gone to court, and it was an administrative law judge originally, and or over the objections of the cmaaring that people perhaps had heard it from activision ceo, that there was a possibility somehow they won't have to extend the merger agreement because they would have to fight in the appeals process, and this idea, scott, that they would close around, so to speak, the ftc, unlikely. my understanding was that was never the plan, but if you were the ftc, you would want a restraining order and you would do that by going to federal court. the process right now was to go in front of an administrative law judge, and steve kovach made clear earlier, you go and get a tro and prevent them from closing the deal is that beneficial to microsoft? it could be beneficial but there are a lot of hurdles for this deal to come to a closure, namely beating the ftc in court as opposed to an administrative law judge, and i don't want to get into that -- >> that says everything about how complicated it could be. >> and you have to prevail in the appeals process, the uk regulator, where there has been politi

it suggested the cma has much other work to do a great deal of time is being spent by the cma preparinginal order consequent on the decision what does that mean? why is that important? you had an interim order saying, in one sentence, we're not going to let you do this deal, and there had been an expectation the final order would say the same thing that appears not to be the case, the cma saying to the tribunal, hey, we need to delay because, in part, we're spending so much time on preparing a final order. why would that be? some people wonder is it possible that there were additional offerings made by microsoft in their comment period, for example, that ended, let's call it, middle of june? is it possible that the interim order will not be -- or the final order will not be the same, that it might allow, somehow, for certain leeway from microsoft to even close the deal, licensing? you know, you can come up with a the lot of different things, but that has been noted by people who parse every single word of these document as something worth being aware of, because it may point to some dif

and the uk despite what's been significant political pressure that's been brought to bear on the cma pro business and the others with the view that the cma is not being pro business what does this mean? they're focused on the fact that you'll have to extend the merger agreement. it expires on july 18th. that's the outside walk date by the way, as i reported from what i'm hearing based on people's conversations with bobby co-deck, the ceo of activision, he seems to be making clear, not directly to me, he's very happy with the idea of microsoft owning this company. he's not going to somehow walk away from the deal, but he will look to extend it with the hope that he will be successful in seeing it brought to fruition in terms of a sale. that will mean microsoft right now is probably beginning or in the midst of a negotiation to extend the merger agreement which means how? paying more money, paying some sort of a special dividend, perhaps, of significance to activision shareholders? you wouldn't need to, therefore, refile the merger agreement. so that would be helpful, increase the reve
