for slager's defense team, andy savage has not commented since the mistrial was declared and craig, theis what was the breakdown of this jury? on friday, we heard from the jury saying he could not in good conscience convict michael slager and yesterday morning, we heard several jurors that were undecided. so far, that breakdown in the jury has not been made public, craig? >> gabe gutierrez for us there in charleston, gabe, thank you. i want to bring in criminal defense attorney bill nettles, and reverend al sharpton. action network and politics nation here on msnbc as well. bill, i want to start with you because i think for the purposes of this conversation, we should note that you were the u.s. attorney essentially on duty there in charleston when this all went down and also during the dylan roof shooting at the church but let's talk about the slager case right now. how surprised were you that the jury deadlocked? >> i wasn't terribly surprised. it was always a plausible option. as you reported in september a year ago, there was evidence that there had been a struggle on the ground pri

however, no matter what happens in this case, michael slager still faces federal civil rights prison, if convicted. craig. >> gabe, from charleston, south carolina. ari, chief legal correspondent. good morning. >> good morning. >> let's talk about the letter that the lone juror wrote. he writes in part, quote, we all struggle with the death of a man and with all that has been put before us. i still cannot without a reasonable doubt convict the defendant. at the same time, my heart does not want to have to tell the killed their son, brother and father is innocent. het on to add, i cannot in good conscience consider a guilty verdict. how unusual is it to get this kind of glimpse inside juror proceedings? >> very unusual. a dramatic letter, the kind of thing that anyone can relate to. a man's life hangs in the balance. another man shot down dead from the video footage that so many people have seen. what we got a peek into, craig, is the deliberations jury before they're even done. according to those letters that the judge read yesterday as well as a separate person from the foreperson, they are deadlocked,

>> so, craig, basically, dylann roof's defense team, they put in a motion late yesterday afternoon arguing that the michael slagerrapped up in the state court right here to my left, could negatively impact the roof trial going on in federal court other on this side of the street. so these two buildings across the street from each other. they also argued that news accounts linking both of these racially charged cases could negatively impact jurors. but as you mentioned, the judge clearly rejecting that motion and the dylann roof federal death penalty trial is under way as planned here in charl son. as you mention, the judge is giving the jurors instructions right now from 67 prospective jurors, that was narrowed down to 12 and 6 alternates. this is the first trial for dylann roof who, as you mentioned, was charged with killing nine african-americans at emmanuel ame church, about a mile from where i'm standing now. you'll remember, craig, he stood in bible study for about an hour and then shot and killed nine church members. now, if he is found guilty, dylann roof will be the first american to receive the ultimate

slager, who shot and killed an unarmed walter scott in south carolina last april. this week the judge declared a mistrial after jurors were unable to reach a unanimous decision. today my colleague craigvin spoke to the jury foreman about what went on inside that jury room. >> when i first got inside the courtroom, you know, i came in with a very open mind, you know, so oftentimes i think due to my color and i was going to go and do x, y and z. that's not what i was going in there to do. i went and looked at all the evidence presented to me from the defense and from the prosecutor. when we got inside i made a judgment based on factual information. want my opinion, not my emotions, not anything i could inject into it but everything i made my decision on was on factual information. some people didn't do the same. >> how much of a role do you think race may have played inside the jury room? >> i don't believe it played a role inside the jury room. >> not at all? >> not that i could have seen. >> what was the chief argument being made against manslaughter and against murder as well? >> self-defense. >> nbc's gabe gutierrez has been following this story from the very beginning. he's joinin
