cheryl: u.s. america are the biggest names on this one but the regional banks as well, that's been one of the things that actually propelled that sector through the last, i would say, 2008 and 2009. people were afraid of the big banks. they wanted that personal connection. >> i agree and there's a role for the community and the regional banks but the reality is people are not conducting their business in this store. if a branch is not profitable, then the bank has to reconsider whether or not they want to keep that store occupy. what we're seeing is we would love to have faith in the community bank but if you're not going to show up and put your deposits with us, you're going to do your transactions on line, we don't need to keep them there. cheryl: what we've seen is about $$80 billion moving from index funds to etf's just coming off the first quarter. consumer staples, hhalth care, financials, i'm curious what you're seeing for the second quarter. there has to be some risk. you always warned me

cheryl: hello, everyone. i am cheryl casone. jobless claims at a four-month high. report. we have a guess that says do not fight the bank in japan, profit from it. dennis: the money trap a trap to catch hackers. cheryl: walgreens clinics going into the critical care business. doctor manny alvarez of head. dennis: the dow in the green despite some lackluster news. >> a disappointing number from the adp yesterday. as you can see, the dow is out by just ten points right now. the nasdaq is certainly weaker. it has been weaker all day. the transports are weaker for the third day in a row. yesterday we had a day when all ten s&p sectors were in the red. not the case today. materials outperforming. with the job jitters, we have a pretty tight range for the dow jones. volume two the upside, however. a mixed market now. back to you. cheryl: thank you very much. a very busy day. a lot of that has to do with japan. an aggressive plan to double its money supply in the next few years. david, last november you were here. you liked japanese equities. i am curious how you feel now

cheryl? cheryl: oil is on the rise crossing the $90 mark. sandra? >> hey, cheryl. it's been a huge couple weeks for commodities. volatility and volume as well. looking at the crude oil contract, back above $90 a barrel, and the most active front month contracts above $91 a barrel. nearly a $2 gain on the session. there's a couch l things at -- couple things at work. ubs, royal bank of scotland, they are increasing speculation in the marketplace that the european central bank is goong to cut its key interest rate to a record low. you have speculators buying up crude oil based on those reports, but you also got some fundamentals kicking in here. you got a report out from the government this morning showing a less than expected rise in crude inventories. that, too, is adding to the bullish sentiment in the market now, so a couple dollar gain in crude leading to higher prices for wholesale gasoline prices also up, heating oil up on the session, so a lot of these energies are feeling the heat today as a result of a couple big pieces of news both

now back to cheryl. cheryl: thank you very much. fascinating story with the players.t to us. well, we want to take a look at shares of alcoa right now. right now up a penny at $8.40. despite the company kicking earnings season off on a fairly upbeat note, they beat expectations. watch out. the earnings bar still may be set too high for many companies that trade on the s&p 500. vice president and senior equity analyst joins me now. i'm curious, you know, you're saying that really the comparisons year over year, we have to be really careful that q 1 is going to be, frankly, rough. so much for this rally, huh? >> yep. well, you know, we'll see what the stock market does. you can never really marry up what you think is going to happen and what you predict the stock market is going to do. but looking at it on a stock by stock basis, we're surprised that the number of preannouncements we've had already and i think it's going to be interesting as we start really meaningfully rolling through earnings season. i think we're going to hear a lot of companies talking down their ea

cheryl: you, too. one week ago today that the dow took that dramatic drop after hackers sent a false a.p. tweet. now regulators up, future trading commission are holding a hearing on the implications of using twitter to disseminate peter barnes is standing by at the white house. >> well, cheryl, that's right. you know, financial information through social media, twitter and facebook and other place $ a whole new world for regulators but this particular incident, we should point out, was about a hack. a hack of twitter -- of the associated press' account on twitter. a headline that said there were a couple of bombs at the white house and the president had been injured. today the commissihoeras regular meetings with financial firms and high frequency traders and exchanges about technology is -- has added to the agenda a conversation about this incident and twitter and what, if anything, to do about it going forward. it's not clear that regulators can do anything about stopping this kind of hacking other

i'm live in oakland, lyanne melendez. >> cheryl: thank you. san francisco police have released the names of two serial armed robbery suspects. these are two men. a third suspect was not named because he is juvenile. police say they used this long barreled gun in most of those robberies march 4th and 5th. he was arrested last month. he was shot after back go into an officer with a stolen bmw. both he and tillman remain in police custody. >>> police have arrested a man suspected of breaking into san francisco city hall and defacing the building. they believe shawn watson scrolled on the marble walls. this is video of the cleanup effort. he is being charged of burglary as well as vandalism and being held on $48,000 bail. >> dan: two oakland police officers on trial for killing an unarmed man are free to return to duties. they shot a 37-year-old man back in 2010. they thought he was releasing for a gun. the officers left federal court without speaking on camera. they told us they feel vindicated. federal grand jury ruled there was not enough evide

cheryl: 11:15.ren is live from the floor of the new york stock exchange with a look at j.c. penney. >> and a rare upday lately for j.c. penney. the stock is up two plus percent right now. the news is that much earlier than analysts had expected, j.c.p. is drawing about $850 billion from a $1.85 billion credit line. it needs to restock shvl shelves and replenish the inventory, not to mention launching the home stores. j.c. penney needs the money to do that. they're also bulking up their homes division at a time when the housing specter is doing better. they're trying to bulk that up again. perhaps to the old 20% where it was. and as you can see, in many ways with the new c.e.o. of j.c. penney, it's trying to get back to the way j.c. penney used to be but that system didn't work, either. so this is still a very confusing story for j.c. penney and shoppers and investors. back to you. cheryl: depressing for shareholders might be a better term. thank you very much. dennis: supreme court taking up a facto

cheryl: thank you.m now and riding this rally, our next guest has stepped out of your comfort zone and take a little bit of risk. joining me, president robert lynn. god -- good to see you again. utilities, staples, that has really been portfolios. you're saying, okay. make some moves. why now? >> it's been a comfortable trade lately. like you said, staples, utilities, names like coca-cola, you know, these are all names that you've been able to participate in the rally for quite a while. not only participate but they've been leading this rally. what really concerned me right now is it's just a little too comfortable and hey, if you want to make money, investing in something that's comfortable is probably not going to get you there. so when you look at the valuations on staples and utilities right now trading at sustainable going forward.at's there's other sectors in the market that people have steered from with valuations right now that are just extremely cheap. areas like technology, industrial, energy

cheryl? cheryl: dennis, yes.at the new york stock exchange once again and obviously security is heightened all throughout manhattan because of the terror attacks in boston yesterday and what we saw happen there but nobody knows about security, especially at large scale events, than bo dietl. large scale sporting event like the boston marathon, that was the target of whomever did this. homegrown or international, we don't know but this is what we know right now, though. >> what we know right now is that someone set two devices off yesterday, intentionally to maim and kill people. that's exactly what happened. as far as who is responsible, we do not know. it's the flowing investigation. there was a lot of misinformation yesterday. they said that they recovered unexploded bombs and they said they had a detonation of an explosive. a lot of stuff is coming over the wires and it's not true. like i say, i keep repeating, flowing investigation means that the terrorist task force is involved with the f.b.i. and the boston
