>>supervisor jane kim: thank you. i want to speak on the amendment before us. i sympathize with the amendment that supervisor yee moved forward. we did get a few e-mails from others from regarding rh 1d to remove this from legislation. i don't spupt at support that because i don't believe there is a reason for this legislation. if we were able to get an actual physical reason, policy reason about the type of residential housing that makes it difficult for them to legalize it would make sense. this is purely coming from a motion that the neighborhood would like to see and i think it's completely reasonable for supervisor yee to make that request on behalf of the residents that he represents. i think that's where that comes from. on the second motion that supervisor yee has moved forward i do plan on supporting a pilot program. i actually appreciate the work that has gone into a path way to legalize in law units. it's something that has vexed the city for decades and it's clearly a source of income for many single family home owners and d, a source of affordable units here in san francisco. however, i have a lot of concerns about the legislation that is being introduced in having unintended consequences and mine is a scenario that i brought up at land use committee which again is that as we know many of the tennants that live in in law units has been as articulated as a shadow economy and therefore because of that probably more affordable tend to be our most vulnerable residents, non-english speaking and able to live in these units because they are affordable. i'm concerned for property owners go through the process of spending the money and then pay more property taxes and not be able to raise the rent on their tennants that many people won't opt in this program. yes, there is a pathway, but nothing in here to ensure that any home owners opt into this program. the only home owners wanting to legalize and hope the tennants don't report it to the rent board because it's an illegal unit and they won't be prohibited by the 10-year no fault eviction provision that was carefully put into this legislation. a pilot would make me feel more comfortable. it would allow the legislation to move through and see who are the home owners who decide to opt into this program and are we incentivize the wrong behavior. if this is something that is successful, those that preserving affordable housing units and supporting the type of tennants that i heard about at land use committee, then this is of course legislation that i would support to make permanent. i think there has to be an incentive program, a stick or carat to get home owners to legalize their units and it's something i don't see in legislation. i think a lot of protections were put in and i appreciate the work put in to protect many of these tennants. i'm worried the tennants we are trying to protect are not protected by this legislation. those were just some of my thoughts on a motion. i won't be the supporting the first motion but i will support the second motion to amend. >> okay. if no further discussion we'll have a roll call vote to amend. >> can you clarify which. we have no. 1 and 2. city clerk: mr. chairman, the 2nd amendment made by mr. yee has not been motioned yet. we are taking the vote on the prohibition of rh 1 districts. >> are we voting on the amendment that exclude rh 1d? chiu? chiu thank you colleagues. this is legislation that i introduced last november for applying to legal status to our city. i want to thank supervisors wiener and mar and breed for their cosponsorship. we know that we have families being pushed out of the city and shadow economy involving illegal unit. there were 20-30 thousand in laws building in 1960 and 90 percent of them were not permitted. there are 8,000 of them illegal. that represented 10 percent of our housing stocks. who lives in these units? they are tennants and the most vulnerable tennants, seniors and families with many children, immigrants and lowest income and longer term residents. these are units affordable but often the tends are in them have challenged legal rights. 40-5 percent who live in these units don't have written leases. for many years there has been a calling for legalization. the housing element stated secondary units are housing method for expanding housing supply. california state law has proetd -- promoted state in laws. the city has turned a blind eye to these in laws and the housing has permitted of these in laws based on complaints. which is why i year ago icon convenience -- convened a large table. the san francisco tennants union, the asian law caucus, the chinese development center and housing clinic and others. on property owner sides the housing realtors and citywide housing advocates, spur, livable cities and many city departments that did work on this among others. what i'm proposed today is very simple that we allow an owner to legalize one existing in law unit without additional permit or a citywide basis. that we wave local planning rules that don't deal with like safety so they don't need to meet additional open space requirements, no additional need to add parking and no additional need for zoning. it does not require exits and entrances, fire and plumbing and electrical, etc. there are really three fold purposes why we move forward with this is to bring 10s of thousands of units to propose housing that are at risk of elimination and keep vacant units off the market. secondly, we wanted to move forward with this legislation to protect tennants who live with fear and vulnerability with regard to their tenancy status. there are five things we are doing for tennants, protecting and assuring rent control status, and this legislation does not permit cost pass through for major capital improvements and doesn't allow for subdivisions and counter conversion, and if there is construction to be done, this requires relocation and reimbursement and permits legalization if there have been no fault evictions for the legal process to begin. third, is to help home owners and first and foremost we know these values will exist if rented. secondly we produce planning and zoning, and we create certainty and clarity as these owners of these buildings rent and we want to make this as easy as possible with a very small nominal fee to move forward with this process and prescreening process to allow owners to bring up to code without any fear of enforcement. let me close with a couple final comments, we heard at our land use committee a lot of comments. we heard from someone renting in law units from friends but at risk of being evicted because a neighbor complaining of enforcement. we heard from others who testify to ease which tennants can be evicted from these units and we heard from home owners tonya sullivan who kepd her in law unit in her home vacant knowing she can't rent it out but can use it to support the family if this law passes. it affects tennants like brian and tonya. we believe this proposal would create a physical legal pathway to bound both housing preservation and both. do you want to take a moment to acknowledge this year long process and complicated issue and we heard from complications from a number of neighborhoods in supervisor yee's district. my response is these units already exist in homes throughout the entire city and they house thousands of residents, we need an alternative to the status quo. doing nothing is not a real solution. now, i do understand there are some on the other hand who think this legislation doesn't go far enough. that by allowing legalization to be volunteer rather than mandatory, not enough property owners will come forward to legalize these units. i appreciate that is a perspective. my response is really, we need to take a first major step in moving forward and we need to understand what's going on and our legislation requires every 6 months so there is monitoring with regard to what is happening on the ground with regard to legalization so we can take a step forwards and think about legalizing in a mandatory way. i would like to thank the 5 of us who are cosponsors to this legislation and i would ask for your support. >> supervisor yee? >>supervisor norman yee: thank you. supervisor's chiu's legislation can make some laws safer by requiring building code standards. i would acknowledge that. my priority as a supervisor is to do everything possible to maintain families and including protecting family housing. i don't like the legislation would allow in law units to be legalized citywide across all zoning districts no matter when the units were built and no matter what the neighborhood wants or needs. i cannot support such a far reaching change that doesn't respect decades of our best thinking around zoning and neighborhood preservation. rewards, illegal behavior by allowing landlords who broke the city's law, a path to legalization. this legislation could have unintended consequences which are the opposite of what the goals of the legislations are. this includes displacement of tennants, increase in rent. encourage speculation. for the units that can't be utilized does not enforce it's own code. i would like to add to this legislation. i'm sorry i didn't put this all in 1 p

walking see and smell and fresh and not so fresh air along fifth street and it was an important opportunity to be reminded about the need to insure there are safe and attractive walking routes. unfortunately, this recommender is as urgent as even the walk to workday was after the zero committee of the transportation authority that was held on april 1, '02 hours after a 3-year-old boy was hit in the richmond he's still roar from. i'm grateful to supervisor kim and supervisor yee and prefkt of that the community has come together and start delivering results we have a lot of work to do and but the signs of progress is encouraging. i also have to say there was another incident two people injured in my district on friday as well who are seriously injured from a car colliding with a mini stop so there's a lot of education to be had. i'm especially glad to see the sophisticated projects out of review and appreciate director reiskin and other head departments the transportation authority we're proud to make our resources available to help deliver projects across the city one example is the prop program that's to refund two really great projects the 1 is mcallister street both of which are on the walk first network i want to thank a couple folks and their staff wore working in the community to permitting prioritize two prop fund. as a reminder for the people prop w a funds are on the registration that the voter approved and finally speaking of transportation ability i want to thank john hayley and his staff who generously spent the afternoon to provide a tour of the transit district we >> offhand how they face the service each day among the crowded sfalts. we were struck by the investment of the katrero yard this houses our trolley cars. at the green yard their producing parts that are no longer available and they climb into pits to work on the under carnival. what was really impressive how much the muni staff are putting together resources to fix what should be minor problems if we had the up-to-date material. fortunately, we've been helping to address those needs and toured the metro east that's a more than facility that will oscillate the burdens of the yard and it will add storage for our to 60 foot couples and finally your central replacement fund will help with the fund to provide the transportation system for driving communication and vehicle reliability. thank you. again to the sfmta for making this possible and i look forward to having more improvements as we seek new transportation revenues in the fall this concludes my remarks. executive director my report is on your desk this month we begin are the recreational defeat the cap and interest trade at that heating up in the distribution of trade and cap resources that is different from the investigators proposal the investment in high speed rail where senator steven burger talks about other transportation. we'll be working hard with the counterpart to figure out how to best work with the santa fe san francisco needs across the state. transportation thirty discussions are continuing this month we've been doing outreach with sfmta to get the input from organizations the capital committee will look at the proposals at the may fifth meeting after which the board will continue the measures for the fall ballot the deadline is may 20th. we continue to work with city agencies an active application this is a reminderer for the walking and biking and will feature a non-infrastructure project coordinated with supervisor yee's office and other trail improvements before we so willed this i'll mention the ac p the active program they're going to apply for fund into in san francisco and the east bay. the zero vision committee i want to note the committee had a great meeting it was well attend and it talked about did role of the committee and the public involvement in the enforcement activity of the program the next meeting will be on june 8th and the mta draft list of 20 proposed projects is available for viewing on the website. we'll find a easy shortcut for the public soon. on the next several updates with a our project conditions with the state and local region level is the transit the ct c voted to have future state money into the project needs in order to complete the large project on time so the ct c delayed the program of $2 million for the chinatown brood study, however, we were able to keep the funds in the right time slot to be ready by working on a swap locally with dpw. those are some of the behind the scenes to make sure we're funded and it's a complex sort funding environmentalist and often challenges produce delivery and the traffic projects where our staff worked hard to wish work with the ata with the two-way operations that will not trigger the quality air we tried to get the funding and ran up against those to convert those projects to two ways with about the air quality and were able to get the funding identified. locally we're pleased to say that the urban tree guide the national and ushering guide is more available to the streets effort we want to thank caltrain's directors and secretary for their advocacy in turning this into the reality that the design guide is being implemented will be the reserve for san francisco and cities up and down the state of california. an example is for us sfmta will be able to critique circle tracks. another piece of good news the sfmta has adapted the transit effectiveness project and finishing the phase and the venice project is on your desk for both projects we're vshtd designs with our staff and trying to assure that each of those is reviewed we'll be holding an enter departmental meeting to finalize the outstanding issues around scope and cost and schedule and be bringing a report back on both projects. next, we want to drawing your attention to the yerba buena island ramp project the construction is under a way we're encountering an urban accepted challenge of north of birds on the island. we've identified this was anticipated with the environmental input report trying to cooperate with caltrain with the costs of working around the birds north site but if the north hablz continue there will be a delay so to offset that we're letting the contractor work on other parts we'll bring an update to see how we can work around this challenge. we're pleased and thank the board for speb the transportation authority as the agency this will help to implement the centerpiece of the transportation program which ask a center project those are fees for town hall and parking fees to support the bicycle on the oimd in addition, this includes followed out projects for the 28 line in addition to the m ocean project that has completed our procurement and we request a proposal so we began procurement we hope to get that going not spring the transit project continues with our advisory meeting on thursday 24 we'll meet to hear the sfmta project proposals as well as the infrastructure plan for the block development we're seeking a member to represent the enar he will side for the geneva seat go to sf.org and the bridge replacement project is moving forward a recent caltrain inspection of that bridge identified evidence of deterioration for emergency repairs so supervisor cowen said authorized the repairs to the bridge the repairs don't effect the traditional bye the bridge must be replaced so we're seeking a caltrain track plan to have that ahead of the local bridge program so we'll be doing outreach on the bridge project including at your seniors advisory meeting tomorrow night on 1455 market street on the condition of the status and the street vacation project to maximize contracting associated with those projects. tiger planning the good news on the transit front we're partnering with that on a large $3 million study we hope to receive grant fund from the federal government to look at the transmitting transbay and the connecting services from the recent adapted transportation plan and set up to prioritization and capacity improvements for consideration in the next regional transbay plan in 2017. on a related note i attend on update from tom and gras who presented at a recent breakfast event to the community both their plans to improve bart and for anyone who has taken bart those places are exploding many ridership. so bart discussed they're big 3 projects to shore up capacity for maintenance facility and i'll keep you posted on that we'll know by summer. we attend a spur panel on highway 101 to present on san francisco to see how we might develop a more efficient carpool lanes and possibly even explore an express lanes where the drivers will pay a fee for the project. i'm pleased to introduce defied our new planning director. we were pleased that david joined our agree and has gotten out in the community he comes from the offices where he led several bicycle sharing procurement as well as expansion projects for the brt system david has an extensive transit and planning background he worked in the city with the transportation and research institute. he studied engineering at the uc berkley and holds dual master degrees and we thank david for joining us we hope to introduce you over the next few weeks. finally, i want to express my grateful to chiu. at our rules committee we concerned the appoint it was our duty to appoint a member it was difficult i want to thank you president chiu and for her service as well. we are as the rules committee we're actually very lucky to have strong candidates it's good for the community there are people with expertise, however, because of victor's sensitive civil rights justice i want the board to consider a motion to promote him to the police commission. it conducted disciplinarian actions and i believe victor is the best candidate. we've heard about the extensive advocate for a champion for civil rights and on top of he has experienced the justice system as a attorney and the prosecution and defensive is an asset is and the and through the cases of the public defender he was on the shooting team investigating the police procedures and you criminal liberate and he's fought and has a record for the defendants and the plaintiff. this is the debt of knowledge and fairness to the position he will bring. i want to thank people who came to provide public comment during the rules committee. i was expressed about their commitment to protecting the community and his ability to work with all types of community. during my time on the board battling human trafficking is been addressed. this is a model program for the country. his expertise has helped with the are foreign consults and worked with the asian women's shelter and this is for human trafficking. he has prosecuted cases on folks and been an advocate for all community. he brings together coalitions he started the minority bar commission and started the equal justice society and served on the california state bar. in addition to his professional work and community service victor has mentored many and that's the personal accounts from his ment tests they have become excellent so again, i want to thank you for the opportunity to thank the police commission everyone has acknowledged your incredible work ethic and she's set the bar high. and through her regular work has been excellent. however, a candidate like victor we can't ignore the expertise and competed he's shown and the positive impact he's made on the community and sit back and do nothing we will be lucky to have him. victor previously applied to serve on the police commission in 2004 and in rules committee when there's more applicant we've encouraged applicant to reapply i want to give victor the opportunity to serve on the commission. with that, colleagues i'd like to request and make a motion and after consideration to appoint mr. wong to the police commission >> supervisor tang is making a motion to have victor's name on the vote. >> supervisor mar. thank you >> thank you president chiu i'd like to speak again that motion i don't feel that voting against the motion is i know directly of his incredible work i hope i've mentioned this to the mayor's office with the vacancy to fill carole king's seat that's a strong consideration but i'll speak in favor of angela's record i've known her for years not only in the chinese americans work but i speak in the rules committees support for angela chang. i feel her voice on the police commission is needed more than ever she's a hardworking person and we need that on the police commission. we reappointed dr. jill marshall and angela deserves to be reappointed because of her record and strong commitment to transparence socy and responderness to all people who come before the police commission. i want to acknowledge that issues like this can put the different part of the chinese and that community together there was not a division within the community and by continuing to support victor our community can be united in promoting stro

chiu. >> no. >> there are six ayes and five nos. >> the amendment passes and with that, are there further discussion. supervisor tang. >> thank you supervisor chiu. i wanted to kind of echo some of the comments that supervisor farrell made earlier and we've been focusing on the amendments that has taken place and that shows how varied these situations are. i think none of us feel good about anyone being evicted as a tenant, so thank you supervisor campos for spear heading this. a lot of my concerns has to do with the overall idea of this . there is no guarantee as a tenant if i'm going to receive this increase relocation payments that i'll use it here in san francisco to continue renting here in san francisco. and so that is something that definitely does concern me. the other thing is that i'm not sure -- i want to appreciate the controllers office and making sure they come up with a neutral and the most clear way they possibly could, i think, formula for determining this, however, it is based on a two year period and what happens after a tenant receives this relocation payment and after two years, they cannot have the income to sustain themselves in another unit that is higher rent than what they were paying previously. there's a host of other questions i have and not sure about the impact on this legislation, our goal is to make sure that tenants are stay here and live in san francisco. i'm not sure that this will achieve this. so that's why i'm uncomfortable with supporting the underlining ordinance today. >> supervisor wiener. >> thank you, mr. president. so i will support the legislation. and i appreciate all of the dialogue that we've had in committee and also here at the board. i know that sometimes people don't want to get caught up in the details. i think it actually is whether one supports this legislation, or doesn't support it, this is significant legislation. it has an impact on tenants and landlords and one can support it or not support it. it's important to get the details right even if those details are reasonable affecting a sub set of the universe where the legislation can come into play. i think it's worth it on having those discussions and i'm glad we did that at committee and at the full board w that said, i do think that looking at the big picture, this legislation is important. and we, as i mentioned last week, it seems like hardly a week goes by where i don't learn about another eviction in my district and i know i'm not hearing about them necessarily in other districts, so i can only imagine what is really happening and i know there's been some discussion about there aren't as many evictions now than in 2000 or the overall evictions, and it's a small number. whether it's a small or large number, it's having a huge impact on people's lives and when these evictions happening far often than not in my experience, you have seniors being impacted and people who are not going to be able to find other housing. people who may have lived in a neighborhood for decades and they're not going to be able to stay there. and so if it's a large number or if it's a small number in a way that's not really the issue. the issue is these folks are being impacted and it's important for us to take action, i think, that moves us in that action so i'll support the legislation. >> supervisor avalos. >> thank you president chiu. i want to thank supervisor campos for bringing this forward. all of us colleagues, not a day goes by where we hear from resident who are asking us to do something dramatics. we have the lee direction families or direct homes where people are occupying themselves to save them and those who have been living in their house for years and a 90 year old woman had just had a birthday will be evicted and she's been in her property for 50 years. this legislation is the dramatic things that we can do to stem a tide of these evictions happening at an epidemic rate. i want to thank supervisor campos for taking leadership on this and i want to thank the colleagues who are supporting and this will make a difference. it will be one tool and many teals we'll need to stop the affordability crisis here in san francisco. >> president -- i >> want to echo the comments that there's no silver bullet to our crisis, but i'm happy to support this legislation because this is one piece we need to help stem our
