any formal act of congress needs to be going through with the president having to sign. it is very strong and it uses congress in a much weaker place. congressried to sort of re-create the legislative veto in various forms over the years. one is a congressional review act. talking about it earlier. it is not that good of a replacement. most of the time the president will protect their own agency's actions. the kind of device he was trying to build, i see it as we need to talk more about those for particular areas. i don't think those should be seen as partisan products. another good example, the national emergencies act. that is one that is gotten a fair amount of play in the covid era. the president speaking to an emergency. congress can vote those down. the way they do it is with joint resolution which the president can veto. so, the president is in such a structurally strong spot and congress has not been that creative and figuring out how to put itself on a level floating. it has some resources, it has some choices that can make. justice breyer wrote about how we can re-create the veto in a constitutional way all the way back in the 1980
