. >> joining us now, damian trujillo, who broke the story last week. why no response from the fire department? it's been several days. >> to be honest they issued a statement on friday saying they would fully investigate, however no one has been willing or able to go on camera and they tell us it's because active investigation. today as federal holiday, lot of government agencies and city hall were closed. but they got back to us, city spokeswoman said this was still in initial stages of the investigation. they have been talking, just not on camera, saying they'll fully investigate. if somebody needs to be held accountable, will do that. >> not just our news organization but others trying to find answers. many people are defending san jose fire department. what's their reasoning? >> they say no harm, no foul in their words. tens of thousands of comments like that. might be a legitimate call here. may have been a medical reason they're hearing that firefighters were there at the pink poodle strip club. at the same time it's just, as i was talking to the

damian trujillo has read the report. >> reporter: the report comes from a jail monitor hired to look into an accident that happened four years ago. he tried to talk to the sheriff and other top brass but kept hitting road blocks. >> the sheriff herself would not cooperate. >> the conduct you have reported to our board is unconscionable, it's appalling. >> reporter: andrew hogan suffered from mental illness, he started to bang his head against the van in transit and according to the report, deputies did nothing. >> this is a case that left one inmate brain damaged for life and cost $10 million in taxpayers funds. >> reporter: the department opened an internal affairs investigation, but the report says rick sung closed the investigation after the jail supervisor got the union to spend $300,000 on the sheriff's re-election campaign. >> we've got a case of the number two person in the sheriff's department who shut you don't know internal affairs investigation for no good reason. >> reporter: both sung and the sheriff refused to spook to the investigator. sheriff's office will not comment

damian trujillo spent the day there today. he joins us now. damian, it looks like this bust happened just in the middle of a neighborhood of homes. can you tell us more? how did police end up finding these illegal casinos? >> reporter: yeah, we're here in my truck reporting the story as we speak. one person walked into one of these alleged illegal casinos in a neighborhood of east san jose and apparently got into a confrontation with one of the operators of that place, was stabbed at that location. then he called police. when police arrived they said something seems awry here. it took them several weeks to put this case together. and so when they raided this facility, they raid this had one on marchant court by fleming avenue in san jose and another on north capitol avenue in san jose. both of them right next to schools. marchant court is next to joseph george middle school and the one on capitol avenue next to russo elementary. a lot of kids and families in the area. >> wow, you said it. nearby schools and kids and families in the area. were

damian trujillo, the only reporter in the courtroom today. >> reporter: he was a no-show inside the courtroom today. meanwhile, the hindu-american community are relieved someone has been arrested. this is lathan johnson in his courthouse holding cell. he told the court he didn't take his meds this morning, so he couldn't go inside the courtroom to face the judge. i asked the district attorney, who was also in court, his reaction to johnson being a no-show. >> sometimes people don't want to face the music. >> reporter: for months, he terrorized the hindu community, accused of starting women, pushing them to the ground and ripping off their jewelry and jumping into a get away car. >> it's very clear that the women were targeted not because of any other reason except that they were wearing bindis, saris, they're around temples and other traditional indian and hindu sites. >> reporter: there were two who had their wrists broken. the prosecutor's office believes he can prove they were all hate crimes because the victims were specifically targeted, which could add 16 years to a guilty verdict. and

now, damian trujillo , you were the first to break the news that it was a football player in the crash. what are you hearing now? >> i am here at spartan stium. we found out, we have surveillance but it appears that at this point the football player was coming to a team meeting. they are flying out to el paso today and then over to new mexico state to play a football game. he was on his way here early in the morning when he unfortunately seems to have gone against a light. the breasts bus did have the green light. he was on the way to spartan stadium and that is when he was hit. they have decided to postpone the game to another date. >> damien, i know you were able to speak with the people who heard and saw the crash., what are they telling you at this point? >> it must have been such a loud crash because they say it sounded like the bus hit a car at the intersection. when they turned around it was actually the football player who was on the scooter that was hit. they say it was a pretty loud bang and just a tragic scene. i can only imagine the trauma for the children on that bus. the
