christien kafton is live with more. >> reporter: good morning. we also have new information about a new countywide effort to crack down on drunk driving incidents. but let's talk about this accident that happened here on highway 121. this accident killing one person, injuring three others. one of those injured was a 5- year-old girl. we're hearing she had major injuries. investigators say 25-year-old was driving a 1997 jaguar south along highway 121. witnesses say he crossed the center line to pass some other cars and that's when the collision occurred. the jaguar crossed into oncoming traffic and a toyota coming in the opposite direction hit that jaguar head on. a 21-year-old was dilled in the accident -- killed in the accident. the 26-year-old driveert of the toyota and a 5-year-old girl both injured. that 5-year-old flown to children's hospital in oakland with what are being called major injuries. the man was taken to the hospital. no word on how serious his injuries were. chp investigators tell ktvu that they are looking to see if the man was

christien kafton has been working this story all morning. and a clear look at where all of this happened. >> reporter: we have a closer look at where this happened. the incident unfolded here. take a look to the left of that evidence markers where shell casings appear to have landed. the person shot here was a 13- year-old boy who lived in the neighborhood. and now we are getting our first indications about what kind of kid this boy might have been. investigators did e-mail us a photo of the replica weapon last night. a realistic looking ak47 style assault weapon. they say the person carrying it refused to drop it after repeated orders to put it down. investigators say it all happened around 3:00 yesterday afternoon. they say officers were on routine patrol in the area. saw the person with what appeared to be a gun and called for backup. the deputies repeatedly orders person to put that gun down and when he refused they opened fire. he was pronounced dead at the scene. workers say the boy involved stopped in frequently and was a good kid. >>
