commissioner clyde: yes. i would like to request a hearing for a speaker from the department of public works to discuss the issue of issuing a permit and then having that permit contestant and what is -- having a permit issued and then having the permit contested. i am really concerned that we have situations where a person is absolutely legally through the city able to operate, and then there is a drawn-out process of a permit being contested that stops the business from operating. this is being driven by the small neighborhood cafe that had a few tables and chairs and was permitted by the department of public works. i am concerned about the department's ability to stand by the decisions of the department when they are made fully within the rules. they are fully within the regulations. for a small business to have to spend their time and their money fighting for something that they are permitted to do -- i would like to know why the department -- what holds them up? what can someone make a complaint and anot

commissioner clyde: i just wanted to restate in the comment made by the president of this commission about plain language. in all of your drafting, please keep it in plain language. i think it will go a long way. >> i am neither a lawyer or a planner, i hope that qualifies me. president o'brien: that is wonderful, thank you very much for that. any public comment? >> i think this is good legislation in the language to go forward. he brought up the point that this is a starting point going forward, so look backwards out why some of laws are there. a lot of this regulation was put in because they tried to keep the character of the neighborhoods, thinking about how the neighborhood as a small shopping center. the owner makes sure there are always different kind of businesses to make it attractive. in bars and restaurants were real problem back in the '70s and '80s because the landlord could charge a bar or restaurant a lot more money for the property. a restaurant can be open for breakfast, lunch, dinner, after dinner. they can get more money out of that particular business. to save a lo

commissioner clyde: item 15, general public comment. president o'brien: seeing none, next item. clerk: item 16, new business. commissioner kasselman: i would like to support a resolution that urges or requests the the department of building inspection and planning to expedite the relocation of those businesses and also, you know, the northern waterfront is on to be affected by the loss of all of those people working in that area. the shop in the area and eat out in that area, so i think it expedited process for a beneficial relocation should be encouraged, if we could draft a resolution, i would be very grateful period -- grateful. president o'brien: it was mentioned in the president's report, but i did have a meeting with the senior plumbing inspector at dbi, and he has advised me, and this may already be documented, about the legislation, and very briefly, the gist of this conversation was, you know, if we can be successful in the outreach and allow people to be aware of the legislation, it is going to be a lot better than if the dbi is called out there because of a complaint.
