attention, but questions are being raised as to whether the rape charges against brock turner are merited. kron 4's charles clifford talked with a prominent local defense attorney who says the facts are not all in. nats in the criminal complaint against brock turner, he 's charged with 5 felony counts, counts one and two are for rape. the two witnesses to the alleged assault say they saw turner on top of the unconscious victim performing a sexual act.. specifically thrusting with his hips.. but neither witnesses can say for sure that turner was actually having sex with her. despite being only about 10 yards away, they also can't say if turner's pants were down or if they saw his penis. in an interview with investigators, turner states that he never took off his pants and that his penis was never exposed. he also says that his intentions were not to try and rape a girl without her consent. he claims that the two were engaged in a mutual interaction. the victim in this case, who admits she was drinking that night, says she doesn't remember being assaulted, or even meeting brock turner. she also says she does
