the city council could change the rules on rent control as landlords and affordable housing applicants prepare to square off. abc 7 news reporter matt keller has the story from city hall. >> reporter: the housing battle in san jose is reaching a boiling point. >> fight, fight, fight! >> reporter: the city council is expected to vote on a new apartment rent ordinance today. about half of all apartment u t units in san jose are covered by rent control, 140,000 people living if them. when the city put in place the apartment rent ordinance in 1979 it limited landlords to an 8% annual increase. last year the city council voted to reduce it to 5%. today they're expected to vote on whether to keep it at 5% or attach it to the consumer price index. with limits on the top and bottom numbers. both options allow landlords to pass on building improvement and maintenance costs to tenants. council member peralez wants the annual increase tied to inflation because incomes are not keeping up. >> follow that based on the economy, saying if people aren't generating more revenue or aren't getting raises

live outside city council chambers inside philadelphia city hall i'm joe holden cbs3 "eyewitness news >> joe, we'll see you at 5:00 thank you. >>> expect to learn more this afternoon about the camden county officer shot in the line of duty last night and the gunman accused of shooting him. cleve bryan is live at cooper university hospital where that officer is recovering. cleve, good afternoon. >> reporter: good afternoon rahel. police chief scott thompson came out of the hospital after visiting the officer. he says the 21-year-old rookie cop is doing well but because of the severity of his injury will likely stay in the hospital until at least tomorrow. so here's what we know about what happened. right about 10:15 last night the officer in patrol in the area of chelten and ninth avenue in camden called for backup. he reported seeing three people involved in some sort of suspicious activity. now the officer approached those three individuals and one of them allegedly pulled out a gun. the officer tried to disarm him and then the struggle and was shot in the leg from point blank range

ktvu's leigh martinez is at police headquarters with what the chief had to say to the city council last. >> reporter: several council members had accused the chief of being less than honest about cooperating with ice agents last summer. the chief says she was tricked in helping out an ice raid. now, back on august 16th of this year, oakland police provided traffic control for the ice raid. oakland officers stood by as two guatemalan brothers were taken into custody in the raid but no criminal charges were filed. one man now faces deportation. the chief says she was told it was for a human trafficking case. the chief brought with her a letter from the u.s. attorney describing the warrant as part of an ongoing criminal investigation, not a civil immigration investigation. oakland's mayor says she backs the chief but wants stronger protection for undocumented residents. >> we cannot be a safe city unless this community feels safe, feels like they can call 911 in an emergency, feels like they can reach out for help. >> what i have shared are facts that i knew. and there is no deception on m
