that was the concept of chevron deference and has been the law of the land for decades now. the court has expressed hostility to the concept of chevron deference and to the administrative state overall, so we have before the court this term, cases squarely testing the question of whether they chevron doctrine should be overturned and replaced with something that would essentially let the court decide for itself what the scope of agency authorities are, and to second-guess agency interpretations of their own statutes and their own authority in a way that i think is creating definite concerns among those who study administrative law and the reason it would create a concern in the healthcare space is that there are so many agency determinations that are very consequential that are done by the agency through regulation and if the chevron doctrine is overturned, which it is largely expected to be done or to be cut back considerably, than what that means is that every agency rule -- think reimbursement under medicare, think fda decisions about the safety and efficacy of a new drug
