now jocelyn wade is openly accusing nathan wade of having essentially a relationship with fani willis, the d.a. and she says that she wants to know more information from fani willis such as this information about trips that they may have taken that nathan wade would have been paying for. what he is making from the district attorney's office. because that's all relevant to the divorce. her argument is that they need to divide assets. she doesn't know how much money he has that he's making. so she wants information. she wants to even depose district attorney fani willis as soon as next week. >> there is a d.a. made any comment? >> she has. she stepped up in court and said i want to not be deposed next week. there's nothing i have that is relevant to this divorce proceeding that has been going on for two years. the district attorney fani willis says in a recent filing that jocelyn wade, soon to be ex-wife of nathan wade, the top prosecutor, is using the legal process to harass and embarrass d.a. willis and in doing so, is obstructing and interfering with an ongoing criminal prosecution. of course

do you think that either d.a. willist know, be removed from this case if going forward they find some evidence or even insinuations of inappropriate or unethical behavior? >> yeah, great question. i think the answer is likely no. i haven't seen anything that would warrant the removal as a matter of law or as a matter of ethics. now, it's a different question, jose, as to whether, you know, this becomes such a story that, for example, d.a. willis decides that maybe the better course is to let attorney wade go as one of the several special counsel that have been hired, all of whom are being paid the same amount. but you know, she'll make that decision, and i think things like attorney wade's prior experience as a judge for a number of years brings some important things to the table and to the team, and i can see why d.a. willis would have added him to the team. but you know, there's a lot of evidence that has to be developed, i think, before we see how this is ultimately going to play out. >> blayne alexander and glenn kir

michael roman, a former trump campaign official alleged in a filing without proof that d.a. willis in an improper romantic relationship with special prosecutor nathan we'd and that her office has paid wade for an exorbitant amount of money for his services which he's used to take willis on vacations. because of this conflict of interest they're requesting that wid, willis and the entire office be removed from the criminal case. michael roman's filing referred to sealed court records in mr. we'd's divorce proceedings and now fani willis has been subpoenaed for a deposition in those proceedings. today a lawyer representing willis filed a motion asking the judge to quash that subpoena saying that d.a. willis has no relevant information to offer in this divorce matter and adding a subpoena of district attorney willis is being sought in an attempt to harass and damage her reputation. defendant, that would be mr. we'd's ex-wife has conspired in the case, that would be trump's codefendants to use the discovery process to annoy, embarrass, and oppress district attorney willis. back with me

romans lawyer asks that d.a. willis, mr. wade, and the d.a.'ing this case. neither willis nor wade has publicly commented on these allegations, and a spokesperson for the d.a.'s office says any response could be made in a court filing. joining me now to explain exactly what this means for the georgia case is anthony michael crisis, a constitutional law professor at -- can you help me understand, first of all, given where these allegations are coming from, how much stock do you put in them? do you see anything potentially hazardous in the sourcing here? >> i think we have to be, cognizant of the fact that this is a parroting of a filing in a divorce proceeding. and so the divorce proceedings, family law, domestic relations issues, these are highly contentious fights that often contain documents with allegations which may or may not be substantiated which beer may not be true. and so we have to take i think all of this with a grain of salt given the source. it may be true, it may not be true. we really have to be cautious about that and wait for

d.a. fani willis endanger her case against trump? >> it really won't, jonathan.t to explain, but there are two separate things going on here. one is the prosecution against michael roman, the defendant who has made these allegations, and his codefendants. and their guilt or innocence is not impacted in any way by these allegations, that case will go on regardless. the question that is posed by the ethics argument roman has raised is whether fani willis continue on the case. and under georgia law, she clearly can, although she might need to answer to the county commission, she might have some ethics issues to resolve. the only sort of a situation that would create a conflict of interest that would justify her recusal would be if there was a financial conflict of interest that impacted the fairness of the prosecution. and here, that is not the case. you know, what might that look like if nathan wade, the prosecutor that she has high, or if she was only going to be paid if -- that might be an improper setting. but here where you've got to prosecutors, both on the sa

the judge has ordered a hearing on d.a. williss have been brought of one of trump's codefendants, michael roman, a republican political operative. and he's apparently using sealed material in the divorce case from one of the prosecutors that fani willis brought in from private practice, nathan wade. the allegation is that willis and wade are engaged in a romantic relationship. jue mcafee is doing absolutely the right thing here. he'll hold a public hearing. he'll put all the evidence on the record. right now mr. romans lawyer has said that although she does have witnesses who will testify, they were not willing to provide her with any form of affidavit. so there's no evidence in the record regarding this, just the bald allegations. what we'll see in the hearing is a judge who will take testimony, see if there'sevidence. even if there is an improper relationship between the two, that should show bad judgment. it might create an internal ethics sort of an issue inside of the office. it should not impact the evidence in this case. it
