christie smith is live in oakland.rdinary story but it's possible. >> reporter: it is very odd but i did ask the firefighter before he left and he said it is possible, in fact, they heard of it before. i spoke with a family inside the home and it's a total loss. what the man of the home is telling me is that they had to use the burners for heat and that's because the heater in the house wasn't working. he says that they think a mouse ran across the stove and that's how the fire spread. i wanted to show you some video that a neighbor shared with what he saw at around 2:40 this morning. flames pouring from the roof of a home on 90th avenue. this is a modular home. very close to the two homes next to. three people inside at the time. a man, his girlfriend and their baby. what he's telling me is that they were sleeping and that the girlfriend heard something moving in the kitchen. they went in and that's when they saw that the house was burning. they got out, it spread to the walls of the two other homes fortunately vacant

christie smith joins us live with some new developments. good morning. >> reporter: good morning to you. we understand that the family may still be looking for some sort of medical facility that would be willing to take jahi mcmath but at this point children's hospital is saying barring any new court order that would have to come before 5:00 p.m. this evening, that a judge has ruled that they can take the 13-year-old girl off a ventilator at 5:00. the hospital does say that's what it intends to do. again, unless the court steps in. the family says that they had a facility in l.a. but that's no longer an option which only leaves one other facility in new york, still waiting for where that stands. another facility in the bay area is out. at this point it's unclear what will happen next. the family's pastor did lead a prayer service but called off a fund-raiser because no medical location was secure yet for jahi. she was declared brain dead on december 12 after severe complications to have her tonsils removed. she suffered from sleep apnea, th

christie smith is taking a closer look. she's going to have a closer look. >> investigators are looking into whether two men arrested for a high end wine heist in seattle are tied to a similar crime in the bay area. chase cain live in san francisco with the details. good morning, chase. >> reporter: good morning, terry. when you are digging into the details of what happened it's like an oceans 11 type heist. that's why san francisco police are talking to seattle police to see if these two crimes are connected because it's valid at three quarters of a million dollars of wine stolen. in that case in seattle we're talking about 2500 bottles ever wine taken from a high end wine store there, the thieves broke in twice, once to spray paint over security cameras and broke in on thanksgiving cutting a hole in the wall, stealing wine, then puncturing a gas line igniting that trying to set off an explosion. that did not happen but they did get away with $648,000 worth of wine. one of the suspects tried to sell that wine to a broker f

christie smith joins us live with the latest details. good morning. >> reporter: good morning to you. what this means is now that the family has until next tuesday to try and get jahi mcmath moved from children's hospital to a long term care facility. they think they have something lined up back east. as you said, this came after a judge ordered the hospital to keep the girl on a ventilator and it came at the last minute, about 4:00. right before children's hospital could have legally turned off the machine. her family spoke with reporters outside in a case that grabbed national attention. jahi went in for tonsil surgery and get tissue removed to help her breathe on december 9. there were complications, three days later she was declared brain dead. the family has maintained all along they still believe she's alive. they went to court and tried to line up facilities to take her two backed out but they say they have one in new york in mind. according to the hospital they still need ensure that any move like this is legal. and because she h

christie smith is live at the scene in oakland. crews say they have those flames contained now? >> reporter: yeah, that's what it looks like. when we first arrived, flames were pouring from the ground where this gas pump once stood. like a pilot like just shoot ou out. firefighters have sprayed what looked like flame retardant on it very carefully, while others kept a safe distance, maybe a half a block away. an suv crashed at this station. the front end of the car completely smashed. it's still on scene. and firefighters sprayed that a couple of minutes ago, too. the initial cause was actually a medical cause, but with the fire at a gas station, this quickly jumped to two alarms. i asked about the driver and he said he may have been transported and someone else arrested. right next to the gas station is an apartment building. this is the brookfield place. if steve can pan over. you can see that the windows here are completely dark. i spoke with a couple of people walking by and they told me they were evacuated, told to just go around the corner for a little while until the situ

we'll start with christie smith live at oakland children's hospital where a 13-year-old girl is now brainead after a routine tonsil surgery. christie? >> reporter: yeah, good morning to you, terry. i spoke to the family this morning as they are distraught and confused. a 13-year-old girl goes in to get her tonsils removed and ends up brain dead. they do not want her removed from life support. 13-year-old jahai mcmass. they shared a photo of her before surgery with her mother on monday inside of children's hospital for the surgery. after surgery she had a popsicle and seemed okay. later on she had excessive bleeding and the hospital staff didn't do enough to help her. the girl's grandmother at another hospital noticed it was getting worse. >> my grandmother yelled, everyone get in here now! then they came in and she went into cardiac arrest. >> reporter: now, i just received a statement from the hospital saying we are very sad about her condition and our hearts go out to her family. we are currently reviewing the case and do not have any information to make a further statement at this time

christie smith live in oakland, she joins us with the very late les. good morning. >> reporter: good morning to you, laurie. this is becoming more and more contention, its family says they at least want to keep the girl on life support through christmas so that her family has a chance to visit with her, but they say they met with officials here at children's hospital yesterday and were told no. as you said now, it looks like an alameda county superior court judge is going to have to step in and decide this matter. the attorney for the 13-year-old girl's family says that he will go to alameda county superior court today to go ahead and fight and keep jahi on a ventilator. the story has captured so much attention. jahi came to the hospital last monday to get her tonsils removed. she suffered from sleep apnea. after surgery, the family says she was talking, a possible sickle but then they say there was a severe complication, excessive bleeding, cardiac arrest and later, she was declared legally brain dead. the family says that they met with the head of pe

christie smith live in the hospital with new reaction from some family members. good morning. >> reporter: good morning to you. the family of jahi mcmath still understandably have many questions about what in the world went wrong here at children's hospital in the first place after they brought the girl here to get her tonsils out. they say right now they're focusing on getting her every chance possible. and that includes one last test to be administered today to see if there is any brain activity at all left in the 13-year-old girl. we have a photo of jahi, a picture of her with her mom right before her tonsil surgery at children's hospital last monday. the family tells us the surgery was actually meant to help her sleep apnea, to help her to breathe better. but they also say that after surgery, well, she had a popsicle, up and talking. but then she started bleeding and they say it just wouldn't stop. they say they actually had to suction her blood themselves. later they say her health declined, she went into cardiac arrest and later was declared brain dead. the

team coverage over to christy smith in the east bay to talk about what we have going on there. >> reporter: good morning. much the same over here. another cold morning. one thing i have learned from working the morning shift, not quite as cold as it's going to get. going to get much colder. i wanted to tell you what's going on in castro valley. 12 hours after a water main break. crews still working on the repair this morning. it looks like they made some progress. what we are watching them do is jump dirt back on the sinkhole where the water main break was. what caused it, it's unclear. could be related to the very, very cold temperatures we are having. what a mess it caused as a river of water poured down the street here. this is at santa maria avenue. the break caused a 10 to 15 foot sinkhole. most of the water washed into yards and garages. one woman says it rushed into part of her home. >> we were just in the -- in our living room and heard this rushing and thought it was pouring rain or something was happening. looked out here, the water was rushing. came out quickly. it's just been n

christie smith also there. we understand sheriffs have just taken one person into custody, is that right? >> yeah, good morning to you. the driver and believe it or not, as bad as this suv looks, what they're telling me is that the driver actually ran away from this scene and was caught maybe a couple of blocks away and arrested for driving under the influence. this is right next to the brookfield place apartments and this whole thing forced evacuations because the units back right up to the gas station here. this is a 76 station. 20 people evacuated. i'm told they should be able to return home soon. they're around the corner right now at brookfield elementary school. this after a driver plowed into actually two gas pumps at the 76 station. i just spoke with firefighters and they are telling me that when it happened, the gas station attendants were actually able to hit the gas shut off and that was huge break for them. but residual gas and vea tors ke pors kept burns, so they had to carefully put u a foam blank

christie smith is live in san francisco. what can we expect from this meeting? >> reporter: hard to believe after all of the talking going on that a deal isn't completely done, but the truth is it isn't. both sides are going to be sitting down today to hash out a clause that b.a.r.t. says was left in the contract and was a mistake. that if left there it would cost them millions of dollars. it has to do with paid family leave. 6 weeks per year. what happened recently is that the board authoritied use. the union turned around and sued so today and tomorrow both sides plan to sit down with a federal mediator to try and end the dispute with seiu and atu which includes station agents and train operators. b.a.r.t.'s union leaders haven't talked about the dreaded s word, strike, but riders are watching. this has shut down trains leaving thousands tranlded looking for other ways to get to work. because of the strikes. this mediator has had success before, it's the same person who reached a tentative agreement in october and that's the latest from here. live in san franc

nbc bay area's christie smith is there live with the very latest. good morning. >> reporter: good morning to you, laura. i got off the phone with the east bay regional park police and they're confident that they have all the suspects involved in this sexual assault. but they're still asking for the public's help. but that may be difficult and i'll show you why. this is the park area where it happened but i wanted to swing around and show you how secluded it is. the street is up there. that's park and mcbride. but it is basically hidden by bushes. now, the area we're talking about is wild cat canyon regional park in the alhave a a doe park area. three teenage boys were accused of getting two girls drunk and raping them. the girls ages 14 and 17 were given alcohol by the boys. they woke up hours later and realized they had been sexually assaulted. they contacted their family and then reported it. then on wednesday, the teenage boys, one 15, two 17 were arrested. warrants served at their homes where evidence connecting them to the crime was recovered.
