nbc bay area's damian trujillo spoke with the family about the arrest. >> reporter: the news is what many have been waiting for. now they say it's time tore justice. flowers and candles can still be found along the sidewalk outside the safeway store on hamilton avenue. a tribute to 24-year-old manuel, a safeway employee murdered inside the store early on the morning of june 5. >> truly an innocent victim of a crime that never should have happened. >> reporter: police rested 18-year-old tevita tuakalau. san jose police also announced the arrest of jacob parrilla. the d.a. says there's not enough evidence to charge him with any crime, so he's been released from jail. the victim's family says they're relieved they have some answers to their many questions about manuel's death. >> it was a little late. i department know when this was going to happen. it's been almost two months and a half. we didn't hear anything from police. it was kind of quiet. >> reporter: huizar's family says the last couple weeks have been agonizing. >> accepting that he's gone has been a long process, a lot of pai

here is nbc bay area damian trujillo. >> reporter: the kidnapping of baby brandon though made national headlines. the infant taken from inside his home as grandma was unloading groceries. police say surveillance video shows a man walking away from the apartment, holding brandon in a baby carrier. the next day police rescued the child from another apartment five miles away. they arrested jose portillo and ramirez, a church acquaintance of baby brandon's grandmother. today the da put on a fourth charge of attempted kidnapping. >> it's an interesting addition. it's not surprising given that they have added attempted charges along the way. >> reporter: he is the lawyer. the prosecutors say she will not comment until after the preliminary hearing in a couple of days. today we heard the possible motive that the da might try to use for the kidnapping. san jose police officer eduardo reyes testified that he interviewed a man named francisco market and that she told marcus she was pregnant with his child. the officer says apparently it was all part of an elaborate ruse, so when ramirez produced

nbc bay area's damian trujillo has the exclusive story. >> reporter: to be clear, the san jose police union is in the middle of contract negotiations with city hall, and there are mayoral campaign implications here. that said, these officers are claiming fatigue due to staffing. san jose police officers tell me that the department is increasingly forcing them to work mandatory overtime. that's because there aren't enough beat cops to cover the next shift. >> i'm looking at four hours of sleep a night. and when i come back to work the next day -- >> reporter: i spoke with two officers who didn't want their identities revealed, fearing retribution for talking to me. they say the fatigue factor among officers is real, especially for those forced to live in the central valley because of the cost of living here. one officer described his close call driving home one night. >> i had a one hour and 15 minute commute home. on the drive i ended up falling asleep and unfortunately got into a vehicle accident. >> reporter: in a statement, the police department said mandatory overtime is a reality
