i'm charles coleman junior in for joy reid tonight.there was another major development today that could affect the 2024 republican presidential primaries. michigan's supreme court rejected a case brought by voters to block donald trump from the primary ballot. the michigan justices did not rule on whether trump engaged in insurrection. the case was rejected on procedural grounds. arguing, quote, we are not persuaded that the questions presented should be reviewed by this court, end quote. and the ruling comes in michigan just a brief period after the colorado supreme court made the opposite decision. that court barred trump from colorado's primary ballot for engaging in insurrection by inciting the january 6th attack. since then, the fbi has begun existing denver police and investigating violent threats to the justices who made that ruling. right, now trump faces losses to keep him off the ballot in at least a dozen states beyond colorado and michigan. let's just say he's got his hands full. michigan's highest court voted the voters su

i'm charles coleman junior, in for ali today. now, there is a groundbreaking new studich just found a strong lin between racism and chronic poor health conditions for black and brown communities in america. a team of researchers conducted the first of its kind study in dorm county, north carolina. and what it found was a correlation between markers of structural racism, such as income, education levels, and locations of housing, and a higher prevalence of illnesses like chronic kidney disease, diabetes, and hypertension in the community. in simpler terms, factors like high unemployment and subpar educational levels actually play a role in health outcomes. historically, black and brown individuals already suffer from disproportionately higher rates of these conditions, compared to other ethnic groups. this compounds the issue. the goal of the research is to avenge really develop and -- that can convince community health. for more on this, i'm joined by doctor ebony -- the senior author of that study, which was published this week

joining us now msnbc legal analyst charles coleman. charles, great to see you.sten to the arguments here and the justices' responses. which way do you think the supreme court is leaning? >> good morning, jonathan. it's difficult to say. one of the reasons why is it struck me as very, very odd that we're seeing these questions that were not necessarily being thrown around ideological lines. you just played a clip from judge kagen generally speaking is considered to be one of the more liberal judges on the court. what judge kagen was basically saying is a comment in favor of the individuals who were in favor of the settlement, basically saying these families were looking forward to being able to move past this chapter in their life after getting paid out. that's not something you would normally see a justice in her ideological position advocate for, because on the other side of that that would shield a third party in this case the sacklers from liability. it's very interesting to to see how this played out yesterday in court with respect to the questions that were

and former new york prosecutor and civil rights attorney charles coleman. charles, let's start with the law. because trump's lawyers have this new filing to stop proceedings in the election interference case. why file this if you still have to respond to the supreme court after jack smith's request? >> stephanie, a large part of what you are seeing from trump 's defense team is, let's throw everything at the wall and see what sticks. i can't say that it is a bad approach to try and get what they ultimately are after, which is a delay. and jack smith has, in the immediate, kind of given them a leg to stand over with respect to their argument. but it is interesting to see what jack smith is doing in the supreme court. because, if he is successful, what he is going to do is essentially take one of their biggest tenets of their defense away from them. so, in the short term, yes, this is something that should be unsurprising regarding donald trump's defense team and what they have decided to do in terms of looking to have this delay everything. but in the long ru

joining us to talk about this is former prosecutor and msnbc legal analyst, charles coleman.tegist, and msnbc political analyst, susan del percio, and democratic strategist, and former clinton adviser, guy l. smith. this move by trump's lawyers was not exactly unexpected but did anything jump out to you about this new filing? >> one of the things that continues to puzzle me about trump's legal defense team in terms of the immunity argument is they aren't leaving room to craft that some things are subject to presidential immunity. and some are not. they are going for a home run, and trying to swing at the fences, all acts undertaken by a president while sitting in office are subject to presidential immunity, and i think that's a bad approach. they're not giving the court a modicum to have a compromise. they might be able to find some degree of success. they aren't doing that. they're going pretty much in a binary model, zero su it all goes. it's all immune. i don't think that's the appropriate way to attack this sort of problem or legal issue. >> i wonder if you were surprised

with me now is nbc news legal analyst charles coleman junior., former brooklyn new york prosecutor, and host of the charles coleman podcast. charles, thank you for joining me. again, it remains to be seen whether or not the supreme court will take up this immunity case. would it be helpful for the court to weigh in on this once and for all? >> secretary castro, i don't necessarily know that we are going to get that far. despite jacks mitt's request, i think ultimately the supreme court may end up leaning on the notion that whatever trump did as far as what he is accused of in these cases is outside of the realm of what he did as president. meaning that he was not acting in his official capacity as president. the significance of that is if they lean to that as opposed to the actual immunity question itself, they punt that second question down the road. it kind of leaves the issue unresolved. i don't necessarily see them delving into the question of immunity directly if they don't have to. i expect that we will likely see them lean into the notion

i want to bring in civil rights attorney and msnbc legal analyst, charles coleman. good to see you.ument in this lawsuit and how likely is it to hold up? >> i think the argument in this case does have a lot of credence based off of what we are learning about the shooter's actions before the incident at the actual store. the fact this shooter went to other stores where the security guards were present and that seemed to have been a deterrent suggests that dollar general was ultimately negligent in not having a security guard to essentially enforce and protect in the same way at the location of the shooting. that is a significant deal. and when you couple that with the notion that there were reports of other violence which had been taking place, it also suggests there should have been measures put in place not only to protect customers but also workers as well. so what you're talking about is a standard of care that exists in certain places that has not carried over to the actual location where the shooting occurred and that discrepancy is going to be something attorneys are going to
