christie smith is live right now in treasure island with more details on this ongoing investigation. christie, good morning. >> reporter: good morning to you, jon. the coast guard is looking at human error as just one possibility behind this oil tanker accident. i want to step aside. you can see it out there lit up on the bay this morning. the coast guard also plans to interview the pilot of the empty tanker called the overseas raymar. the bridge itself is okay. no injuries with this. investigators say the ship is double hulled, seaworthy. no leaks. the coast guard is trying to figure out what went wrong here. the bar pilot has been identified as a 61 year old on the bay since 2007. the coast guard will review audiotap audiotapes. they were in contact just before the impact. >> the ship's captain they were in an outbound transit obviously and the coast guard gives an advisory to those folks. in communication with them just prior to the accident. >> reporter: state records show that he ran aground in san francisco in 2007 and in 2010 again. he passed an alcohol test, drug tests are sti

"today in the bay's" christie smith joins us now at the santa rosa sheriff's department with new details about the very suspicious death. good morning. >> reporter: good morning to you, laura and jon. sheriff's deputies are trying to get to the bottom of a very disturbing situation that started with an investigation of a suspicious car near sonoma state university. suspicious because of where it was parked. in the end they ended up finding a body in the trunk of a car wrapped in a blanket. they have not identified the victim or even how this person died but their investigation started around 6:30 last night with a car left in a no parking zone on petaluma hill road. a check of the license plate showed the car was tied to a person wanted for questioning in a crime that happened on friday near santa rosa. deputies looked closer and found evidence inside that they thought my have been tied to that crime on friday. they're not revealing a lot of information on what that crime was. again they looked closer. they found that the trunk was unlocked and inside was that body wrapped in a blanket.

christie smith is live in sunnyvale. christie, we're being told you just spoke with a man who actually made that 911 call. >> reporter: yeah, that's right. that one neighbor says, look, i did what anyone would do in this situation. he says he saw a burning home. he figured there were probably people inside. he banged on the door, couldn't get an answer. he even got a water hose and sprayed water on it. the woman who lived here was unable to get out of that room. >> and then i see flames in the window. so stopped the car, get out. >> reporter: michael had just finished walking his dog when he spotted a fire and did his best to help. >> start banging on the door, ringing the doorbell. and no answer. i don't hear anybody saying, what? or answering the door. i then hear the sirens. >> reporter: it was before midnight inside the plaza del ray mobile home community in sunnyvale. among the first to arrive, a police officer. >> the patrol officer came to the door, went inside and pulled them out. >> reporter: a unit in the rear w

reporting live in oakland, christie smith, "today in the bay." >> thank you, christie. vallejo police are now involved in a hazing investigation at a catholic high school that led to five students being expelled. police say several freshmen football players at st. patrick-st. vincent high school reported they were victims of sexual hazing rituals at the hands of the varsity players. the coach has since been fired and five of the alleged offenders have been expelled. >>> the family of a walnut creek man shot and killed by police last month is now suing that police department. officers shot 22-year-old anthony banta back on december 22nd after he charged at them with a knife. police say banta got in a fight with his roommate before officers arrived on scene. banta's family say the fight was over before police arrived and one officer fired his gun in a panic after another officer tripped and fell behind him. banta's family is suing four members of the police department for $15 million in damages. >>> want to switch gears and check in with meteorologist rob mayeda in for ch

"today in the bay's" christie smith is live in the city with an update on this story and a search and condition of that victim. christie, good morning. >> reporter: good morning, jon and marla. the victim in this horrible attack is in the hospital this morning in the burn unit here at st. francis hospital suffering severe burns to her face and chest. san francisco police are asking for the public's help trying to find her boyfriend, the man they believe is responsible, 22 years dexter oliver. witnesses watched in horror yesterday as he threw a flammable liquid on his girlfriend and then set her on fire. those witnesses include her family. family members say the two had been only dating for about six months and they had what they describe as a rocky relationship. they were arguing near a laundromat on hollister near generjennings when lamar told he relationship was over. >> she had to get out and it was over. she left the laundromat. ten minutes later she was burned. >> reporter: now he's accused of returning to the home to get some gasoline and there were burned clothes in the street

"today in the bay's" christie smith joins us live. we understand you spoke to the victim's family and they say he's a victim of mistaken identity. >> reporter: that's what at least one sister believes. i just spoke briefly with the stepdad who was so upset he had very little to say but i can tell you that he lives right near where this happened. i want to step aside. he lives in this unit here. you can see one officer there is where this shooting took place. the sister believes this young man may have been targeted because he just wasn't from here. she says there was a commotion outside of the unit and she spoke with him before that. next thing you know there was gunfire in the streets. one neighbor believes that this was likely gang related just because of the people who live around here. the shooting started around 12:16. neighbors called 911. they heard multiple shots fired. when deputies arrived, they found a 17-year-old down on the ground. those deputies tried cpr but it was too late. the sister said he had just celebrated his 17

"today in the bay's" christie smith is live in morgan hill right now. the principal says bullies do not belong at britton middle school even with most of the bullying happening off campus. >> reporter: that's right. when students come to class this morning, they're going to get the message. the punishment may sound harsh but this student was warned before that his behavior was way out of hand and this morning parents are feeling pretty good about the outcome that the bully was stopped in his track. the 13-year-old cited with a juvenile contact citation. morgan hill police say for a juvenile that's the same as an arrest. investigators say that britton middle school student harassed two 13-year-old classmates verbally, physically and even taunting them. one shooting plastic bbs at them, taunting them online. a school resource officer tried to warn the boy. >> shook his head. stated he understood. knew that his behavior was wrong and then went home and contacted the victims again through text messages, facebook and in person. >> reporter: the principal say

that's where "today in the bay's" christie smith joins us live with the one thing the suspects left behind that could lead police right for them. interesting, christie. >> reporter: good morning to you. new information. i just spoke with people inside the home who were robbed overnight and they are telling a very scary story. they didn't want to go on camera. they say they were inside at the time. these are students and they say five guys with hoods on came into the home and they had guns. they threatened them. they kicked the door down. they are thinking even though there's a gate in front of this home that maybe it wasn't locked and that's how they got in in the first place. what happened is that they say they took a kitchen knife and threatened them in addition to having the gun they say they heard banging and the door gave way. this was overnight about 3:00 in the morning here in the richmond district. they say that these guys got in and kept demanding money and marijuana asking for a large 50-pound bag of marijuana. they say the men believe this was a grow house in the past and they t

reporting live in marin city, christie smith, "today in the bay." >>> 5:32. jose international airport williams a new flight today on one of the most advanced planes in the sky. they will land its first flight from tokyo in just a couple hours. >> this comes as the faa opens an investigation into the aircraft after a round of safety mishaps at other airports. scott mcgrew has been looking into the problems with the dreamliner. the airline says it's not concerned? >> it points out the particular aircraft on its way to san jose right now due in just after 9:00 a.m. has been in use for more than a year. there are concerns about the airworthiness of the boeing 787 in general nicknamed the dreamliner. the model was delayed for years at boeing factories. in the last week or so we've seen several problems with 787s at a variety of airlines with a cracked windshield, fuel leak in boston and not the kind of publicity the airlines want. here's ana spokesperson last night. >> that is not our company. that's different airlines aircraft. we don't have any comment. >> in f

with that in mind, let's bring in "today in the bay's" christie smith live at treasure island right now with a look at what investigators are planning to ask that pilot today. christie, good morning. >> reporter: good morning to you, jon and laura. the coast guard is looking at human error as just one possibility behind this crash. the truth is right now they just don't know what went wrong when the tanker that you see out there hit a tower of the bay bridge as it headed out to sea late yesterday morning. they are going to be interviewing the pilot of the empty tanker called the "overseas reymar" this morning first thing. the pilot identified as 61-year-old guy kleess will report to the state board of pilot commissioners conducting its own investigation into this. caltrans says the impact didn't damage the structure of the bay bridge but a tower fender was ripped off. investigators say the vessel is double hulled so no leaks. it was empty but an oil spill response was activated just as a precaution. the coast guard is reviewing audiotapes and was in contact just before the crash. >> the

"today in the bay's" christie smith live in san francisco with a look at some of the changes. it's been a long time coming for this one. >> reporter: good morning to you, laura. this is really going to take some getting used to because san francisco has had free parking on sundays at meters since way back in the 1940s. of course what's different is back then most stores weren't open on sundays and now they are. the idea is let's say you have a starbucks or cleaners across the street. they want to make sure that people don't just leave their cars all day and everyone has a chance to park and that the cars keep cycling through. everyone has a fair shot. starting this sunday the municipal transportation agency is saying pay up on sundays at all san francisco parking meters. some church groups are saying this will leave their members running out in the middle of a sunday service just to pump quarters into the meters outside. the agency says that they are just going to run from noon to 6:00 on sunday. so you can also prepay or you can pay up to four hours so that shouldn't really b

nbc bay area's christie smith spoke with them this morning. she joins us with more. good morning. >> reporter: good morning to you, marla. the message coming out of the oakland police department this morning is that oakland has only one police chief, howard jordan, that bill bratton will offer advice on how to reduce crime here. doesn't have to be what worked in new york or l.a., but boy, there is a lot of doubt. the 2:00 a.m. vote brought a mix of relief and anger. the city council approved a contract hiring high profile police chief bill bratton to help oakland get a handle on violent crime, but opponents say his aggressive style just won't work here. >> i think that the zero tolerance also has this really destabilizing effect on communities. it relies a lot on kind of massive police sweeps and high numbers of arrests. >> reporter: some worry that bratton will use tactics like stop and frisk that may lead to racial profiling. >> racial profiling is illegal. it's not tolerated by the oakland police department. it's contrary to our policies. >> reporter: oakland has

nbc bay area's christie smith is live outside that home right now. christie, what's the latest? >> reporter: good morning, jon. the students who live in this unit behind me are completely shaken up. they say it was about 3:00 in the morning when some men kicked in the front door, demanding money and marijuana. they made them get down on the floor while they searched for it. >> i've never had a gun in my face before. that was pretty intense. >> reporter: he's scared to show his face and hearing his story, it's easy to understand why. five men broke into his richmond district duplex overnight. >> they ended up getting a little violent with us. hit some of the guys. they kicked me in the throat. >> reporter: it was 3:00 in the morning. after the ordeal, san francisco police spent hours at the scene. they gathered fingerprints from the kitchen knife the men used to threaten the college students and their friends. >> two of the guys went through all our stuff. and there was one guy holding us in the room. he kept asking for drugs and stuff. but we didn't have anything like that. we'r

christie smith was there for that announcement and she joins us now with the details of this plan. christie, good morning. >> reporter: good morning to you, john. state lawmakers and their supporters here in oakland know that they have a fight on their hands trying to regulate ammunition sales here in california, not just with the gun lobby but also with a number of people who think that something like this wouldn't be that effective, after all there is a black market here that you just can't regulate. they were led by assembly member skinner of berkeley and gathered in front of the state building to unveil ab 48 and they also held a moment of silence for the victims of the mass shooting in newtown, connecticut. but also, the dozen young people killed in the streets of oakland just last year. according to xirn, ab 448 would establish restrictions similar to those that cover gun sales in the state, requiring sellers to be licensed and buyers to have and show valid i.d. it would also ban kits that can convert guns to assault weapons, ammunition sales will be reported to the department

nbc bay area's christie smith joins us with what the mayor has laid out for us. good morning. >> reporter: good morning to you, jon. san francisco mayor ed lee talked jobs and legislation saying that san francisco is a city that's resurgent and strong. and yes, he did, take a minute to talk about the san francisco 49ers and their big super bowl run. we had a packed house at college track in the bayview. that's a new center that helps underserved students reach their college goals. in the crowd former san francisco mayor willie brown. lee asked brown to actually go easy on his speech in reviewing it since it's his first state of the city. lee said that unemployment is down to 6.5% compared to over 9% when he first took office. that downtown south of market business is moving in. san francisco he says remains a top destination for tourists. there are a number of big cranes working downtown, meaning more construction jobs. he's painting a picture of a city with a balanced two-year budget getting back on track. >> from the sunset to the mission to right here in the b

nbc bay area's christie smith is at the museum where mayor kwan spoke this morning regarding the burglaries. we're hearing there's now a reward being offered. >> reporter: good morning, marla. the museum is now offering a $12,000 reward for information that leads to them getting this historic gold rush era box back. it was stolen on monday of this week. bold break-in overnight when the museum was closed. now, they say this box is really distinct, the look of it if you saw it it would be easy to spot. at the same time they're not releasing a picture of it for us to share with you. oakland police say that that's part of their investigation. but here's where it was stolen from, an alarm box downstairs in the gold rush display. investigators believe the thief broke through a door on the side that led to a garden. the museum has called it priceless and would not confirm reports that this thing was worth perhaps up to $800,000. this is the second break-in. on november 12th someone broke in and stole some gold nuggets and other items from the same area. a security guard phoned it in. investigators

nbc bay area's christie smith is live in morgan hill this morning. they say that bullies do not belong at the school even though most of the bullying happened off campus. >> reporter: we've been speaking with parents this morning. most of them had no idea that a student here was citeded for bullying, but the more they hear about the circumstances, they seem to think it was the right thing to do, and students agree. parents at britton middle school say bullying has got to go. and if the police need to be called, then call him. >> if it comes down to scaring him, as far as the police and let him know, hey, you're causing, you know, harm to another person, then sure, yeah, i think it was the right thing to do. >> reporter: his son says if bullies approach he just tries not engage. >> i just walk away. i don't really try to fight with them. >> reporter: does it happen often? >> no. to me not really. >> reporter: good. morgan hill police arrest and cited a 13-year-old boy for bullying two other student. investigators say he would harass them on the phone,

"today in the bay's" christie smith is live at ocean beach where a storm surge is expected to kick up some very big waves come sunday. christie, be careful out there. >> reporter: thank you very much. good morning to you, marla. after two winters without an event, the mavericks surf invitational is finally back. they are expecting some big waves to come toward half moon bay. when i say big, they are talking 30 to 40-foot waves coming in off the coast there which means 24 big wave surfers from around the world are on the way here. a five-man committee made the decision earlier this week. we spoke with director jeff clark. five of the surfers involved will be riding a special surfboard that he designed this time to be much faster. with thousands of people expected in half moon bay, the locals are making plans to actually try to avoid all of the traffic. >> kind of makes locals angry. it's fun to watch. it's great living in a small town like this there's a lot of that tourists coming and traffic and it's hard to get around. >> staying at home and letting the people come in and spend thei

christie smith early for her reservation south of market. city of san francisco working with yelp on this project. >> reporter: good morning to you, scott. a restaurant score is on the san francisco health department website. in fact i just went and looked on it. the problem is that it's not that easy to find. you have to click on it. get into the data base and put the name of the restaurant in and you get the idea. it's much easier the way it is now. they are putting that score on the yelp website page. it's on the restaurant profile for any san francisco restaurant starting today. you click on it and it takes you to a second page with date and type of inspection and number and details of the violations if there are any and yelp is hoping what this might do is help raise the bar on food quality here in the city but for the restaurant industry, it's really about keeping the scores in perspective. for instance epic road house on embarcadero has a perfect score but the owner worries about this. >> i believe that the restaurant should be given

"today in the bay's" christie smith is live on the scene. what's going on now, christie?ter: good morning to you. san francisco police dealing with a very scary home invasion robbery. several armed men somehow got into this home and at the time there were several people inside, adult men and women. what's happened within the last couple of minutes is that investigators have made the crime scene a little bit wider this morning. they've been going up and down the block looking into bushes with a flashlight and that's because right in front of the home that was robbed they found a knife tossed into the bushes so crime scene investigators are out here and will take that and check it for fingerprints. they will look at what else may be tossed on the way out of the home. i talked to one officer who said the call came in at 3:00 this morning as an armed home invasion in the richmond district. they say the men took several things, cash, electronics including an iphone. investigators tried to track it for a while or ping it but the robbers may have turned it off. that didn't work.

"today in the bay's" christie smith is live by san francisco's masonic lodge on mission street with an inside look at how that beautiful work is shaping up. christie, good morning. >> reporter: good morning, jon. the 49ers love is pouring out the side of this building here in the mission district where this mural is absolutely incredible. this is the side of the masonic center and the building manager says that it had been tagged before and they thought put up something permanent. niners are in the super bowl. this is what we have. the city bleeds gold. one of the artists is here this morning. can you tell me how you came up with this design? >> we wanted to do something different versus a logo and city bleeds gold comes to mind. makes sense. building is pouring gold. forms a helmet. >> reporter: i wanted to show you what they are working with here. this is not stuff you get at the hardware store. this is specialized paint they use. >> this is made for artists by artists. it's expensive. $6 a can versus $3 a can. >> reporter: you obviously have done several other murals. there is niner

christie smith continues to reaffirm that. that's good news to and from 101 coming through san rafael. we're looking over here to san rafael flow of traffic picking up. slick roadways and maybe some low visibility through santa rosa and heading down into this area. just keep that in mind. be careful. we'll get another live look at 101 on the peninsula northbound with taillights toward willow where there was a second of morning traffic breaks that just took place. it's okay with lights. the sensors were showing slowdown on the map northbound toward the area but that just cleared. there was earlier garbage spilled on lanes near the willow and marsh areas that cleared from slowing. we'll look at south bay with a smooth drive northbound. there's slowing showing up center of your screen north 280 around 880 but no incidents there. 101 we typically see this burst second of the morning hitting and sticking now north of 680. we'll find 87 slow into downtown as well. getting a look at the southbound commutes through east bay, a little

christie smith is live on the little gnome that's becoming a big-time battle. od morning. >> reporter: good morning to you, jon. you can walk by these power poles and not even notice that there is a gnome down at the bottom. when we pulled up, we noticed them on that pole there. the one in the middle and this one where we are standing. they are posted down at the bottom. they are a quirky light hearted twist for a city struggling with violence and painted on little wooden boards and screwed in. as you said, not everyone happy about it. we'll get to that in a minute. some of them are gnomes. some are more rare. a mushroom next to them. according to the chronicle. the gnome creator is unknown. no one knows who it is. over the past six months they sprouted like mushrooms around the area. there could be by some estimates hundreds of them. according to the chronicle, pg&e which owns some of these poles, want the gnomes removed concerned it could give other people ideas for placing other things on their property and they don't want that. they have also popped up on a
