this woman, 67-year-old cheryl hepner, the potty-mouth grandmother of miglino's 3-year-old son. >> youter: you had no idea that cheryl hepner was going to come out. >> i don't talk to her. there's no reason to talk to her. i didn't know why she was stepping out. i didn't know why. i thought she was going to keep yelling at me. >> reporter: which is why he hit the record button in the first place. he tells "nightline" in an exclusive interview, heppner was holding miglino's bag and pillow. from behind it, she pulled a gun. >> she shoots, my reaction, as i came around. grabbed the gun. >> reporter: wow. >> grabbed this way. pushed her all the way back to the grass and was on top of her. and i was trying to take the gun away from her. >> reporter: miglino says he swats the gun away, grabs it and bolts. you can hear him wheezing, as he races back to his car. >> what's your emergency? >> she shot me. >> reporter: but heppner wasn't through yet. >> what's your emergency? >> someone just shot at me. >> reporter: police say lying, bold-face to a 911 dispatcher. >> did he pull the gun on you? o

this woman, 66-year-old cheryl hepner. >> i wnt believe you shot me! mouth grandmother of sal's 3-year-old son. she hid the gun behind the toddler's pillow. >> do you have an emergency? >> she [ bleep ] shot me. i recorded it. i knew something stupid was going happen. we're going through a divorce. >> reporter: but she wasn't through. >> 911, what is your emergency? >> 911, somebody just shot at me. >> reporter: lying, boldfaced, to a 911 dispatcher. >> he pulled the gun on you or you pulled on it him? >> he pulled it on me. he's got it. he got way. >> reporter: they believe she would have kept shooting and they have charged her with attempted first degree murder. this is only the fourth time miglino has seen the now viral video. >> i can't believe it happened. i just can't believe it happened, in my mind. i can't believe i got a second chance at life, to be honest with you. i've got a second chance to be with my boy. >> you okay? >> reporter: it was so traumatic that nearly three months later, he still thinks she's coming after him. cheryl hepner called 911 and puts the blame on her son-in-law. >> somebody just shot at me. >> did heu pull the gun on him? >> no. he pulled it on me and he's got it. he drove away. >> reporter: at the same time, moglino was speaking to another dispatcher. >> oh, my god. i'm shot. >> okay. >> i took the gun away from her. i have it. >> where are you shot? >> on my shoulder and my side. i can't believe she shot me. >> sal says he has an angel on his shoulder. and i have to tell you, had he not turned the way he did quickly enough, he would not be here. >> reporter: hepner now face as attempted murder charge. her attorney issued a statement declining to talk about the specifics of the case but saying "ms. hepner is distraught over this is den and the circumstances leading up to it as well as being sorry that mr. miglino was shot." the defendant has a court date. her husband is charged with accessory. he died from cancer last month. police are looking into what mr. miglino's wife had in this incident. >> if she's convicted she goes to jail for, what attempted murder? is that right? >> re
