d.a. fani willis.at can you tell us about what is percolating with the georgia republican party with this case? >> republican leaders in georgia during the last legislative session passed this new kind of oversight entity for prosecutors in the state. now initially this was to go after progressive prosecutors that weren't charging certain crimes. that it said they weren't going to enforce the new abortion ban penalties, for example. they weren't going to charge defendant low level drug crimes and conservative lawmakers didn't like that and when a chance to rain and potentially discipline these prosecutors. but now, republicans are saying they want to use this new law, this new entity, which goes into effect in october, they want one of the first things the entity is asked to do is to investigate fani willis. again, kind of different. now they're not saying she's failing to prosecute crimes, they were saying, in this trump case, she's over prosecuting and accusing her of politicizing her office. now fan

d.a. fani willis. that was a 2020 prosecution of 12 atlanta educators, as joyce explained, had to do with a rigging scandal. but there was a lot of criticism over willis's use of georgia's rico statute to be able to prosecute educators. in this particular instance, greg, they haven't applied rico to an election law framework. and so there is a concern the three might be similar criticism if that particular statute is used by fani willis to go after trump and his allies? >> yeah, there will be pushed back on her no matter what she does. but look. she is an expert in using this rico statute. she is even joked that, look, you should just use rico statute for folks eating spaghetti dinners in a crowded ballroom. this is a rico statute that can be used against street gangs and has been successfully used against public administrators in the cheating scandal. and if all signs to this going on in the next couple days, it could be used against the former president and allies in terms of their efforts to overturn

d.a. fani willis' trial against donald trump? >> let me start having worked with d.a. willis.s stay ready when you ain't got to get ready. she's already said from the beginning, i anticipate trying this case in october. she's already told the defendants from day one, i'm ready. i have the evidence. i have my witnesses lined up. we are ready to go. i think this is something that could possibly backfire if this is done here. you'll see a few defendants that may roll the dice and press their luck. i do believe this may be a time when some of these defendants will be severed from this. in other words, have their prosecution or their track separated from the rest of the defendants who could go later. >> does it really depend on who they are, what their particular role was in all this? when you're weighing the pros and the cons, do we go early, do we try to delay, how do you make that calculation? i realize you're not defending any of these folks, but what will they be looking at? >> well, certainly -- more times than not it's in your best interest as a defense attorney where you wa

d.a. fani willis' command that these 19 defendants come and turn themselves in tomorrow. sources tell cnn that there is a lot of conversations happening here, communication between trump's team and the d.a.'s office specifically conversations that are going to continue into next week about the conditions to his appearance, and also the logistics of his surrender. we've been hearing from a lot of officials, including the fulton county sheriff that trump and the co-defendants will be treated the same as everybody es. frankly, that's not possible due to all of the security precautions that have to be taken here with transporting a former president of the united states. we know that the secret service has been here on site over the last couple of weeks, working out with the city of atlanta and the fulton county sheriff's office the particulars of that surrender and also the arraignment. it's likely, jim, that booking process for trump and the co-defendants will move much more swiftly. jim? >> easy bthank you very much fo legal analyst. let's go to my next guest, michael moore

d.a. fani willis. i'm wondering if you're thinking the same thing as to where there aren't more in depth investigations happening within some of these states and could that be in the potential pipeline considering what has been laid out here by the special counsel? >> it could be but it is a lot to bite off and chew if you're a county prosecutor or state attorney general. i give a lot of credit to fani willis for taking this on. it is enormous and immense. in michigan, there has been a charge filed against the 16 fake electors. but within each state there is a little conspiracy. and it is not so little. it is just one of seven. i think one of the reasons fani willis acted so quickly is because she had that really powerful evidence of the recording of donald trump, pressuring brad raffensperger to find him 11,780 votes. i don't know if we have such open and obvious recorded evidence in the other states, and it is probably convenient to just sort of stand down and let jack smith do his thing. in theory,

d.a. fani willis is expected to present her interference case against donald trump next week.s learned the case of two individuals subpoenaed to testified. joining me now nbc news correspondent blayne alexander who's at the fulton county courthouse. who are these two people? >> reporter: well, katy, they're two people that we have heard the names of before in reference to this, lieutenant governor, former lieutenant governor in georgia, jeff duncan, the other is a former state lawmaker, jen jordan. the third is a former lawmaker, nguyen. we reviewed one of the subpoenas, we know they're being called to be available to testify between now and the end of the month. as it gets closer to when fani willis is going to make the presentation, they're going to get 48 hours notice. this morning i spoke with both jeff duncan and jen jordan. they tell me they have not gotten the 48 hours notice. what that tells us is this is not going to go before a grand jury this week. that's why we're looking closely at next week. as for who those people are, katy, and how they fit into the d.a.'s case
