the colorado spring police are on the scene at colorado springs airport. told that on this airtran flight 39 from atlanta to san francisco, a young man was taken into custody after the plane was diverted. there are varying reports that say the suspect was intoxicated and might have locked himself in the bathroom and refused to come out. it was then that we're told that authorities said we can't fool around with this. they let the government know -- this is a picture taken of this passenger on the flight a little while ago. you might have seen this earlier today. and then they radioed back and said, look, we've got a problem here. and deciding that the better part was not to take any risk. norad immediately released two f-16's that tailed the plane down for this landing to colorado springs. everyone safe on the flight. the passenger has been taken into custody. that's all we know. but, again, this could have been obviously a big deal. you only send f-16's to tail a plane if you fear that plane might be used either as a weapon or god forebid even worse. 9/11

and i want to recognize the gentleman from colorado, mr. coffman who has been working to organize support in the congress for support of the balanced budget amendment to the constitution. mr. coffman: i thank the gentleman from virginia as the prime sponsor for that resolution for a balanced budget amendment and i want to work with you to get that passed. when we look at -- i think you mentioned, discretionary spending, nondefense zreagsary spending that now stands at $536 billion of -- up nearly 24% since the bush administration's last full budget -- in fiscal year 2008, which was 433.6 billion. so we have a $1.4 trillion deficit right now. and the president is expected to address joint session of congress tomorrow night and i think he's going to present two plans fwr what i understand, to -- from what i understand. first, he is going to freeze 1/6 of the budget that will be domestic discretionary, nondefense spending, but only 1/6 of the budget and that over 10 years, the estimated savings, should that section of the budget not be allowed

colorado i was watching fox news sunday yesterday, mr.ted that there was no attempt to try these individuals in criminal court. my question is, does that not imply that there is an upside or downside in determining the factors of whether or not these individuals are tried? second, what is ever the up side of keeping terrorists off of our soil in the first place and holding them somewhere else? guest: on the first question, you have put your finger on something that this administration is struggling with, how to explain why they decided to put some people on trial in criminal court and why some of them need to go to military court. the fact is that they do not have a good answer, the administration prefers to use the civilian courts. the president was very critical of the bush administration and their system, but then he got into office and saw the evidence that the government has against some of these detainee's and he realized that some of the evidence probably could not hold up in civilian court. that is when he decided to basically go
