so south dakota v. wayfare stems from the south dakota statue passed in 2017 to allow the state to compel online retailers to collect state sales tax on sales made to south dakota residents. the bill had a few stipulations, and namely that the only companies, only online retailers are forced to come ply with this are those with sales over $100,000 or with more than 200 different transactions to residents in the state. those were the only companies that fell in the purview of this law. and, so only kind of larger online retailers were affected and wayfare and retail stock and new egg which did not comply with the law originally citing a 1992 precedent in quail v. north dakota, which actually made it illegal for states to force online retailers to collect sales tax unless they had a physical presence in the state. so, this is essentially has allowed ecommerce companies and other online retailers to avoid collecting sales taxes, and kon s consumer s who shop online are still technically required to pay a u

joining us to discuss that and more is the north dakota trade office executive director.nk you so much for coming on. we don't know very much about this program, how exactly it's going to get doled out, but $12 billion, does that sound like enough to you when you look at some of the losses from the north dakota farmers >> thanks for having us. it's one where it's not a small amount but again the devil is going to be in the details there's a lot of people that have been hurt so that's a lot of money that's going to have to be shared. >> simon, do you feel the sentiment towards the president amongst people like yourself is changing tone, and what does this particular offer do to change that tone back the other way? >> well, you know, for us we're concerned about our farmers. you know, the farmers here in the state they spend a lot of time -- this looks like it's going to be great a year, so for us it's kind of frustrating there's a lot of this rhetoric being thrown around and a lot of these issues really truly impacting the farm sites for us my role here representing the st

north dakota is in that category. so no matter how many people get out and vote against kevin cramer, there's not enough people to do that for him to lose. i think he goes on to victory. he wins. he'll have the resources necessary to win and he will be a representative of the great state of north dakota. >> dana: talk to me about claire mccaskill and missouri. she has $12 million on hand. how does the nomination of brett kavanaugh and the supreme court affect that race in your opinion? >> significant, this is a big challenge. this could be a box canyon with no river to walk up and out of or swim through to rescue. this is a difficult challenge for a state like missouri where president trump won by 20 points and continues to have popularity there. the people of missouri want a judge who is not going to legislation and rule through personal bias and follow the law and the constitution. that's what they want. we've seen the incumbent vote against the will of many presidents that won missouri, nominations that won missour

south dakota basically manufactured the supreme court case. they said we think that does not make any sense. they had their legislator pass a law which was directly contrary to finding president at the time. the law said if you engage in more than $100,000 in sales to folks in south dakota you have to pay and they have to collect sales tax. the supreme court said you can force individual residence to pay a tax if you bought from amazon. the state could say you the buyer are under an obligation to pay the tax but in some states nobody followed them.>> is challenged right away by retailers on the ground that it violates the national ballot. south dakota basically says the decision is basically legal. it is when there was rigid former rules for thinking about the commerce clause but the supreme court had it moved away to something more flexible. complete auto was the touchstone for the commerce clause that asks what effect is the tax. is it going to burden interstate commerce as opposed to the kind of rigid is there a physical presence requiremen
