senator corey booker, a senator from new jersey who also serves on that key committee. a moment that many feared inevitable at some point, of course but your reaction to finding out the news today >> you know, this has been a year of such grief and such profound death for america, 200,000 americans almost dead from a coronavirus, losing heroes, john lewis and now a woman to what thur good marshall was for civil rights he was a champion for women's rights in our country. and then on the court as a -- as a law student, as a lawyer i mean, so many of the things that she did inspired. and even when she was writing in the dissent, i still remember in her shelby decision, this decision that gutted the voting rights act that john lewis fought so nobly for. right now is like getting rid of an umbrella during a rainstorm because you don't think you're getting wet anymore. she was just truly one of the giants of our nation and our nation's ideals. and this is just a deeply, deeply sad night and i just grieve for not just her family but i really do grieve for our nation and the lo

senator harris: so the justice in policing act -- yes, corey booker, my brother in the senate, we led it on the senate side. but then got a lot of senators to sign on to it. on the house side, our fellow members of the congressional black caucus brought together a bipartisan group to support it. and it does a number of things which joe biden has, without any hesitation, said that he will do in our administration. including banning chokeholds and crot i had holds. let's -- carotid holds. let's be clear. george floyd would be alive today if those holds had been banned -- banned. creating a national standard for use of force. why is that important? well, because where there have been cases that might be able to go to court, where an officer has used excessive force, it is often the case that the standard that's applied makes it difficult to actually prove the case and win the case. because here's what happens. in many jurisdictions, in the case of excessive force, the question that is asked is, was the use of force reasonable? and as we know, you can reason away just about anything. o wh

i think we'll see a corey booker spartacus moment, and we're already seeing them target judge barrett's young kids which is really despicable. kids should be off-limits. on the merits, she's a very strong candidate and i think the senate will confirm her by the end of the month. >> sean: 29 times there have been openings on the supreme court. you discuss this in a column. i want you to explain what's happened historically because all 29 times presidents nominated people that would be the norm. >> that's exactly right. in our country's history, 29 times there, have been supreme court vacancies during presidential election years. presidents always nominate someone. all 29 times, whether you're a republican or democrat, the president nominates someone, and what's interesting is what the senate does. there is a clear historical pattern and precedent. 19 times the senate and the president have been in the same party. the senate has confirmed 17 of those nominees. 10 times the senate and the president have been from different parties. the senate has confirmed only two of those nominees so the
