d.a.'s office. here on "comunidad del valle." captain, welcome to the show, we're talking here about your workers exploitation task force. michael whittington: yes, and first off, thank you for inviting me to the show. it's my second time here and it's always an honor to come on the show, so thank you. damian: thank you. thank you for being here. so tell us about the task force and why it was-- it needed to be formed. michael: yeah, about a year ago, our district attorney, jeff rosen, created a lot of criminal justice reforms. and one of the reforms that he created was the establishment of a worker exploitation task force. the reason we created it was because we were starting to see that when companies were willing to defraud either through taxes or defraud through insurance, they were also defrauding their people, meaning they were working them too much and not paying them or they were threatening them when they were hurt. so this reform was to focus on the human toll of fraud investigations. damian

d.a.'s office.has yet to tell her story to the albany county d.a., which is running this investigation. she filed that criminal complaint with the albany sheriff. the next step would be that she gets interviewed by the d.a.'s office. we're waiting to hear on when that happens then we'll see if the d.a. feels they have enough to pursue a criminal case. >> we've also learned one of the governor's most loyal and high ranking aides has resigned. what can you tell us about that? >> people i've talked to who work for her describe her as a loyalist of the loyals. she is the most loyal person to the governor. she's well-known to all of us in the public. she sat by the governor for many, many months during the pandemic in all of his briefings. melissa derosa. that's her there on your screen. she resigned last night. it certainly shocked people that were close to the governor. some of the people who used to work for the governor. they certainly did not expect to see her go as quickly as she has. the thing her

d.a.'s office investigation actually stemmed from that federal investigation of michael cohen, so the hush-moneyand very separately i should say, rudy giuliani is on cameo for people who don't know what that is, it's where you can go on and pay someone generally someone famous to record a message for you and it's worth noting he's facing huge legal bills, right? as he does this. tell us about this. >> right. so rudy giuliani joined cameo. charging 275 for each of these spots he could give -- >> how long are those spots? >> i think they're anywhere from one minute to two minutes. jerry springer is also on cameo charging 134 a couple of minutes. so giuliani is charging more. this does reflect kind of the financial straits that he's in, this dire situation. he's not getting help from the former president, his one-time client. he's facing election litigation and of course this bill criminal investigation by the federal prosecutors in new york can get very expensive. his friend had launched a fund to raise money for him. i was just looking at vanity fair story. he hasn't raised that much money really

d.a.'s office or another jurisdiction. it's a piece of the puzzle. i don't think the pressure alone on park puts the puzzle awe the way together. >> you know, tim, michael makes a point about the manhattan district attorney, whether there might be criminal charges coming out of them. i want to read you a headline. "federal prosecutors became to suspect trump organization cfo alan weisselberg lied and considered charging him with perjury." new york prosecutors came to suspect the trump organization's chief financial officer alan weisselberg lied in testimony during their testimony of michael cohen three years ago. despite suspicions federal prosecutors did not pursue perjury charges against weisselberg, but his past interactions with them could now become relevant to the manhattan district attorney's office as it seeks his cooperation in the tax fraud case brought against weisselberg and the company last month. translate that into english for us. >> well, in english it means that the u.s. attorney's office believe that donald trump's accountant lied t

d.a.'s office as well as they move forward. here is more from the sheriff.an tell you that i had a female victim come forward which had to be the hardest thing she has ever done in her life, and make an allegation of criminal conduct against the governor. i think as far as the sheriff's office, i am elected as well. i think that we have a proven record in this area, in this region of helping people, taking care of people, and i think that's what we're supposed to do with law enforcement. i think that's what we're supposed to do in government, is take care of people. i have a young lady that came in who is alleging she was victimized and we are going to do everything in our powers to help her. >> reporter: and, joe, obviously this is a very high-profile investigation, and the sheriff said that the governor will not be treated any differently. the a.g. also responded quickly after this press conference wrapped up, saying that they will turn over all evidence related to the complainant. meanwhile, reporters pressed the sheriff about potential charges. the sheri

d.a.'s office? >> it would be my department, but the backing of the district attorney. if you don't have the backing of your district attorney it's moot to move forward. >> with the complaint lead to your office, did it encompass additional incidents? >> i'd rather not answer at this time to keep from being convoluted. anybody else? >> when can we expect the nexpress conference or update or you do not know? >> i do not know. again, this complaint came in thursday afternoon. i was unreachable yesterday. we will be sitting down after this and having a meeting with our command staff come up with a strategic plan and then we will also conifer with the district attorney's office and commence our investigation. >> will you and the district attorney be interviewing the victim together? >> in all likelihood yes, yes, and i also, i need to talk to david about some of the other district attorneys. i've seen four or five other district attorneys seeking information. again, i don't think we need to have a room full of people to sit down to interview our victim so we'll go over the l

d.a.'s office demanding prosecution, then that may weigh heavily on the d.a.'rd. otherwise, neil, the next would weeks, the next two months, frankly the next two years, the governor is going to be consumed with prosecutions and civil lawsuits. neil: i wanted to pick your brain real quickly about a comment i heard a critic of the governor saying, i don't want him there for two weeks. got knows what he would be up to and trying to do? let me ask you what could he do in two weeks that worries his critics? >> great question. so let me put my prosecutor's hat back on, neil. as a prosecutor i would be worried about him either destroying documents, emails, or through inappropriate means, having contact with witnesses and or victims. so as a prosecutor i would be reaching out and saying, look you're going to have no contact, zero contact. you're to say all documents, including emails. i would frankly ask that the state turn those over now, his computers, his iphones, his laptop, everything because i need to look at that and use that potentially as evidence in the upcom

d.a.'s office around the country really tried to protect the income and keep the identity of the individualre serious, it's a good thing the lawyers will be speaking to the public and not governor cuomo, because now anything he can say at this point can be fodder for the prosecution and used against him. >> john: we should mention that what mercedes is alluding to is that three of his attorneys including glavine who wrote that in response to letitia james' report will be holding a press conference at 3:30. i do not know if you had a chance to read the entire rebuttal, but she says that everything that letitia said was speeches and her presentation was full of lies and every complaint filed against the governor has been fabricated, what do you say? >> it is pretty amazing what such a bold pronouncement by an attorney, because when you look at what this investigation was, 179 witnesses paid 168 page report, 74,000 pieces of evidence. this is not something that ended defense attorney can say, not a big deal. i have been a defense attorney for decades, when faced with this magnitude of a defens

d.a.'s office would not even bother to prosecute these crimes. makes a lot of sense to me.f all that sounds crazy to you, you're right. but these are the actual policies and the real-world effects. and now rawlins, this same district attorney in boston that decided she's going to just take a vacation instead of being a district attorney and not try to convict anybody, this ms. rawlins have been appointed by president biden to be the u.s. attorney for massachusetts. he's giving the person who decriminalized resisting arrested and all -- resist something arrest and all these other laws. i wonder what other crimes she'll decide aren't worth processing? there is surely somebody in boston that can do the job. and yet president biden is the only one saying republicans are lying. he said that just a couple weeks ago about democrats wanting to defund the police. he said it's the republicans. i'll tell you what's also not helping to make our neighborhoods safer -- the growing crisis at our southern border. absolute shame, and the biden administration completely, completely lacks the

d.a.'s could take evidence and proceed. the burden of proof is quite high here, is it not? >> that's right, jim. this is far from a slam dunk. we heard the state attorney general's officeted touching. you now see prosecutors from several different counties jumping in and asking for additional evidence as they pursue potential crimes. now, specifically in manhattan, prosecutors say they're look into possible sex crimes and specifically they want to talk to a female state trooper who was assigned to cuomo's detail and says she endured unwanted touching. prosecutors in nassau and westchester counties are looking at the allegations by that trooper and the district attorney in albany has an ongoing criminal investigation. but it's unclear specifically what types of crimes they're pursuing, but the most likely is a class a misdemeanor. forceable touching. as you noted, the standard to successfully pursue a criminal case is very different than the one that investigators were using for this report. typically for the standard, proof beyond a reasonable doubt. typically sexual harassment in workplace claims are dealt with similarly. we've seen at least one accuser say she is goi
