our report tonight from nbc's chris jansing. >> reporter: when amy's husband john got laid off, they had credit card debt, big medical expenses, and two young sons. >> we didn't know what to do. it was either bankruptcy or cash in our iras. >> reporter: they decided to drain both of their retirement accounts, an increasingly common decision. a new study shows that more than 1 in 4 households with a 401(k) or other retirement account will withdraw some or all of it to pay for non-retirement needs, things like mortgages, credit card debt, and the kids' college tuition. but experts say it's a deeply troubling trend. >> if they cannot pay their bills while they have a paycheck coming in, how do they think they are going to pay those exact same bills later on in life when they no longer have a paycheck coming in? it makes no sense in any circumstance to take a loan from a 401(k). >> reporter: loans that result in penalties, taxes, and lost interest. people in their 40s are most likely to borrow against their 401(k)s, but the financial pressure doesn't end there. another new study by aarp

i'm chris jansing. we have been watching the opening statements coming from the senate armed services committee. this is expected to be a long and contentious confirmation hearing for chuck hagel. the president's choice to succeed leon panetta as the next secretary of defense. hagel faces questions from the 26-member panel and at least three republicans on this committee have already said they won't support him including the ranking senator james inhofe. he made that clear in his opening statement. now it is extremely rare for presidential nominees not to be confirmed, are and are senator dick durbin, the senate whip, said all 55 members of the senate democratic caucus will vote for him. so, in order to break the filibuster, he'd need the support of just five republicans. and one republican senator, thad cochrane, has expressed his support. let's bring in "time" magazine's assistant med tore and "washington post" columnist and msnbc contributor. we've already gotten a little preview as we heard from inh

i'm chris jansing. >>> well, we do have a deal, but it's not a done deal just yet. a little bit after 2:00 eastern time this morning, two hours after the u.s. economy officially went over the fiscal cliff, the senate passed a deal to avert its worst effects. the bill passed easily. it was a vote of 89-8, and it set up a showdown in the house which will convene four hours from now. republican leader mitch mcconnell said the process wasn't pretty but it got the job done. >> each of us could spend the rest of the week discussing what a perfect solution would have looked like, but the end result would have been the largest tax increase in american history. so, it took an imperfect solution to prevent our constituents from a very real financial pain, but in my view, it was worth the effort. >> so, here's what in that imperfect bill. tax rates will rise for individuals making over $400,000 and couples making more than $450,000. high-end rates for the estate tax and the capital gains tax will rise. all of those elements will be made permanent. in addition, the alternative
