at this point in the bill clinton presidency, he had confirmed 298 judges. by the end of this week, president obama will have confirmed 303 judges over the entire course of his presidency thus far. that's federal appeals court judges and district court judges and those folks, they are not household names. and you do not recognize them if you pass them on the street. but those folks are really important part of any president's legacy. these are lifetime appointments. and, no, judges don't, you know, pledge feelty to the president who apointed them for the whole time. but, for the most part, these judges are the on going way that a president has forduoing influence. influence moving forward in time. this is the on going way that a president's values get reflected in a governing structure for years. for president obama in particular, in terms of who they are. he has appointed more diverse judges. and in particular, more fell mail judges than any president by a mile. 42% have been women. 19% have been african american. 11% have been hispanic. particularly, in ter

if -- can you explain how president reagan, clinton and bush, can you remind us you how they can did something but all of a sudden president obama can't do essentially the same thing? >> as i said in the written testimony, and as i said in my opening statement, i don't believe that president bush, president clinton, president bush, president obama, have the constitutional authority to do what they did. and the fact that it's been done for four administrations and over 25 or 30 years as i said constitutional violations don't get better with time. some have arced there are distinctions at play here. i don't take that position. i take the position that if you look at it just constitutionally, was there a constitutional basis upon which those actions were taken and frankly, i don't see it. and i'm sympathetic to what they were doing. and the percentages should make -- constitutionality is not determined by percentage of violation. if there is a violation of 1%, it's as bad as a violation of 99%. >> there any constitutional legal distinction from a general deferment and country specific ac

and tom and i were in leadership, we got welfare reform, which president clinton signed. we did a balanced budget, we did tax reform, measured telephone communications reform, safe drinking water, importantability of insurance, raise military pavement what among those is not a good thing? what among those is not conservative, from some of my conservative friends. i tell some of them, look, just to doing in is not a conservative position. it's to change the direction of the country. you have to get an action, whether it's liberal, moderate or democrat. have to get something done. but it is harder now do and it you do run the risk of getting defeated, i get, or losing your leadership position. enough look back and -- say now, so what? at least you go down standing up, as morgan freeman said in the movie, "gloriry. the first president bush cap that. clinton reversed it. second president bush brought it back, and obama reversed it again. a phrase --id silent and back channel -- what did you mean by that? guest: executive orders and presidential memoranda are not the only way the president can get something done. he is the president. he can call the secretary of education, the secretary of the interior and say this is what i want done, but presidential -- executive orders and presidential memoranda are as much political tools as they are executive tools. so, what will happen -- and we saw this on immigration -- on immigration the president announced something like 19 executive actions. some of them were pretty small bore. things them were department of homeland security were looking at doing anyway, relatively minor tweaks of regulations. done isgoing to be normally going to be done at the cabinet-secretary level. he also issued two presidential memoranda that were the umbrella policies of those, and those were the presidential actions. in addition to p
