christien kafton has been along 121 all morning and christian investigators say alcohol likely a factor in this crash. >> reporter: yeah, that is one of the things they are certainly looking into, they believe it is a likely factor in this accident that happened after 7:00 on this stretch of road here, 121, killing one person, sending three others to the hospital, one of them a 5- year-old girl. investigators say the driver was driving a jaguar south along 121 and witnesses say he crossed the center line to pass other cars and that is when the collision happened, again it crossed into traffic and a toyota hit that jaguar head on. a 26-year-old man in his jaguar was killed in the intact. the driver of the toyota and a 5-year-old girl in that car was also injured, that girl we are hearing again with major injuries flown to children's hospital in oakland. chondrayedas was taken to a hospital as well, no word on how serious his injuries are, they are looking to see if he was intoxicated when they say he veered into oncoming lanes. >> the driver of the jaguar is being investigated for potent

christien kafton is there now to tell us what happened out there. good morning, christian. >> reporter: good morning. since we have arrived here we learned the whole incident happened on the opposite side of this vacant lot. officers were on routine patrol over there. they say they found the individual with a replica gun. shot him dead on the sidewalk over there. the press democrat is reporting the person that was shot is a 13-year-old boy. so far sheriffs deputies not releasing much details about that at this point. investigators did e-mail us a photo of the replica weapon last night. a realistic looking assault rifle. the person that was carrying it refused to drop it after repeated orders to put it down. it all happened around 3:00 yesterday afternoon. officer were on routine patrol in the area, saw the person with what appeared to be a gun and called for backup. the sheriffs office said deputies repeatedly asked that person to put the gun down. when he didn't comply they shot him. they also found a replica handgun tucked into his waistband as we

christien kafton tells us friends are identifying the teen and then say he was no threat. >> reporter: he friends say 13- year-old andy lopez is dead after sonoma county sheriff deputies mistook a toy gun for a real assault rifle and shot the teen. at about 3:00 yesterday afternoon, two deputies on routine patrol near the intersection of moreland and west robles avenue saw someone with what appeared to be an assault rifle. the deputies say they repeated told him to drop the gun and when he didn't opened fire. investigators say he died on the scene. it wasn't until later, deputies discovered that the rifle was a toy, as was the plastic pistol they found tucked into his waistband. >> he was sweet. he loved everyone. he would never hurt nobody. >> reporter: this girl says several boys in the neighborhood share the toy gun he had yad and she doesn't understand how deputies could have mistaken it for a real weapon. >> it had an orange thing on it, the orange tip and it's obvious that it is fake when -- you know, if it has an orange tip, it's fake. you could notice it by looking at it. >> r

but ktvu's christien kafton says the protests aren't over yet. you are live at city hall. e protesters will meet again later. what's going on, christien? >> reporter: yeah, that's exactly right. protests planned here at city hall at 12:30. we were at dolores park at 12:30 this morning as the protest was ecbreaking you. we have video -- was breaking up. we have video of it. this was an overnight protests. they were angered over scott wiener, his plan to close the city parks between midnight and 5:00 a.m. now, there were about two dozen campers who stayed the night there. they say the plan would eventually criminalize being poor. they said it would be unfair to homeless people who have nowhere else to go. supervisor wiener says closing the parks would give the police another tool to fight the quality of life crime like illegal dumps and vandalism. right now, have an enorm out amount of vandalism and dumping that happens in the park. the cost -- it cost the parks department more than a million dollars a year and happens in the middle of the night almost excluesively. >> both v
