it is a memo that came from the interim city administrator in the city of oakland to the members of the city council there. this memorandum says the city of oakland is opting to extend by 2.5 years the terms of their agreement with waste management of our meeting county -- alameda county. there are different ways to see this memo. in some respects, i can see how it points to the need to extend or continue the relationship with recology. i think it cuts a different way. what is interesting about the memo for me are the two reasons given by the oakland city administrator as to why this agreement should be extended. he said there are two compelling reasons. one is that the extension of the agreement ensures the city will continue to receive the revenues provided for in the agreement. in fiscal year 2010-2011, the city received $21 million. $4.8 million of that goes into the general fund. that is not the case in san francisco. we do not have a franchise agreement like oakland does. we do not have the same structure where there is a specific amount required by agreement nor do you have a spe

of the process between recology and the city. commissioner campos: in other jurisdictions -- oakland being one of them -- the city council actually has a say over rates. to your knowledge, the board of supervisors has never opined on what the amount should be or what the allocation of these funds should be? >> not to our knowledge, but other -- under our current process, any member of the board of supervisors could initiate the process. commissioner campos: is there a reason why under the rate process, the number that was cited was 10.6% of the total revenue? >> this is our deputy director. >> it was not based on a percentage. it was based on looking at individual costs for programs and their individual services. that was looked at in the context of whether that total was a reasonable amount, but it was not set at 10.6%. at that point -- and actually, the percentage may vary depending on the revenue that comes in to recology. that 10.6% -- the amount is fixed, so if there revenue is lower, that percentage could go up -- it -- if their revenue is lower. commissioner campos: the reason i ask is a superficial comparison. it does not

of. we also looked at a public agency fees. different cities called them different things. oakland has a city fee. san francisco has an impound account fee. the amount of those fees affects the rates also. here is the first set of rates. we looked at the customer rates. i understand it may be hard to see on the small monitors. we tried to color code them. the san francisco residential rates are not the lowest but they are also not a highest. they are right around the average. they're just a little higher than average. keep in mind when we say that, you have very good services. we would expect your rates would not be the lowest because you do not have the least amount of services provided. on the commercial side, you are a commercial structure is very different. it is unique. it has been used as a good example for the last few years in various other jurisdictions. if we'd looked at your commercial base rate, you appear to be high. but your rate structure is set up so that commercial accounts get a discount the more capacity they provide for diversion. it appears a 50% capacity is about average. when
