comcast cannot slow down or degrade netflix for example. ve verizon is suing the fcc claiming they lack the authority to enforce those rules. and verizon is saying the company rules violate their freedom of speech because it transmits its own speech and the speech of others across networks, restrictions or rules that prohibit how it can structure or manage its network violate the company's first amendment right to free speech. this has attracted quite a bit of criticism because verizon is free to speak out any time. it is giant corporation with free speech rights. it will be interesting to see what the federal court does and we will not see the decision for several months. if the fcc loses the case, chairman wheeler will face a difficult choice. we might try to bridge the rules. or try to reclassify broadband service that would give the fcc the authority to enforce the rules. this reclassification over the years has been called the nuclear option because if he did that there is no doubt the fcc would have the authority to enforce the rules

this idea of comcast acquiring seems kind of unlikely.umber one gun moving -- merging with the number two. twice as many as time warner. the notion that charter could gobble up time warner alone also maybe a stretch. a market cap is almost three times that of charter. more than twice as large. yet this combination still would not let them be bigger than comcast and is one reason regulators may be less opposed to that idea. the two together is one reason to take charter more seriously. 27% stake held by cable billionaire. malone says cable is ready for a new consolidation wave. charter is the trojan horse to do it. this could spread beyond charter and time warner to enveloped comcast and cablevision. perhaps cox. and when in doubt bet on john malone. ashley: bet on higher cable rates. we continue consolidation. >> reporter: your point being that there will be a raising of prices. we can't get any other competition. it will lead to lower prices because they can band together and negotiate from lower prices. ashley: i like the way you think.

stock up 4% on comcast and 9% on time warner. david, what can you tell us? >> clearly investors are embracing the idea of consolidation. what we reported this morning is that comcast has employed people to advise it on the feasibility of a time warner cable acquisition. particularly from the regulatory hurdles it might face and whether it could overcome those hurdles. they aren't specifics to any trust because the caps for cable ownership was thrown out some time ago. but there is still a question as to whether the fcc would allow comcast actually acquire time warner cable for any number of reasons, including, it might control as many as 37 million separate house holds. perhaps too much power with programmers. time warner itself has been under siege to a certain extent. we know charter and liberty, since last june have been eyeing that company, trying to get it to the negotiating table, to agree to discuss a deal under which the much smaller charter would acquire time warner cable. the stock of which has been up sharply on takeover speculation since we reall

on the other hand, if comcast does it, they'll face a very tough road in washington. and that's why you started to hear people on friday saying that maybe they do something together. my best guess is at the end of the day, comcast decides not to get involved before this process. maybe if charter moves first, they decide that on the back end there's some pieces of this they might want to take off of charter's hands to lower the financial burden for charter. but then my intuition is they probably get involved in a secondary rather than in a leading part of this transaction. >> because, i mean, we did hear about comcast thinking about the antitrust implications, talking to folks about that, hearing from some of their shareholders, that they wanted that company, our parent, again, to make a play. why is it less likely? >> the issue is the antitrust. you have a cable operator that has not only about 33% of the paid tv subscribers in the united states, but about 36% of all of the broadband subscribers in the united states. that's going to invite regulatory scrutiny. the cha

there has been a lot of criticism about comcast purchase of nbc universal, which essentially combined the largest cable company in the u.s. with one of the crown jewels of the american media business, nbc universal, the peacock network, the movie studio, etc., so there was a lot of criticism about that. there are also rules regarding media ownership in cities around the country, so for example in places like new york or los angeles or other big media markets, there are rules that prohibit big media companies from owning too many media outlets across media, for example, newspapers, television stations, etc. working tocurrently rue m the media ownership les. of course a lot of the big media theanies advocate relaxing restrictions so they are able to own more outlets in a given market. but members of the public interest community after detroit -- have traditionally argued for what is referred to as diversity or localism, more local, independent stations. so there really is a tension. so, yes, that will be a big issue for chairman wheeler for sure. >> another issue that he discussed as hi

> let's talk about comcast. favorite stock? >> absolutely. >> why? >> i mean, they straddle distribution and content. on the distribution side we think the drivers will be, believe it or not, video. the new guides that are coming out, the cloud-based guide, are amazing and in our view will lead to more usage, more viewing because it's so intuitive, search and recommendation functions. on broad band a long way to go in terms of penetration and pricing. voice, there's a $5 cost per line. voice is coming along as part of the bundle. s&m, the commercial business is growing revenue, 25% to 30% with very high margins, 50% plus. home monitoring is actually a very new business. so, on the cable side i think things are solid. on the nbc-u side there's tremendous upside in every division because part of it was that ge starved the business for capital. it wasn't a primary business. am we think of television -- there's retrans, we just talked about that. they'll go from making $40 million to $200 million this year on the wa
