charlie, i want to start with you, because the justice department said in its filing the judge can in's request was, quote, is unnecessary and would significantly harm important governmental interests, including national security interests. i am very interested in your take on this, could a special master actually be harmful to the investigation, and the government's interests? >> it depends how broad the mandate that special master had, and whether the judge stop the government from doing what it is doing wally special master did his or her work. if they stop the government from doing what they are doing, i think the justice department would immediately appeal. the government is not just looking at these documents for the purpose of this criminal investigation into the mishandling of documents of national security secrets, obstruction, and concealment of government-owned records, it is also separately looking at it to conduct a risk assessment of the damage to national security that would ensue, if any of this information has been compromised, which they do not know, was kind of sitt

charlie savage and what more do we know about this ruling? >> good afternoon, lindsey, this is a significant setback obviously for the department of justice. judge eileen cannon in florida, a trump-appointed federal district judge agreed that trump did not show a callous disregard for rights and then has essentially ordered the imposition of a special master to review these 13,000 documents that have been seized at mar-a-lago, not only for the purpose of attorney/client privilege, to sift out attorney/client privilege documents, which is fairly standard but she went a step further and said this master should also examine documents to see whether they are subject to executive privilege. this is very strange. the d.o.j. argued in the court hearing last week that there was no real claim of executive privilege here, no -- [ no audio ] >> it looks like we don't hear ken anymore. let's go ahead and go to peter baker. peter, why don't you pick up where ken left off, what it means for the investigation moving forward. >> yeah, i think what ken was trying to get at is that this special master is going to look at these documents also through the len

. >> charlie, one of the things that came up in the discussions between the department of justice andal team is that the doj would like this wrapped up by october 17th. there is some relevance to that take given that we have elections in november. the trump team suggested taking 90 days. that is literally three times the amount of time. that fits. that may be the motivation here. maybe, in the end, just as barbara said, the information that is investigating the documents are a little bit different. it maybe eat another delay tactic. and i think that would not be an incorrect where do you think about this. we have seen president trump's legal strategy. it has been going back to when he was president. democrats took over congress and began trying to use oversight and use the legal system as a delaying tactic. they wanted to run out the clock. they wanted to fight everything. they wanted to slowly litigate it. take your time to write the briefs, have the arguments, get a ruling, appeal it to the next level and then start all over again to one of the clock. the clock was the next election

charlie, within the last hour, you wrote the breaking news article covering all of this ruling. what do we need to know? >> so, the bottom line, the justice department had gone yesterday to the federal judge who approved the special master and said, look, we can acquiesce to there being a master. we can acquiesce to not being allowed to touch 11,000 documents that we've seized from president trump's -- former president stepped home in club. but we can't live with -- someone giving access to the documents that were classified. please stay the portion of your order just we keep investigating those documents. she said no. tonight, they went to the 11th circuit, the federal appeals court that oversees florida. based in atlanta. and they're asking for them to issue a stay of just that portion of the ruling. that would allow them to resume unfettered access. just to the hundred or so documents with classification markings, which they say is important, for a variety of national security reasons. stephanie? >> neil, what do you think is the most important thing you learn tonight? >> well, i, mean the most important thing is that the justice depar

justice department. should the judge say maybe went a little too far here, why don't you back off at least as far as the classified material. >> barbara, charliehings. and point to point out there, as he brings up the 11th circuit court of appeals, you mentioned thistle as well. feasibly, the appeal of this could actually end up in the 11th circuit court of appeals. which obviously could be a conflict of interest, when we're talking about the appointment of a special master here. although let's begin first to these 100 or so classified documents, and which you tweeted out essentially the doj was kind of giving judge cannon a good carve out here. saving doj has given judge canada semi face saving option by allowing her to carve out classified documents from the special master's review. assessment of damage to our national security requires fbi access to these documents. judge should run to take this option. so, you're suggesting the judge should run to take this option. the question is whether or not she's going to take this option. obviously, we heard charlie in fact saying it's likely the trump team is going to say, no, no carve outs whatsoev
