sherri ly joins us live from the d.c. fire department headquarters with more on this one. >> reporter: good morning, d.c.'s fire department is not talking about this class action lawsuit this morning. and the allegations of racial discrimination against the department. we contacted d.c. fire. they say they will not comment. this lawsuit has not been filed. and it's unlikely that they will comment after, that which is common practice when lawsuits are pending. we are being told that this lawsuit accuses d.c. fire of racial discrimination in its discipline policy and promotion practices. d.c. firefighters and ems workers met with lawyers yesterday. the lawsuit involves 50 to 60 current and former fire and ems employees with the department. we're told that lawsuit will be filed in u.s. district court in d.c. around 2:30 or 3:00 this afternoon. lawyers representing the workers say they have discovered a pattern of discrimination and that african american firefighters are being disciplined more than others. >> what we are doin

dozens of black d.c. firefighters filed into a federal courthouse and filed a class action lawsuit against the city and d.c. fire and ems. veteran firefighters say since 2007 and under the leadership of fire chief dennis ruben they have experienced institutional racism in the department. >> it's a hurting feeling because i felt years ago our department was heading in the right direction. there was a lot of unity amongst the firefighters. i feel over the last few years we've lost that and we're here now to try to regain that. >> reporter: it's a serious charge and according to the 30- page lawsuit, black firefighters work in a hostile work environment where whites are disproportionately promoted while blacks are being punished. the suit details more than 30 specific incidents. >> we're talking race discrimination. >> reporter: prominent employment lawyer donna rucker says the lawsuit lays out a pattern of discrimination inside the d.c. fire department. >> what i hope can get accomplished is that we have an

d.c. are hiv positive. city officials took an unprecedented step today to stop the spread of this virus. they started testing at dmv's in exchan for a break on the fees. >> reporter: this is the first of its kind in the country, a pilot program offering hi testing only at one branch this one in southeast washington. if successful it could be available at all the dmv's throughout the city and other states as well. thepenn branch dmv in southeast washington is providing the office space. the d.c. department of health supplies the hiv test kits and a private partner is giving a quarter of a million dollars for the year-long program that could screen 3,000 people who might not otherwise be tested. >> we really base the need on the current statistics in the district that show an increase of hiv in the wards in the district. i think it's the place where we need to try innovative programming like hiv testing in community sites like the dmv. >> money orders for up to $15 are used as an incentive t

do you think those are locked in those kinds of changes in d.c. and can't be rolled back for the terms of this current contract? >> at least for the terms of the current contract we negotiated those things are pretty safe. you are right. one of the biggest problems in the public education system today is we hesitate to differentiate. i think that's the biggest mistakes we're making. to be frank there are thousands and thousands of great teachers here in washington, d.c. who are doing heroic things for children everyday. we also have ineffective teachers. we have to be able to differentiate between our our highest performers and recognize and reward those folks. we he'd to also be able to identify the lowest performing teachers and either professionally develop them or quickly move them out of the system. >> paul: i was look at the baltimore system, they rejected a contract with some of the same elements that had been in your new washington, d.c. contract. how do you overcome that resistance from rank and file teachers and their unions that somehow
