scott is off tonight. i'm charlie rose. the police department and court system in ferg ferguson missouri engaged in racial bias against african americans routinely violating the constitution and the federal law. that is the conclusion tonight of a justice department investigation launched after a white ferguson police officer fatally shot an unarmed black man touring a confrontation last summer. mark strassman is in ferguson but we begin with jeff pegues in washington. >> reporter: the department of justice investigation examined 35,000 pages of records records from 2012-2014 and the numbers are stark. while 67% of ferguson's residents are african american, they made up 93% of those arrested and 90% of people given citations. and when an officer pulled someone over, 85% of the time it was an african american. when police used force 88% of the time it was against african americans. last month ferguson's police chief tom jackson was asked by cbs news correspondent dean reynolds whether bias existed in his department. >> repor

scott is off tonight. i'm charlie rose. this is our western edition in los angeles an investigation is under way into the fatal shooting yesterday of a homeless man by the police in what they say was a struggle over an officer's gun. carter evans has the latest. >> reporter: a bystander shot the video which shows police wrestling with a homeless man. as police handcuffed a woman who grabbed one of their batons, the struggle in the background quickly escalated. police say the man tried to grab one officer's gun and you can hear the buzz of taser. within seconds... [gunfire] three officers fired five shots. dennis horne captured the scene on his cell phone, as well. he does not believe the man was grabbing a gun. >> you're being tased, you'll be flailing. you're not necessarily reaching or grabbing for anything. >> reporter: but investigators countered that this afternoon, showing an enhanced image from the video they say shows the suspect's hand on the officer's gun. police also showed another image of the gun in his holster

charlie anderson live this evening in minneapolis. welcome. good to have you on. >> thanks for having me, scott. >> you had a neutral on this.ay? are we waiting for the valuation to get a little bit more palatable? >> yeah. i think so. you know, we have been neutral since last august. we have been waiting for, you know, the valuation to kind of be on our side. you know, for a long time and traded at, you know, 50 times earnings. 40 times earnings. we always said we were comfortable with something in the high 20s, low 30s on a p.e. basis. today it's trading 25 times the new '16 estimate. numbers have gone up. we have been able to raise estimates. we don't feel like we're being overly aggressive in the model. you're set up well for potentially any new products as well. all the model throughout don't have any revenue from the new products. thing is a company likely to extend into other categories over time. i think you have the ability to see estimates go up over time as well. >> lockup is in the rear view. the only thing i hear potential head winds is competition. what it's apple who will come into the space and challenge gopr
