i think that the d.c.ill reject easily, will reject the claim that there's total immunity. so richard nixon, when he resigned, there was a period of time when my boss when i was a very young lawyer was considering whether or not to prosecute him. that was taken off the table by president ford pardoning him and president nixon accepted the pardon. so if he was immune from being prosecuted, there was no pardon for him to accept. recently, it was held by this supreme court that the president is not immune from even a local subpoena for his financial records. let me go back quickly to the watergate experience. there was a grand jury subpoena issued for white house tapes and this very d.c. court of appeals weighed because everything in laws are balancing. weighed executive privilege and they said that can be very legitimate. but in this case, it gives way to violations of criminal law and the d.c. court of appeals had two sentences. i hesitate to read. let me read you two sentences from this very court. they sa

in all fairness to d.c. and you have hundreds of thousands of people coming in to this country, millions and millions of people, a lot of them coming right here. we have to make our capital safe and we have to make it clean and respected and beautiful and that's part of my plan. we're going to run it through the federal government and it's going to be run very tough and very smart and very safe. people are coming here and they're getting shot. they come here for an evening, i want to see the lynn condition memorial, i want to see something, i want to see something so beautiful. i want to look at the capitol building. i want to look at the white house. they go home in a casket. not going to happen. we're going to straighten it out. reporter: said they wouldn't have happened, the strike, you were president but president biden is now facing a decision to react. what would you do if you were? mr. trump: you shouldn't say what you're going to do. he says we're thinking about doing so. you have to do something. th

those are ways to delay within the d.c. circuit. but what the d.c. circuit panel today can do is say, you only have a certain amount of time to do that, or the way ty would phrase it is the mandate. this is going back to the district court in x days, like five days, if you do not seek further review. they can do things to shorten up the time frame that donald trump has. obviously, the other thing that can happen is donald trump can seek supreme court review. again, the d.c. circuit and the supreme court have the power to tighten up that time frame. that is why it was fascinating to me that at least two of the dges, possibly three, were very interested in whether this was even -- this appeal by donald trump was even properly taken. in other words, whether the court should have heard this. the normal rule, as joyce stated as being an experienced lawyer, is the normal rule is you can appeal once there's a verdict in the case. at the end of the case. you don't get to do interim appeals. this is very much an exception. the circuit was interested in whethe

it's estimated 52 million people live between washington, d.c. the areas that have the, you know, the forecast seems to be getting worse and worse, if you don't want snow. 4 million people under advisories. later today, the winter storm watches will go up in areas of the northeast. here's the snow forecast over the next four days. it shows you in general where snow can fall. it's falling in areas, four corners, headed through new mexico. later tonight, it will push through the planes. once it gets to the east coast come saturday, that's when we'll see heavier stuff. that's some of the areas that haven't had snow this winter. it's a big deal, on the weekend, people can play in it more. the best chance of the really heavy stuff in the purple. moderate means plowable. the white is light. new york to philly to d.c. to the coast, probably nothing at all. my first call of snow forecast, i've left at least a chance of an inch for d.c. and philadelphia and new york, but it may be one of those things where it's only on the grass or possibly the car tops.

the d.c. police might require. madam mayor, the former president has blamed you and speaker pelosi for what happened on the capitol that day. this day three years ago. you read that text message understanding that there were so many warnings. people knew, so many people were afraid that donald trump would not rise to the occasion and do what needed to be done. three years later, what your take on everything? >> first of all, it's a solemn day. i'm glad that you are talking to the american people about what actually happened. the very significant threat to our country that day. and the threat that continues. there was a real attack on our democracy. there was a real attack against our law enforcement apparatus for the country. and i think what we are all pleased about, that justice is being served. the people who showed up at the capitol that they are doing real jail time. as they should. because they hurt people. people died as a result. and our country is still reeling. from that. unfortunate

and especially true in the d.c. circuit wildly considered the second most powerful court after the supreme court. i think the danger trump's lawyers have here, if they start performing for that audience of one, that is going to not be received well at all. this is not a place where you engage in theatrics, not a place where you engage in that kind of boisterous trump way of argument at all. so we've seen them in other courtrooms take on that more aggressive more performative tone. and i think a panel here in the d.c. circuit won't be receptive to that. >> and what a great point about this. there are pretty powerful alum from the circuit court of appeals that you can mention you think about some of the supreme court justices. in fact one, judge childs, was on a short list for a potential supreme court nomination to replace justice breyer. and i've been before judge pann. and there was no pleasantries. she was very professional, but no moment where it was like let's shoot the breeze for a second. she wants to know why

we need to be serious about who we're sending to d.c. and then there were two things when i was at the united nations that russia, china, and iran never wanted us to have. they never wanted us to have a strong military, and they never wanted us to be energy independent. we won't be energy independent, we will be energy dominant. we will get the e.p.a. out of our way. right now they care more about sage brush lizards than about whether we can pay our utility bill. we'll start speeding up the permitting process. we'll start the pipelines, including the keystone pipeline. we'll export as much lick if id natural gas as we can. we'll do nuclear power. we'll create an energy industry that's a powerhouse for our economy. it should be an all of the above. and when it comes to a good, clean environment, we want that too. but let's transition it. let's do it the right way. let's work with our producers instead of demonizing our producers. so we have the answers on domestic policy. now let's talk about national security. the world is on fire. liter

the d.c. appeals court. three-judge panel will hear arguments whether or not the former president is immune from prosecution. this in connection with special counsel jack smith east election interference case. the hearing we'll hear it by way of audio inside the court. so stand by for that. it will start in about 30 minutes from now. we'll get to that. from last night check it out. >> biden is not talking to his secretary of defense every single day. when i was at the u.n., we knew the intel, we knew the health of everybody in every country. they know what's happening to secretary austin. what bothers me is while our adversaries may know our own president doesn't know. the one thing that keeps me up at night is what happens between now and election day. biden is making america very vulnerable and putting us at risk. >> bill: nikki haley calling america's military readiness in question over a lack of transparency and couldn't come at a worse time. strong comments there. i'm bill hemmer. >> dana

court of appeals, federal court of appeals for the d.c. circuit.hat's the mid-level court of appeals below the supreme court. the way we got here, of course, is this started out in the district court. the trial level court where donald trump argued he was immune from prosecution because the conduct falls within his scope of the presidency. the district judge tanya chutkan ruled against that. there is no divine right of kings. when we go into court today, these will be the judges who are sitting. judge henderson was put on the bench by george h.w. bush in 1990. judges childs and pan were put on the bench by president biden. there's no tv broadcast of what's going to happen, but there will be a live audio feed, so we'll be able to hear the questioning and oftentimes having done a bunch of these arguments in a three-judge panel, you can tell pretty strongly where they're leaning by the number and the tone of the questions that they're asking. >> so talk to us about the argument here because trump's team is trying to essentially extend one of the nixon
