meantime, chuck rosenberg, we saw tom barrett and court today. he's predicting we're going to see over time that he's 100% innocent. where is this case going and what do you think his defense might look like? >> why don't he's entrepreneurs, and chris because i read the indictment it's pretty compelling. the government seems to have a bunch of emails and text messages to and from tom barrack. and which is working on behalf of the united arab emirates and he failed to disclose this as an agent of a foreign government. so what happens now? between now and the next court dates in early september, the government will be providing discovery to the defendants. that's their obligation under the law. there may well be pretrial discussions about resolving the case. i wouldn't be shocked, but i wish i had $1 for every defendant who is 100% innocent on the day of their arraignment. because it's not the way it tends to turn out at the end. >> a lot has been made, chuck, of this $250 million. that's that tell us more about how rich he is or about how serious

we welcome back chuck rosenberg, former senior fbi official and attorney. to be the host of our msnbc podcast, the oath. chuck, what are you looking for tomorrow? and after, say, 2:00 p.m., when the indictments are unsealed, what chain of events does that then kick off? >> yeah. let me take the second question first, brian. after folks are indicted or, perhaps an organization, they appear in court. they are arraigned. they are presented with the charges. they plead guilty or not guilty. in this case, it will be not guilty, and the judge will set a status hearing or schedule of the next appearance. they might set a trial date. but nothing much will happen. it is perfunctory. paul butler referred to it earlier. i want to see the detail of the indictment. i want to see the story. there's two ways to indict a case. one is to recite the bare-bones resuscitation of the elements of the crime. the other way to do it is a speaking indictment, where we lay out the entire story, the scheme. who was involved? how long were they involved? what did they do? the elements o

let's bring in nbc news justice correspondent pete williams and msnbc contributor chuck rosenberg fororney and cia official. pete, i'll start with you, barrack is being held until monday for a bail hearing. walk us through the charges here and what's next. >> reporter: well, the charge here is a federal law that makes it a crime to lube the u.s. government on behalf of a foreign government without notifying the justice department of that lobbying. prosecutors say, for example, tom barrack got pro-uae language and inserted it into some trump speeches and arranged meetings with uae officials. the charges say that he was in constant touch with a businessman in the emirates who was close to uae government officials and the u.s. says he met with some of them in december of 2016 after trump was elected and suggested they give him a wish list of their foreign policy goals that they would like the u.s. to adopt and he would try to take care of that. he is accused of taking advantage of his insider access, such as his role of the chairman of the trump inaugural fund in 2017. there are some oth

sorry, go ahead. >> no, that's a question for you, chuck rosenberg.to do that? the trump organization would do exactly what harry said. what are the legal options facing allen weisselberg right now? >> well, sure. i mean he could have his day in court, nicolle. he's entitled to that as a constitutional prerogative. he could plead guilty and cooperate. he could plead guilty and not cooperate. he could go to trial and we aconvicted, he could go to trial and be convicted. most people end up cooperating primarily before they are charged. occasionally after they're charged. and rarely after they are convicted. so he still has options open to him. but prosecutors much prefer cooperation early rather than late. the sooner they get it, the better off they are. and so if weisselberg wants to help himself, my guess is that he pleads guilty, if in fact he is guilty, at least that's what he ought to do, and that he cooperates truthfully. if he doesn't want to, that's his call. if he wants to take valuable information inculpating others to jail with him, that's hi

attorney chuck rosenberg. he's also an msnbc contributor.shamelessness or both, but this is par for the course for trumps. they try to neutralize what they're being accused of by talking about it on the record. what legal risk does that carry? >> there are two ways to think about it, one through a political prism and the other through a legal prism. politically, maybe it plays with their base, although i imagine much of their political base doesn't have corporate apartments and cars. maybe it helps with the fund-raising. legally, to your question, none of this is helpful if you're a defendant in a criminal case. attorneys always tell their clients "stop talking." prosecutors always hope defendants in criminal cases keep talking, because under the rules of evidence there are times under certain circumstances where you can use this stuff at trial as evidence of their knowledge and intent. so it doesn't make a lot of sense to me legally. i understand it politically, but i'm not the best person to talk about politics. i rather disdain it. but le

joining me now is chuck rosenberg, former u.s. attorney and fbi official. i guess the obvious question here for tom barrack, who seems like a smart guy, well read individual, is -- and it kind of goes for paul manafort too. wouldn't it be easier to just register as a foreign agent? >> oh, absolutely, joy. look, this is not that complicated. everything they did, they likely could have done if they had just followed the rules. the rules say, joy, if you want to represent a foreign government, if you want to represent canada, tell the attorney general. put it on record. file periodic reports. tell us what you're doing. and if you do that, joy, have at it. represent canada. there's no issue there. the issue is when you fail to register. really what the law is getting at is transparency. we want to know who's representing whom and what the hidden interests are. so if you're transparent, you're not in trouble. >> and if somebody takes a huge risk, this is something you can get five years in prison for this. i assume somebody like paul manafort who was wearing cro

attorney chuck rosenberg.ghts for a slightly better picture of what is playing out in the courtroom and the charges and the dollar value of what is at stake here, and your initial reaction as to how all of this has played out, and what we are seeing in the last couple of as expected. we know itt is a financial fraud case and we have a number attached to it, $1.7 million which may be the total loss to the state or it might be the aggregate of the perks or the benefits that weisselberg received. i have to read the indictment to figure it out, but it is a class c felony and punishable up to 15 years in prison. so it is not a trivial matter, and it may not result in jail time, but for white collar criminals, it is not the most important thing, but as the chief financial officer, he may be licensed or regulated in certain ways that may cost him his ability to do business, and he could lose his job, and he has the stag ma, perhaps, perhaps if he is convicted of a felony charge with him for the rest of his life. and
