our chris hayes was there, host of "all in with chris hayes." he broke that for us here on msnbc not too long ago. the individual that was leading the aclu in this effort, anthony romero, was there. he joins us by phone right now. anthony, first of all, just the amount of energy we see pictures of individuals with fists in the air and this was so expectant. first tell me about the reaction after you heard from the judge when it was said yes, this national stay has been granted. >> well, thank you for having me on the show. yes, it was we were incredibly moved and exhilarated by the reaction of folks on the street and social media. we were feverishly working through the night last night to make sure we were able to file this complaint and request for the stay and our demands on behalf of our clients but also a whole class of individuals we believe were affected by this unconstitutional executive order. when i was approaching the courthouse for the hearing, i was stunned to see hundreds of people already in front. we had only gotten word a couple

i want to go to the host of "all in" with chris hayes. he is at that courthouse where the aclu and other groups are trying -- what do you know right now? >> reporter: so i'm here, there are a thousand people near brooklyn. protesting and chanting. they're not letting anyone else in. there's an individual here, a policy analyst from one of the group who's brought the suit from inside the courtroom and has been tweeting. about a minute ago saying the stay has been granted. we don't know if it has. we're going to find out soon enough officially and particularly when folks come out here. there is a huge crowd. they'll go bonkers if the stay has happened. based on, i don't know if, what the right word is. manifest sloppiness and executed the last 12 to 14 hours. it would not surprise me if a judge grants it. there is a get showing of irreparable harm when people are being put on to planes to countries they may not be able to return from. the crowd is awaiting word. they press their noses to the glass to see whether the lawyers come out to offi

. >> chris hayes is along the route. chris, we haven't heard from you. >> reporter: how you doing, brian? i was out along, not far from the route earlier today talking to protesters. michael moore was up there. one of the things that struck me, talking to folks there is i've attended the last four inaugurations going back from 2000 and in year's past, the big protest have been scheduled on the same day as the inauguration. so in 2000, 2004, there were huge amounts of protesters, it filled the city much more. we, of course, have a situation where the big marches tomorrow, there's a smaller throng of folks, much more focussed on civil disobedience, smashing windows, but the fact that you have at this moment, which is the kind of peak moment of popularity. you have this very divide country as intensely divided as any at this moment in recent memory with the president who lost by three million votes and the popular vote. it really presents the question of whether the politics of the campaign can survive and succeed in the gov

i'm chris hayes. we begin with breaking news. the acting attorney general of the united states, that is the person who is most senior in the justice department right now tonight is calling president donald trump's travel ban indefensible. sally yates, a holdover from the obama administration is serving until trump's attorney general nominee is confirmed ordering the justice department not to defend president trump's immigration executive order in court. writing in a letter that, quote, my responsibility is to ensure that the position of the department of justice is not only legally defensible but informed by our best view of what the law is after consideration of all of the facts. in addition, i am responsible for ensuring the positions we take in court remain consistent with this institution's solemn obligation to always seek justice and stand for what is right. at present, i am not convinced that the defense of the executive order is consistent with these responsibilities nor am i convinced the executive order is lawful. which

i'm chris hayes. there are now just four days until donald trump is sworn in as this nation's 45th president. right now, he is poised to enter office amid a swirling and growing tornado of controversy that at least for any other political figure would widely be seen as creating a major legitimacy crisis. trump, of course, will become president despite hillary clinton winning the popular vote. the widest margin of any losing candidate in american history. he will take office despite any assessment from the intelligence community that the russian government interrupted to boost his chances and what influence the russian government may holdover him. while most presidents have seen their popularity hit a high point right before they are sworn in, trump is at historic lows. comparing to bill clinton's favorable rating of 66% and george w. bush's 62% and barack obama's nearly 80%, trump, by contrast, is sitting right now at just 40%. more than 20 points less than each of his three predecessors. trump is vie
