i'm chris hayes. there are major developments in two of donald trump's for indictments. the first is out of the federal classified documents case in florida. we just learned that trump employee number 4, that's how he's identified, appears to be cooperating with special counsel jack smith. here's why that matters. in the superseding indictment, the one that came later, one of the most striking revelations was an exchange between to mar-a-lago employees describing how, quote, the boss, donald trump, wanted security surveillance footage deleted and an i. t. mar-a-lago worker also known as trump employee 4 refused. in a new court filing tonight, jack smith's team says that that guy, to various, as retracted his previous false statements surrounding the footage. he has fired his previous attorney, stanley woodward, who represents several other people in trump world. jack smith's team writes, immediately after receiving new council, he retracted his prior false testimony and provided information that implicated not, de oliveira, and trump in efforts to delete security camera

good evening from new york, i'm chris hayes. the department of justice is requesting severe penalties for five members of the far-right gang, the proud boys, convicted on some of the most serious charges we've seen in connection with the january 6th attack on the capitol. not to be clear, this is the second group of violent conspirators in the capitol attack that the doj has successfully prosecuted. over the past year, prosecutors secured convictions of six members of another group, the oath keepers. on the rare and serious crime of seditious conspiracy. the group's founder and leader, elmer stewart rhodes the third, the guy there, you see there. he's now serving an 18-year prison sentence. the longest yet in a january 6th case. but the request from federal prosecutors in the proud boys cases even harsher. the doj is seeking sentences of 20 to 30 years in prison for. enrique tarrio, who they described as quote, savvy propagandist and celebrity chairman of the -- the government requests 33 years. tarrio was the only of these five

i'm chris hayes. for the third time in four months, donald trump will be arrested and arraigned tomorrow. and a federal courthouse in washington, d.c.. he's got to be getting used to it by now. he will stand for a federal magistrate judge. he will enter a plea as he has done in the last two cases. in this new criminal case laid out against him for attempting to steal the 2020 election. tomorrow he will be returning to the scene of that crime, as laid out in the detailed and sprawling 45 deed indictment that special counsel jack smith. he's charged for a felony felony counts, conspiracy to file united states, count to conspiracy to obstruct an official proceeding, count three, obstruction of and attempt to obstruct official proceeding, and count four, a conspiracy against rights. that's a reconstruction law prosecutors used her to charge the ex president for a willfully seeking to disenfranchise voters. he is charged along six unindicted and named coconspirators, five of which are believed to be attorn

i'm chris hayes. we have a proposed date for donald trump's trial on charges he tried to steal the 2020 election. in a court filing today, special counsel jack smith asked for a start date of january 2nd, 2024. he said this would vindicate the public's interest in a speedy trial, that will ultimately be decided by the judge presiding in that case, judge tanya chutkan. but even assuming she chooses a somewhat later start, there may be some delays along the way, donald trump is probably going to face trial in this case before the presidential election next november. though he does have one critical possible hail mary remaining. he and his lawyers could try to somehow find a way to kick the case up to the supreme court, where the conservative majority would rescue him. that was one of the last desperate plans for donald trump's coup back in 2021, to get the supreme court to rule in his favor. we know there's at least one very conservative justice who one of trump's coup plotters thought would be particul
