i'm chris hayes. a happy new year to you. a day after the release of what is probably the most -- i think definitely the most damning presidential phone call of all-time, the fall out over a president caught actively plotting sedition continues to grow at this hour. two house democrats are now asking the fbi to open a criminal probe into donald trump. i'll speak to one of them in just a few minutes. the fulton county district attorney released a statement saying, quote, like many americans i've found the news reports with the president's telephone call with the georgia secretary of state disturbing. anyone who commits a felony violation of georgia law in my jurisdiction will be held accountable. this afternoon the republican official in charge of georgia's voting system did a live point by point fact check of trump's preposterous claims about voting in that state. >> again, this is all easily provably false. yet the president persists. and by doing so, undermines georgian's faith in the election system, especially republican

just in the last hour on "all in with chris hayes" we had remarkable news. hakeem jeffries of new york telling chris tonight here on msnbc that he is the person described as congressman 1 in a quite scary court document unsealed today in the southern district of new york. a federal criminal complaint charging a 35-year-old man from california with threatening, not just threatening congressman hakeem jeffries but threatening him by threatening him to physically harm his family. trying to intimidate congressman jeffries by threatening to kill his family members in new york. the fbi and federal prosecutors say that the same man also in similar ways targeted the family of a prominent journalist as well. the "new york times" is reporting tonight the journalist in question is george stephanopoulus. the man has been arrested and charged that sent the threatening messages because he was "dissatisfied with the results of the 2020 presidential election and subsequent statements made by the congressman and the journalist." the defendant allegedly threatened to harm the

chris hayes. we are 40 hours from a transfer of power. unlike nearly all that came before, it cannot be characterized as a peaceful transfer of power. there has already been violence against the transfer of power incited by the outgoing president that left five people dead, including a police officer. this is what it looks like in a nation that had a violent threat to transfer of power. 25,000 troops stationed in the capitol, as if they were in a war zone. militarized green zone around the center of the city. much of washington, d.c. is utterly shutdown. there are lots of ways to describe the moment. but no one gets to say they didn't see it coming, that they were not warned. if there is one thing donald trump made clear from the beginning, going back to 2016, he never had any intention of conceding defeat if he lost, engaging in a smooth and peaceful transfer of power. >> will you commit to making sure there's a peaceful transferal of power after the election? >> we have to see what happens. you know that i have been complaining strongly

i'm chris hayes. tonight republicans in the united states senate took a vote to show that they have no intention to hold the former president accountable for his role in the january 6 assault in the capitol that led to the death of a capitol police officer. that vote comes as we learn new disturbing details of a threat that day against the family of a leading member of congress. today we learn of this, an indictment in the southern district of new york charging that on january 6, the day of the riot, the day of the assault, the day that people died in that building, a 35-year-old california man sent threatening text messages to a family member of a new york city-based u.s. congressman, including a text to his brother reading the following. your brother is putting your entire family at risk with his lies and other words. we are armed and nearby your house. you had better have a word with him. the target of the threat was the family of congressman hakeem jeffries. congressman jeffries will join us here

i'm chris hayes. one week after the trump-inspired siege at the capitol, the national guard deployed to defend the seat of american democracy. donald j. trump tonight has become the first president in the history of the united states to be impeached twice. this time for incitement insurrection for his role in summons the riot. it was a surreal scene. 10,000 national guardsmen streamed in to protect the capitol from the possibility of a second attack. they were wearing masks because we're in the midst of a once in a century pandemic with more than 130,000 people hospitalized across the country and over 4,000 people who died again just today. and the members of the house of representatives also, of course, in masks, several of their own having tested positive, they returned to the chamber where they had sheltered only feet away from gunshots. they arrived in order to impeach the president for his incitement of that mob who threatened their lives. a impeachment that marks him forever in history as the on

i'm chris hayes. the theme of president joe biden's inauguration day yesterday was unity. unity in a deeply divided country. a country still trembling from the unprecedented violent insurrection directed against the incoming administration and members of congress incited by the former president. that unity message was appropriate, i thought for our country right now. but here's the stark reality. the stark reality is that one party cannot just declare unity and have it be so. unity cannot be achieved unilaterally. it cannot be achieved without some course correction, some accountability, some self-reflection and an apology and retraction by those who played their part in the effort to overthrow the democratically elected government. base who basically sought to destroy american democracy in its current form. but what we say today, one day after the inauguration, the first day of this new era, is no such apology shall be forthcoming. congressional republicans, republican party in general, is going to attempt to pretend it all didn't happen. just turn the page and go back to
