you remember, many here will sit-ins, the cit crusade in birmingham, alabama. finally, belatedly, john f. kennedy said, yeah, let's pass a law. there was a lot of controversy two of the civil rights act under which we live that prohibits racial discrimination in places of public accommodation. one of the reasons why there was so much controversy around it was because of the civil rights cases. question: was there a constitutional warrant, was there was additional authority for congress to pass a law prohibiting this sort of racial discrimination? that was a big issue. the kennedy administration, the johnson administration, responded to that question by saying that let's pass a law prohibiting racial discrimination in places of public accommodation, but let's not think that primarily, on the 14th amendment. let us forget about the 14th amendment. why? because of the civil rights cases. instead, let us pass the law invoking the commerce clause. in other words, let us not say that people in the united states are entitled to public accommodations free of racial imp
