nbc 10's andrea cline-thomas spoke with members of cosby's team. drew smith has reaction from outside the courthouse. but let's go to randy gyllenhaal. >> reporter: you mentioned the jurors returning for a saturday deliberation. did not last long. they were in there for about an hour before they came back, and this case was declared a mistrial one day before father's day. and the comedian known as america's dad left the montgomery county courthouse celebrating. bill cosby and his team with hands to the sky, as heavy rain poured down, leaving court knowing that at least for now, this trial is over. >> justice is real. it lives here in montgomery county. i'm proud to have been able to represent mr. cosby. >> reporter: after 52 hours of waiting, today cosby held his cane to his chest, listening as the jury told the judge they were hopelessly deadlocked. a hung jury with no verdict. >> we came here looking for an acquitt acquittal, but like that rolling stone song says, you don't always get what you want, you get what you need. >> reporter: cosby goes

let's go to the scene where nbc 10's andrea cline thomas is live. >> reporter: let's start with showingou how forceful this crash was. that suv hit a light pole. the light is right here. the base of the pole is right here. but the pole itself is about 30 feet down the street next to that suv. this dodge derango was traveling westbound near tiogeau tree when it plowed into a light pole. a mother was standing on the a sidewalk nearby with her 9-year-old son and what's believed to be her 11-year-old daughter. the suv and light pole crashed on to them. the mother was pronounced dead at the hospital, her 9-year-old is in stable condition. the 11-year-old daughter was not injured. witnesses ran to help the victims and confront the driver. >> i tried to help her but i didn't know what to do. i was saying it's okay talking to her but she couldn't talk to me. >> we -- i don't know the guy that was with me. we just ran towards the car. tried to stop him from going anywhere. >> reporter: rivera was among the witnesses who pointed out the driver who police say tried to blend in with the crowd. offi

andrea cline-thomas is liven wi -- live with more. >> reporter: the family was getting a ride to svu to report a crime and the shots were fired feet from where they sat. this is the video that philadelphia police are using to determine if officers followed protocol when shooting a man in the back as he ran away. >> there is nothing that says you can't shoot at a fleeing suspect. i'm talk about departmental issues. >> reporter: an officer was transporting a family to svu to report a crime and a man noticed a man driving a dirt bike. the officer discovered the man had a gun that was loaded. the father was in the police car watching it happen and tried to intervene. >> he said, he, himself looked the guy in the face and said don't do it, man, don't do it. as if to sigh, don't pull the gun. >> reporter: the police described a struggle as they each grabbed their gun. shortly after, the officer fired shots feet from where the father and children sat. >> that's your first charge is to make sure they're safe. >> reporter: the philadelphia police would not elaborate on the policy of officers
