. >>> today the commonwealth filed capital murder charges against defendant jesse matthew and announced they are seeking the death penalty. what led to the change? >> reporter: denise lunsford says they have new forensic evidence that allows them to bring a capital murder charge which will allow them to seek the death penalty in the abduction and murder of hannah graham. graham was a second-year uva student from fairfax county. he is charged with first degree murder and abduction, but today he was charged with capital murder and could receive the death penalty. >> the commonwealth received additional forensic information in late february that led to this increase in charge. >> reporter: hannah graham's parents were in the courtroom today sitting with jill harrigton. her daughter was also abducted and killed in 2009. matthews is a suspect in that case but has not been charged. >> whatever the court decides, i'm in full accord and agreement. >> reporter: matthew will be in fairfax next month to face trial june 8th on charges of attempted murder and sexual assault in an unrelated 2005 case

we invested in commonwealth, which became equity commonwealth, and realogy capital partners.e chairman of equity commonwealth. there is a great ceo and chairman for free. now, why is it that this has occurred? because there has not been the same level of governance and liquidity in the asset class as happened in corporate, and in order for real estate, it is much more of a private market. in order for it to grow increased governance increased accountability, it will really enhance value. today, they took some big steps to enhance accountability. they need to do more, and i think the ole miss -- the onus is on them. to act like good fiduciaries, and if you do, your real estate will be worth more. if you do not, it won't. if real estate does not have good governance it does not need to be a public market asset class. if they can trade at a premium to their nav, then it should become a living organism, so i think the real estate world, at one time, the whole market cap of the reit's, it is become a great public market asset class, and one of the reasons is transparency disclosur

but the commonwealth attorney saying that there was new evidence came to light, new forensic evidence that came to light in february that compelled her office to upgrade this for my first degree murder case to a capital murder case. she would not give any details as to what the evidence is, only saying that jesse matthew was served the indictment this morning, and this was evident that came forward. forensic evidence came and propel case to move forward. he had been facing first-degree murder charges after hannah graham's disappearance in charles phil. her remains were found five weeks later in october in a rural part of the county. he was arrested a few days after. he was arrested in galveston texas. talk about this new texas, if the question as to why this question decision was made. here's what she said went into the decision-making process. >> if i did not believe this case were worth capital charges, if i did not think mr. matthew were someone that would be appropriate for this ultimate penalty, then we would not be standing are having this conversation. >> jesse matthew's defens

. >> i think the commonwealth has presented a case that is circumstantial, to be sure, but very, veryong. >> as aaron hernandez adjusted to live behind bars, charged with murder, yet another accusation of gun violence makes headlines. four months before odin lloyd is gunned down, the football player is at tootsie's strip club in miami. a law enforcement source said hernandez drops about ten grand that night. one of the men he's with, alexander bradley. prosecutors describe him as hernandez's former right-hand man. by morning, bradley is shot in the face, dumped out of a vehicle, and left for dead. still wearing his now blood-soaked vip wristband from the club. police retrieve this bullet fragment from his head, but bradley won't give them any details. >> when the police investigated this incident, alexander bradley didn't point the finger at hernandez. >> that changes when bradley sues, claiming aaron hernandez cost him his right eye. the motive is unclear. after bradley is shot, prosecutors say hernandez gets a new right-hand man, a man named ernest wallace. >> this defendant is more
