ktvu christien kafton joins us now from gilroy. following the details of this tragedy. >> reporter: good morning. we have been out here since 4:30 this morning. this is a community that is still trying to come tigrisens with this murder-suicide. there was a candle light vigil here last night. you can see the candle still it will outside. gilroy police still searching for one more victim. her mother. they found forensic evidence martha gutierrez is critically injured or dead. no one has seen her since wednesday night. on wednesday police were called to this apartment complex after they found lucy luna and her brother abel gutierrez dead in a bathroom. it appears abel first killed his sister and turned the gun on himself. police suspect he may have killed his mother martha gutierrez as well. family members say after abel returned from iraq he was suicidal. this morning we managed to catch up with neighbors that are mourning this morning the loss of a very well liked family. >> good family. good girl. he played with my son. he's nice.

christien kafton joins us from okay land. >> reporter: we have been trying to find more neighbors in the neighborhood to talk about that shooting. so far the few neighbors i have spoken to didn't know about it. take a look you can still see some evidence of that shooting. there is crime scene tape over here. that neighbor that didn't want to appear on -- by those stairs right over there. to give you am sense of where we are. we are at the intersection of birch and 90th avenue. this happened last night at 9:00. oakland police officers opened fire on a man they say was armed with a shotgun. there is no word if the man rised the shotgun and took aim at the officers. we -- we do know how -- in stable condition we are hearing he is expected to survive his

ktvu christien kafton joins us from oakland with what we have learned in the past 30 minutes. >> reporter: we are starting to uncover more details. we spoke with a neighbor he tells us last nights officer involved shooting happened inside these gates on those stairs here. we are at the corner of birch and 90th avenue in oakland. this whole thing happened at 9:00 last night. oakland police opened fire on a man that they say was armed with a shotgun the officer that fired on was taken to oakland hospital. police say they have recovered that shoot gun and they say the incident is under investigation. we are hearing police may have been tailing that man for some time before that shooting and may have been a suspect in another incident. meanwhile we have learned there was another shooting in this neighborhood just a month ago. we were over there and got video of that scene. a 17-year-old boy was shot at the intersection of birch and 80th. that is just about eight blocks from here. no word at this point if the two incidents are connected. coming back here live you can see that incident happenin

but first, let's go to christien kafton. >> reporter: good morning, dave.lmo. up around 25 minutes ago, we were up near the home where the tree was. now, the sun has come up. you can see the damage that the oak tree did when it crashed into the home. it all happened around 7:00 last night. the oak tree came crashing down, briefly trapping three people inside. everyone was okay. but firefighters had to help get the residents out of the house. the home's owner came to check out the damage about 45 minutes ago. while we were ordering, inspectors were preparing to inspect the home. >> this one visually now does not look safe. we'll be making that determination in the next few minutes. >> reporter: that inspection is still underway. while we were on scene, we saw the only way in and out of that house is through a ladder loo leading up to a searkd -- ladder leading up. as you can see, the creek is nowhere near the flood stage now. you can see that yesterday's rains have certainly filled the creek here. it's running fast and deep. again, nowhere near flood stage b

christien kafton has more. >> reporter: i was in the courtroom when the judge barred -- ruled that our cameras were allowed to record the proceedings but not our face. the public defender requested that his office represent them. but the prosecutor objected because the prosecutor represented luc's brother and the judge removed adachi from the case. >> we believe the judge's decision was wrong and she didn't follow the law. >> reporter: luc is still face -- is still facing homicide charges. >> i'm very new to the case. based upon the charges, the initial concern would be that he's charged with a multiple homicide. she's charged with special circumstances which make him eligible for the death penalty. >> reporter: luc is scheduled to be formally charged and will be entering a not guilty plea on april 5th. meanwhile, jeff adachi said at a news conference immediately following the hearing that he will be appealing the judge's decision. that appeal is expected to come within a week. now david stevenson is following all of these rapid new developments on this case and we'll have the latest f

christien kafton just received new information. good morning. >> reporter: good morning.came here to oakland police headquarters looking for more information, more answers about that officer-involved shooting. and in the last 20 minutes we got more details about that officer-involved shooting. we have video of the suspect in this case being taken to the hospital following that shooting. witnesses say they heard shots at about 9:00 last night and saw the officers and suspects. police now tell us that a pair of officers were looking for a suspect in the area of 90th and burch here in oakland. investigators say when they found the suspect, he ran and the officers chased him. at some point they say the suspect produced a shot gun. the suspect was taken to highland hospital here in oakland in stable condition. he's expected to survive. they've recovered the shot gun. a public information officer is look to talk to witnesses. when we have more information we'll bring it to you. we will continue to dig for more information about the officer-involved shooting here in oakland. chr

christien kafton joins us with more. >> reporter: ken, we've been working on this story, as you know, morning. in the past hour we've moved and in the last ten minutes i was actually up there in the headquarters looking for more information about this apparent murder suicide. i spoke with some people and they say there's no updates for the mother. now, investigators say they've found forensic evidence that his mother is either critically injure order dead. no one has seen her since wednesday night when this all unfolded. police were found to the apartment complex after they found the 11-year-old sister. family members say after the man returned from iraq, he was suicidal. they say that the 11-year-old pay be the -- may be the first victim. the last time they saw the mother was on wednesday in the laundry air yu but they are still hoping that she survived her son's rage. >> we are really hoping and praying. maybe she's somewhere holding onto dear life. but if -- but if she is, i can't imagine what she's thinking. police reaferned the -- learned the man moved into -- in with his mother
