. ♪ ♪ cheryl: i'm cheryl casone in for liz claman.is the last hour of trading, and markets, well, they're holding on to those big gains that we got from friday. take a look at the three major indices, all of them higher right now, the dow higher by about four points, not a big gain there. the s&p, though, up more than four points and the nasdaq is higher by 14.5 points. so, again, all of the major indices holding on to that big rally we had on friday. bank of america, they are leading the rally. the company announced it reached a settlement with bond insurance company mbia. right now b of a is higher by 5g deal, at one point shares were halted as the markets were trading. bank of america, though, big mover. bmc software has agreed to be sold in a $6.ed billion deal, the investor group led by bain capital and golden gate capital. and take a look at bmc, 45.44. but certainly a stock to watch, kind of a mini merger monday i guess we could call it. i'm not going to call it that because i'm going to get to the floor show at the new york st

liz: theft noon, i am liz claman. it is the last hour of trading. weaker than expected manufacturing news out of china overnight started casting a reddish call over the numbers. the nikkei numbers tanked overnight. we have been doing very nicely lately but they fell pretty dramatically and the whole situation was intensified with leftovers of the news on the federal reserve on the bond buying program. feeling angst in early trading but we are moving higher on the lower third as we watched each index getting closer and closer to the flight plan. new home sales ris rising to the second-highest level since the summer of 2008. number of americans applying for unemployment benefits fell last week, that all helped market recover some of their losses. at a certain point, all of the losses were erased. look at it now. dow jones industrials up 23 points. i will give the nasdaq a flat, but up about a point. and we must include hewlett-packard in the entire picture. shares soaring today, a healthy percentage change of 15% to the upside after better-than-expect

now we continue to our countdown with the closing bell with liz claman.ews, sony is jumping nine-plus percent right this minute. here's what's happening. you remember last week, daniel loeb of third point, the agitator investor, came out and said, you know what? i'm sending a letter to sony saying that sony should be splitting up its entertainment division which is highly profitable away from its electronics division. here's what's happening now according to reuters. we are hearing that sonyyis now considering a board meeting to evaluate that proposal from one of its major shareholders, third point llc. this is a fascinating development. the stock jumping nearly 10% right now. sony, once again, is now listening. this after it had said, no, we're not interested in splitting up. now according to the reuters and nikkei k it looks like sony is looking to at least have a board meeting to discuss the proposal that was recently put out there in a formal letter by daniel loeb who also showed up and tried to have a formal discussion with them, in essence, saying y
