there was concern i had with the sunshine task force around the city charter and some violations that were made but bruce was one individual that i thought was very committed to making reforms that were necessary to follow the city charter and i also believe has a strong commitment to sunshine and i will continue to support bruce wolfe as our appointee to the sunshine task force. i do want to thank both ms. simon and ms. forsley for your interest to serve. i think that there are a number of different committees and task force that your background would ideally suit and it seems there's more of a general interest to serve in any capacity, more than just specifically the sunshine task force itself. i know in mr. wolfe's circumstances he is specifically interested in sunshine and transparency and open government and for that reason i would like to support him as well. i want to recognize supervisor farrell's comments though regarding the fact that -- (no audio) -- i do want to give him an opportunity to do so, to meet with my colleagues and see if he's able to garner some other support.

there are actually sixteen places in the city charter where there can be a finding of official misconduct. there's this one plus fifteen others. at some point you are going to need regulations on how to handle that. admittingly the charter provisions are a mess. once you move away from what the mayor can do and the mayor cannot do but you still need the regulations. the other problems i have obviously the artificial statute of limitations one year from the date the records were asked for. it makes no sense and i think it's probably too restrictive to stand up to the constitutional requirement of how you interpret laws affecting public access. there's also a provision that the notes of the investigative individuals on investigating individuals are to be kept confidential until the decision is made. there's no basis for keeping any of those records confidential. that's been established. i think the quick case i filed a couple years ago probably established that principle. other than that, there is any number of glitches and such but i really think that taking another look at it is very help

sitting as commissioners today are familiar with the rate making process that is dictated in the city charterthat has been applied to water and sewer rates making most recently. same process for these rates. once our commission adopts a rate it will be forwarded to the board of supervisors where it will sit for not less than 30 days. no action on the part of the board means the rates go into effect, so anygaction on the part of the board suspends that process for opportunities for additional hearing and consideration of those rates. we hope to be -- if we stay on target with our schedule, we hope to be in that 30 day period in mid-december where -- excuse me, in mid-november through mid-december so that by mid-december we will have a. -- adopted the rates for the program and we will be in a more public mode with the turn of the calendar implementing our customer education and notification program, implementing the provisions that ask customers to tell us "are you in? are you out? ordinance task force composition, some of my colleagues have mentioned the brazen violation of the city charter when that task force decided to exempt itself from the charter's quorum requirement. you have to have a majority of all members vote for something to pass it, not just those present. this board has to act with six supervisors, his even if we have only six members present. the sunshine ordinance task force, because of attendance issues, exempted itself from that charter requirement. the task force, according to the reports prepared by the board's legislative and budget analyst determined that city employees had to go to the task force to have their case adjudicated 1.9 times. the task force was not handling its agenda property and as a result city employees would have to go multiple times, and that is a waste of taxpayer money, and it generates unneeded overtime. there were reference made to sunshine ordinance complaints against members of this board, it is true that since i've been on, there have been sunshine complaints filed against almost every member of the board. that's part of l
