we are appealing permits for the chase bank at the visit darrow - - at divisadero and oak street. we are back because we have not had the opportunity for a hearing, a conditional use hearing at planning. this is a vibrant small-business corridor that has successfully opposed chain stores moving into the neighborhood for years. chase proposes to merge three storefronts, and this project is in an nc-2 zoned area. there are several issues. the primary issue is formula retail. others have become apparent through the briefing from planning as well as from the permit holder. first, the formula retail law covers banks. the bank's claim there is an exemption for them from the formula retail laws, and they are absolutely incorrect. with due respect, they are mistreating the formula retail law, as is the planning department. second, from the papers filed, the square footage of the project appears to exceed 3999 square feet, which under the applicable law requires conditional use regardless of how this board determines the formula retell issue. the issue raised by planning in their brief --

danville police are investigating this morning's robbery of the chase bank on san juan valley boulevard just off 680. police say after 10:00 this morning, a man in his 20s seen here, approached a teller and demanded cash. he escaped on foot with about $20,000. tonight they've tentatively identified the suspect as the man with that white kind of head piece. a pen of interest believed to be involved in several other bank robberies throughout the bay area. some have been happeningthru since february. >>> over the years we've seen it all. the cal palace has hosted everything from the beatles to the rodeos. now it is host to a mountain of pge documents. they are using the buildings to sort through tens of thousands of boxes of papers. they include the records from the utility's gas and transmission pipelines in california. the puc gave pge to produce the records. it stems from the explosion that killed eight people and destroyed dozens of homes. since the incident, pge has been criticized for its faulty record keeping. >> while the city of santa clara is scrambling to save the statement. cit
