christie smith is live in oakland at the scene with what is happening right now. christie. >> reporter: good morning to you. there is an improvement in the situation, and that is that two lanes are back open on the freeway off ramp, this is northbound 880 at market street near west oakland. now, what happened a little earlier is that a big rig caught fire. if we can pan over here, you can see the front of the cab there. i spoke briefly with the driver, and what he's saying is that he picked up a load from long beach and was heading to the port of oakland and driving and he heard a boom sound. he decided to pull over, see what was going on. then the engine started smoking and caught fire. fortunately he was able it to get out, but during that time, firefighters arrived here in oakland. they had to shut down the ramp so that they could put the fire out. now, they've been trying to talk with him about what he's carrying. he's not sure, but it doesn't seem to be dangerous and no fuel leaks, that sort of thing. they have called a tow truck in, but i just spoke with a ch

christie smith explains why this is such a big deal for that school district. istie, good morning. >> reporter: good morning, jon. 21 years and this school district finally owes absolutely nothing to the state of california. today, west contra costa unified school district is making its final payment on a huge loan. they are out here celebrating, paying it off early, giving $8 million payment to the state superintendent of public instruction. they're holding a ceremony at the rebuilt ford elementary school in richmond. this is huge for the district which had filed bankruptcy in 1991 and planned to close. it was the first to enter state receivership. they had a trustee and $28 million loan, with interest. over the years, they tell me they paid back $47 million. the school board president says even though state budget cuts are still an on-going problem, this is a hugep ste forward. the decisions, the finances now all their own. >> the taxpayers and the constituents over $2.5 million of interest payments, that goes back to the kids. that's where we as taxpayers wan

christie smith joins us live from the scene.ust talked with the chief. >> i can tell you one arson investigator is here on the scene, and more are on the way after a fast-moving fire ripped through the apartment building. the two units in the rear there are gutted. that's where the fire was when they arrived at stan burrow street at 12:30 this morning. the back of the building has a car port, and earlier we were told about five cars were burned back there. that battalion chief tells me it looks like more than 11 are burned down to a shell or damaged. the heat and flames forced people on the adjacent building out, too. no one was hurt and redwood city fire knocked down the flames quickly and determined this was suspicious. >> there's some things that were found with the cars, and there was a lot of fire when we arrived. all those -- the investigator believes that it was deliberate. it appears to be deliberate. >> the number of other apartment units here have smoke or water damage, so at least 27 people are displaced this morning.

"today in the bay's" christie smith live with the very latest. good morning. >> reporter: san mateo county d.a. is investigating this shooting along with south san francisco police. the memorial here is growing. when we were here late yesterday morning, there were only two stuffed animals and a note. so you can see how much it's changed just overnight. this is the scene where 15-year-old derek gaines was shot. the teen pulled a gun out while he was being chased by police. that was tuesday evening near a gas station on westboro, but his family -- it had to end this way -- tells us that she moved him to south san francisco to protect him from dangers in oakland. police will only say they were trying to stop a pair of teens who were acting -- that derek ran, they say, would not comply and pulled out a weapon. gaines' mom says he was walking home from a nearby mcdonald's and doesn't believe he even had a gun. >> i'm worried about the status quo in south city. that's what i'm worried about. i don't want to see another kid shot or hurt. or labeled. >>

christie smith is live at that scene where the family and friends of that 15-year-old. crying foul. christie, good morning. >> reporter: good morning to you, jon. we were here late yesterday morning, and there were only two stuffed animals and a note. you can see how things have changed overnight. friends and family keep coming out. derek gaines' aunt tells us she did everything to protect him. moving him across the bay from oakland thinking that would keep him safer, but the 15-year-old was shot and killed by police. this was tuesday night near a gas station. police said they tried to stop two teenagers because they were engaging in what they call suspicious behavior. but police didn't explain exactly what that behavior was. police say derek gaines ran and pulled out a gun prompting an officer to shoot. now, many who visited the memorial were skeptical about that description of events. but his mother says she thinks he was walking home from mcdonald's. she believes he was profiled and is worried about other teens in the area. >> i'm worried about the status quo in sout

christie smith is live in san francisco. sounds like a cool deal out there. >> reporter: who doesn't like free. the buses are starting to roll in this morning across the bay, and we've had a chance to talk with a couple of riders about the pluses and minuses of commuting using ac transit system. the message they are telling us give it a try. that's what ac transit is hoping for. we shot video of one of the first buses coming in to the transbay terminal where today workers from noon to 2:00 will give away free passes, good for each. >> at this time for me, the bus is the best. it works really good because i get off of work at 5:30 and i can right down market street and catch the pus at 6:00. >> reporter: there is a slight catch that it's only for new riders. each ride would normally cost you about 4.28. there is a good savings. the passes would be loaded onto a clipper card. the only negative that commuter shared is sometimes coming the other way he says that the buses bunch up and you have to end up waiting but he told us he

we have christie smith live where the department is expected to talk about the shooting in a half hour from now. christie, what is the latest out there? >> reporter: good morning. that is right, in 30 minutes, the san francisco police will come outside and talk about the officer-involved shooting that claimed the life of a teen. they have to the said much about it this morning, but we spoke with friends who knew him. they tell us he was just 14 years old. diana margola left a letter of condolen condolence. she says her son went to westborough middle school. they we they were out for the summer. the kids hung out at the mcdonald's where the incident happened last night at 9:00. the officers tried to stop two people. one of them ran. the officer saw a suspect with a gun and the officer feared for his life and opened fire. what the initial contact was about, police have to the said yes. those who know the teen are in shock. >> my son is 14 years old. he was with him the night before. i just think about my son and i just feel like it needs to stop. >> reporter: now that second suspect was

christie smith is live with more on what the mother had to say. christie, good morning. >> reporter: good morning to you. this was maybe a 30 minute court proceeding. first, the judge told the defense he would allow more time for them to prepare a motion. meantime, very emotional statements being read in court by the family about how the tragedy, losing three people has effected them. security was very tight outside the courtroom. metal detectors as the family of anthony bologna had time to read victim impact statements. the murder of tony and his sons in 2008. the d.a. suggested he shot the family in attempt to avery long the shooting of a fellow gang member, perhaps a case of mistaken identity. the defense said he was actually a fall guy for another killer who has since disappeared. today, bologna's widow held up photos of her family in court and delivered heart breaking words. this was the love of my life, my husband, a loving father that you took away. you could hear sobbing in the court from other family members. and about her son michael, she

christie smith has the latest. christie? >> reporter: good morning to you, laura. firefighters brought in a big load of lumber. they'll use that to try and shore up the carport area because it was so badly damaged in this fire. the building now has a yellow tag on it. residents can only get their belongings out but they can't stay. firefighters and police are working on this investigation together. they don't know how it started but it may have been set on purpose. car after car left a charred shell in a carport of an apartment building on stambaugh street. resident jose says he was up after midnight. >> i was on the computer last night. and i saw my dad's car beeping and knocked on my dad's door and said all the cars are burning. once i ran outside to see the cars, three blew up tame. >> reporter: the teen couldn't believe what he saw. five cars burned, another six had heat damage. he says he grabbed his two little sisters. >> i was standing in the middle, and i yelled to everybody to get out, and my mom -- i told my mom to call the firefighters and they came. >>

nbc bay area christie smith is live in san francisco to show us the impact of today's decision. christie, good morning. >> reporter: good morning to you, marla. there were no crowds outside of the courtroom as there have been in the past. no cheering. only a seven page document that was handed out just before 10:00 this morning, basically saying the 9th circuit court of appeals refused to reconsider a ruling from february that struck down proposition 8. there was one lone demonstrator outside the court in san francisco. many say they basically expected this decision for an 11 judge panel not to rehear a ruling that found the 2008 law unconstitutional because it strips gay and lesbians from the right to marry. they now have to look to the supreme court for answers. supporters say this is the next logical step. >> more good news from the court. we have been seeing momentum across the country saying that marriage discrimination is unconstitutional, and this is yet another ruling in this case saying that the prop 8 ruling, overturning proposition 8 stands. we are on the final lap wit

nbc bay area's christie smith is live in san jose with a look at everything going on in court today. kra christ christie, good morning. >> reporter: good morning, jon. a witness is on the stand who is says she worked at the sacred heart jesuit center for 14 years and she she actually walked in on this assault in progress. she testified this morning that she heard william lynch yelling, "you ruined my life. you ruined my brother es life." the trial of william lynch, accused of assault and elderly abuse of gerald lindner, a jesuit priest. this attack apparently happened in 2010. lynch says in the 1970s lindner molested him and his brother. mary eden says she saw lynch standing over him and aggress e aggressively hitting him, her words, that he had plood blood on his face, that lynch tried to leave and come back but stopped him from returning and let him know that a receptionist had called 911. on cross-examination, defense attorneys questioned why that version of events was not in the initial police report. the trial began last week in a courtroom that has spectators claiming to be vict

nbc bay area's christie smith is live at the scene where at least one person has been taken to the hospital so far. christie, good morning. >> reporter: good morning to you, marla. right now several alarmed ladder trucks are in front of the building basically blocking the street here. they have their ladders extended all the way up to this seven-story building. it's an apartment. you don't see smoke or flames because the fire was mostly in the back of the building. i just spoke with a firefighter, and they tell me that at this point it's almost contained. that's the good news. it started about 10:00 this morning on leavenworth between o'farrell and geary and quickly jumped to three alarms for several reasons, one being that the buildings are so close together and they wanted to make sure they surrounded this on all sides. firefighters are telling me that it spread quickly in what is called a light well, sort of a void space near the stairs. there's metal flashing in there, and the fire got behind that flashing and spread. it actually started on the lowest level, they're telling me, and move

christie smith live in oakland for the perk for the first riders this week.ood morning. >> good morning to you, laura. this is the first ferry service in the bay area since 1992, and more of a step forward toward creating a network of ferry services throughout the bay area. this one running between alameda and oakland square. another alternative to riding b.a.r.t., muni, caltrain, or driving across the bay bridge. rides to and from alameda are expected to take about 50 minutes. about 40 minutes each morning. now the ferry service, the terminal in south san francisco cost about $26 million to build and some major employers over there will offer shuttles. in fact, nine companies will offer shuttles for riders who get off there. there are three morning departures from the east bay and two return trips back to the east bay in the evening. one-way trip will cost you about $7. they take cash, credit, or clipper cards all okay. first boat leaves alameda at 6:25 this morning, here in oakland at 6:40. live in oakland, christie smith, "today in the bay." >>> this morni
