"all in" starts right now. >> good evening from new york, i'm chris hayes. for a third night in a row, people are expected to be out on the streets in the st. louis area profetesting the shooting a black man. some demanding the arrest of police officer darren wilson following the death of 18-year-old michael brown. there was a tense standoff last night between police and protesters following the shooting death of 18 yield mi-y myers on wednesday. police say myers had a gun that he fired at the officer after an altercation, a charge his family disputes. and earlier today, his family identified myers on a store surveillance tape just before his fatal encounter with the officer. they reiterated, they do not believe he was armed. >> you can plainly see that he was not armed. his pants was almost hanging off his whole body. >> the same people who supposed to protect and serve they're taking their lives with no explanation and then they try to justify and then they put them out there as animals like they were animals and they was these hard core criminals and it h

i'm chris hayes. voting is already underway, the first real snapshot in two key states, there's some good news for democrats. in isle way, a statistical dead heat and democratic senatorial campaign said today that more than 21,000 iowans have already voted. of those, 53% are registered as democrats and just 19% are republicans and 28% are afill rated. over 44,000 people have requested ballots as of yesterday and over 18,000 of those people didn't vote in 2010. of those voters, nearly 29% are democrats. all of this is important because democrats are increasingly banking on holding on to the senate by using the turnout machine they've now spent six years building during the obama era. in the end, all that matters is who's going to turn out. and, right now, the polling using if existing likely voting models have republicans with a pretty strong lead. polls show republican senate candidates leading arkansas which are both debating tonight. the new york times has republican's chances of taking back the sen

i'm chris hayes. we have breaking news tonight. a seven-week manhunt has come to a close in pennsylvania for a man accused of killing one state trooper and seriously injuring another. eric frein, 31 years old, the son of retired army major who once said his son was a good shot who "doesn't miss" was captured today. he was caught at an airport. he has been taken into custody. he's accused of killing this man, state police corporal brian dickenson, as well as killing another state trooper on september 12th and, at the time, the officers didn't know who was shooting at them or where the fire was coming from. the ambush set off one of the largest manhunts in pennsylvania history. police immediately blocked roads, launched helicopters and flooded into the pocono mountains by the hundreds. the car belonged to locals deborah frein and her husband. inside, police found camouflage face paint, empty rifle cases, cartridge cases that match the ones found in the barracks and id for the couple's son, eric frein. trackers found items like soiled

i'm chris hayes. a nurse who was held against her will for three days in a mandatory quarantine is finally free tonight and heading home. the governor who put her there found himself under fire. here's what happened. right before we went on air, the governor of new york and governor of new jersey announced a new policy, a mandatory 10-day quarantine for anyone who had contact with ebola patients in west africa. the man date was done without bo bothering to inform the new york mayor. i happened to be speaking to new york's health commissioner about it. and when i asked her about it, it seemed like she, like the mayor, had only found out about the policy when it was rolled out. >> the policy would have applied to dr. spencer. you're thoughts? >> it just made news late today. and as you point out, we don't have anything in writing yet. i'm looking forward to seeing the written document. i've been assured by the state health department e department, the commissioner, that i'll have a chance to look at it.

i'm chris hayes. president obama canceled his plans today and convened an emergency meeting on ebola. in the face of mounting evidence that the government's response to the crisis has been shoddy, haphazard and insufficient to keep americans safe. the second nurse to contract ebola at a hospital in dallas has just touched down in atlanta on the way to emory university hospital which has already successfulle treated american aid workers who contracted ebola in west africa without any infections among its staff. the same cannot be said for texas health presbyterian hospital which treated thomas eric duncan, the liberian man who succumbed to the virus just over a week ago and where first nina pham and a second nurse identified as amber joy vinson, age 29, has tested positive for ebola after treating duncan. vinson reported to the hospital with a fever just a few hours after arriving on a flight from cleveland the previous evening. vinson boarded the plane with a temperature of 99.5 degrees, which the cdc
