city librarian. we are going to provide background on issues requesting today on making the teen center on the lab. we have a powerpoint presentation we are going to walk through. we have new skills that is going to involve new media. one of the reasons we have received the award is the department of california science, the bay area video coalition to in fact create this planning process that truly engages our young people. i will provide more details on that. it's also linked to other improvements to the entire process continued today but the focus is carving out the plan. in terms of the design process we engaged 19 youngster, teen advisory board members if you will from across the city involved in working side by side for a space they envisioned in the center. it's part of the learning skills and certainly about connected learning. it's a strong relationship in collaboration between the library and the department of public works. the focus to have here are some that involve they took the best for

. >> most are familiar that the city librarian was found to have purgered himself for 3 consecutive years making claims that the friends of the san francisco public librariry gave him nothing which actual year they were giving him thousands of dollars worth of gifts of travel, hotel accommodations, transportation, food, conference attendance, etc.. he spent two years withholding public records from me. i had to file two petitions to the superintendent of records in the city attorney's office, and the first petition after a year of waiting for him to give me documents was denied because he was giving me documents. another year, went by, and filed another petition and they gave me another pile of documents all of which should have been given to me within the first two to three months of my original request. and the reason that he did this? he wanted to hide the fact that he had purgered himself and filed his statements of economic interest each year, saying that he got nothing, and then had to go back when the ftpc caught him and refile and show the thousands of dollars of gifts he got from

city librarian herrera, after holding public records unlawfully for two years was only found guilty of perjury after the case was brought before a state agency. during that process there was not e are checked. and we see lists after list, after list. of things that he now says and acknowledges that he received. that is only 2009. and he had to file the same thing for 2010 and 2011. and one of the reasons additional reason that he withheld the public record that he was by law, that he was required to give was because it allowed him to do this for two additional years. ftpc said that we can only go back three years, and if he had not withheld the document thises would have been come to public light two years earlier, and the unlawful behavior would have stopped two years ago, and like i said i would have never even bothered to bring it to you because all that you would have done is cover his ass. >> any other public comments? >> any other nominations. hearing none, i would like to call for a vote on electing commissioner ben hur as chair of the commission, for 2014. >> 2015. >> and 2014/

i have written to the city librarian whos responded this morning and said that no permission was givene chronicle to violate the privacy of the three individuals in the two photographs. these photographs were taken by a commercial for-profit corporation. they have appeared not only in print, but also on the web. the city librarian informed me that the chronicle not only didn't ask for permission, but they have violated two rules of conduct about the library. you cannot take pictures in the library without permission. here the chronicle has done that. i also must address the potential for violating the state penal code, specifically section 6 47 j, subsection 1, which prohibits the taking of pictures in public rest rooms. i would like to know from the city attorney, the police department, and the district attorney what is being done to investigate the photographer lia fasuki for violating subsection 6 47 j subsection 1. this is not okay. these women in these pictures have had their privacy violated by a for-profit corporation. i think this is a matter for this board because the library

paragraph of a 39-page chapter on once a future library in san francisco, kevin starr, the former city librarian of san francisco, wrote, "these people disestablished a distinguished collection. to say that the san francisco public library, the largest public library at the center of ground zero of the fourth largest urban population mass in the nation, should divest itself of a collection that is moving toward 100 years old, to disestablish that collection without any mandate or public discussion is shocking." and he talks about in the previous pages about why and how that process worked and he he talks about the secrecy that made it possible. the library has talked about a new project which will affect negatively the public access to magazines and has absolutely kept secret the negative impact. thank you. >> next speaker. >>> i'm mark trout and it's sometimes said that jesus never spoke out against homosexuality. and since there is so much good in the worst of us and so much bad in the best of us, it bee monthsv all of us not to judge any of us. but that's actually not a sip turrell statement.

i, as a city librarian, felt compelled to at least explore that. at the point when i sent a response to mr. hartz saying that in my estimation, my judgment, i declined his request, then he filed the sunshine ordinance complaint. at that compliance committee when they suggested that we take it back to the commission, i did just that. that's why it came back. and i also felt that because of the expenditure involved, it would be their judgment, their call and policy determination to do that. so, i felt that was, again, doing due diligence in having a full public hearing on that matter and they did that. and, again, it was a 6-0 vote not to do it because they felt they were not in violation and they got some attorney, city attorney advice and also -- i mean, the brown act and sunshine ordinance did not prescribe a specific method of allowing the use of a-v equipment during public comment. so, they felt that they were going even beyond that by allowing the printing of any audiovisual equipment. and i want to qualify that. when we invite -- and it's real

know, i wonder at this point whether the most productive thing to do might be to ask the city attorney -- the librarian to go back and explore whether there is other accommodation that can be made, whether that's wireless, whether that's battery operated projector with a screen. it sounds like those item have not been fully explored. if the commission is open to that, maybe we can defer the matter, otherwise i stand by my second with commissioner renne's motion. >> i guess i believe that that suggestion is not necessarily germane to the motion. and although i might agree with it, i think we have to rule on the motion and then we can make some decision as to whether or not we want to give mr. herrera some guidance a to what we think he ought to be doing. >> okay. all in favor? >> aye. >> opposed? >> no. >> it passes 3 to 1. >> okay, the motion passes 3 to 1. i would strongly urge the librarian to try to figure out some way that this can be resolved. even if it's not a perfect solution, i would try it and at least see what you can do. clearly you heard some significant concern about whether this was appr
