claudine? mike?y of a drowning victim in alameda is now suing the city and the county. the brother and sister of raymond zach accused emergency responders of failing in their duty to help save a live. the suit claims they breached this duty through numerous actions and inactions, many of which violated their own policies, procedures and protocols. these were the direct and approximate cause of the death of raymond zach. the 52-year-old zach waded into chest-high waters off crown beach in alameda last may. witnesses say he stood there until he drowned. police and firefighters watched along the shore the. -- shore. the lawsuits are seeking unspecified damages. >>> some employees at "the new york times" will be the victims of job cuts. . >> i'm claudine wong. it is tuesday, october 11. tori and dave have the day off. we start at 7:00 a.m. with the occupied movement that spread to another bay area. occupied oakland is now in its second day and activists are not leaving until police forces them out. we are live with how they are responding. >> reporter: police and city leaders would not kick these protesters out of oakland city plaza last night and they didn't. when we got here this morning at 5:00 a.m., there were a number of people, 75 to 100 tents spread out here at frank ogawa plaza. this group calls its occupy oakland. they are here even though camping is technically a violation of the city code, camping in city hall is. the group said it was important for them to be out here to get their message across. since we have been here this morning, people in the group represent a variety of causes from teachers who say they are tired to cuts in public education to what, retirees, to people who recently lost their home to foreclosure. they say that they are upset about the economy. now, all this was fo

now, claudine wong is there. >> reporter: the victim is not a student but came here for a party. this is spreading through the campus. and we talked to a student who said she is pretty nervous hearing about this. and this is the tower dorms right behind us right now. and this is where it all went down. police are telling us this morning that, here is what happened. the victim was here with a group of friends. and she was looking for a party. she was overheard talking about the party to her friends. now police believe the suspect described as being 18 to 22, 5'8", 180 pounds. with short hair and described as a mixed race, used the information to lure the victim into an elevator. the victim thought the suspect was pretty friendly and went inside the elevator while they were trying to track down the party. once inside the elevator, he took the victim to an unknown floor at which point both the suspect and victim left and went into an unknown room and that's where the assault occurred. >> after the assault, the victim was able to get away and report this all to police. again, there i

ktvu claudine wong is outside the dorm building where this happened. you're telling us how the students are reacting to this alert? >> reporter: certainly the student we talked to this morning, they are concerned that this happened. it is friday night. they do expect to have a lot more parties tonight. this is where a student was headed to a party here at the tower dorms last friday when she became the the victim of a sexual assault. police say that it was between 8:00 to 10:00 on friday night that the victim who is not a student, that they came with friends to the tower dorms to go to a dorm party. but the group, they just weren't sure exactly where the the party was inside. so the friends, they were talking about it and the victim believes that the suspect overheard them. when they left to try to figure out where the party was, that this man, he called out to the victim saying, "i know where you're going and you can come with me." she thought he was friendly enough, so she went into the elevator with him. as the doors were closing, her friends came b

ktvu's claudine wong is keeping an eye on this situation and jut got off the phone with police in san jose. so what -- so what are they saying. we want to show you the situation now in san jose because the man is still -- still handing on top of that building. we have our camera and sid, our photojournalist, to show you how high that man is up there on top of the cement structure. we know he's been there since at least about 3:20 this morning. when i talked to police, they said they got there at 3:20 to do their -- what's become routine clearing out. they've pulled the protesters out of san jose occupy. this morning they came out here and there were five people out there. they arrested five of them. four went to jail. one was cited and released. at the time this man was standing up there. he was holding a sign. there's -- there is a sign that talks about how many lives, four peaceful protesters, that was the mount of response they saw -- amount of response they saw at 3:20. so police believe someone was feeding him information. he's holding the sign himself that says stand up for what
