge that suggests that ingmar guandique murdered chandra levy in the course of an attempted robbery. so why this complexity, why are these charges associated with kidnapping and attempted robbery? well, that is because it becomes a felony even if it was an accident. so even if ingmar guandique didn't mean to kill chandra levy, but he did it in the course of an attempted kidnapping or an attempted robbery, it still is first-degree felony murder here in d.c. so we're keeping an eye on this. so those are the first two counts that chandra levy -- that ingmar guandique faces. if the jury does not consider it first-degree felony murder, they have a fallback position they can go down to second-degree murder of chandra levy which it requires a little bit less proof, a little bit less evidence. on friday, the jury came back, they had a question that they needed resolved at the very end of the day and we suspect that m

ingmar guandique is accused of attacking chandra levy in rock creek park in may of 2001. he is currently serving a 10 year sentence for attacking two female joggers in the park around the time of levy's disappearance. the defense began its case by calling three witnesses this afternoon. now the jury has the rest of the week off and they will come back monday when the defense will present some more evidence in this case. the judge says he expects the closing arguments will be held on tuesday and the jury could get the case by wednesday. at d.c. superior court, paul wagner, fox 5 news. >> joining us as he has throughout this trial, noted defense attorney bernie grimm. so i got to ask you it was a surprise to the reporters today that the prosecution rested their case so soon. what's your thought? is this a bad sign for their case? >> i guess a bad sign based on the opening statement. it didn't end with a bang. it ended with a fizzle and based on the opening statement that the prosecution gave, i actually expected a lot more in terms of, you know, witnesses from penitentiaries

a big day in the chandra levy murder trial. the prosecutors wrapped up their case, dropping rape charges against ingmar guandique. apparently there was a hangup with the jail house informant who was expected to testify that guandique confessed to him to raping chandra levy. but even without the sexual assault counts, guandique is still facing charge that could send him to prison for life. robbery, kidnapping and murder. also in the courtroom today we heard again the name gary condit, the former congressman. an fbi technician testified that gary condit's dna was found under a stain on underwear found in chandra levy's apartment. but the trouble for prosecutors is that neither gary condit's dna nor ingmar guandique's dna was found with chandra levy's skeletal remains in rock creek park. >>> i'm delia gonsalves at the israel metropolitan cme church in northwest washington where nearly 100 people are being fed. >> we have two different produce for you today. >> reporter: volunteers are serving up food for the soul. >> you treat as

prove and prosecutor his no witnesses or dna evidence and no murder weapon linking guandique to chandra levy. instead, they pin their hopes on former cell mate armando morales who testified that guandique confessed to him he killed levy during a botched robbery tap. without hard evidence, prosecutors tried to establish a pattern of behavior for guandique. he attacked two women in rock croak park around the time chandra levy disappeared and said he struck from behind while they jogged on isolated trails and ran away after each woman fought him off. one of the dramatic moment of the trial came when former congressman gary condit took the stand. he was romantically linked to levy and initially considered a prime suspect. the police later cleared him of wrong doing but the defense lawyers tried to get him to admit he had an affair with her on the stand and he refused. we're getting a lot of reaction on to the verdict on line. one person said guandique knew it was coming, a matter of time and now it's time for him to pay for his crimes. a lot of folks, though, think the jury got this wrong. here'

intern chandra levy is in the hands of a jury. the defense and prosecution finished their closing arguments in the case of ingmar guandique yesterday. both sides are waiting for the verdict anxiously. courtney robinson is live outside d.c. superior court with the latest. >> good afternoon. many are waiting on this verdict. the jury began deliberating at 9:30. they are still deliberating. according to the prosecution, once the verdict comes down, that is the moment that the chandra levy family have been waiting for, nearly 10 years. innocent or guilty? 12 people will decide whether in my guandique murdered federal intern chandra levy in may of 2001, three weeks of testimony and evidence comes down to two days of arguments. for the prosecution is a case based on circumstantial evidence. they say that ingmar guandique is guilty left the woman to die in a remote area of rock creek park. there is overwhelming reasonable doubt according to the defense, and no physical evidence. they say it a guilty verdict would convict an innocent man.
