we're live in san jose, i'm damian trujillo, nbc bay area news. >> developingg news. another tesla crash making headlines. this one was an autopilot. it happened in laguna beach. these are pictures from the scene thiss morning. investigators say a tesla sedan slammed into a parked police cruiser. the tesla driver wasn't badly hurt and the cruiser was empty at the time. just two months ago a driver was killed in a crash on so 1 and mountianview. it slammed into a concrete barrier slamming a driver, a google engineer. tesla says it was driver error, but the family is seeking legal options claiming the autopilot feature is defective. >>> a northern california teen is slipping in and outut of a ca tonight after being a attacked with a hammer. he was one of three teenagers attacked here at a house along monte vista drive. it began when a group of masked men walked into the garage where the three teenagers were sleeping. they woke up to the men beating them. deputies say the men then allegedly took things from the garage and drove off. one boy remains in critical condition.

"today in the bay's" damian trujillo has more. >> reporter: it's the time of year when these colors covere, a celebratory occasion for the first capital of california. that celebration began on wednesday at chacho's restaurant downtown. they stocked up on food and beverages and security. >> this is by far the busiest week of the year for us so this year, we start the 1st of may and go all the way to the 6th. >> reporter: chacho's is calling in security guards early this weekend to keep patrons safe over the busy weekend and the rest of the city, police are beefing up staffing. these probation officers met with sheriff's deputies and the gang unit. they strategized on how to keep troublemakers out. >> we aren't going to discuss our operational plans or tactics but i can tell you we are assigning additional police officers here in san jose, both in plain clothes and in uniform. >> reporter: with the sharks game on sunday, officers know the crowds will be out in force, so they're geared up, vowing to protect those who come out to celebrate the true meaning of cinco de mayo. in san jose, nbc

damian trujillo was inside of the courtroom for this morning's hearing and live with the details. >> reporter: well, laura, the da was already charging adrian gonzalez as an adult but because of prop 57 there has to be a hearing to proceed with that and recently a judge agreed with the d.a. and now the defense is peeling that ruling here in superior court in san francisco. he turned 18 and sat in court with his public defender. in 2015 prosecutors say he kidnapped and raped and murdered his neighbor, 8-year-old maddy middleton. he went from juvenile court to adult court and a judge just ruled that adult court is where he belongs. the prop 37 took that authority away from the district attorney and gave it to the court and that is why they had the prolonged hearing of nine weeks, but the defense disagrees with the judge and plans to appeal the ruling this week. >> the grounds for the appeal are essentially that, that he misapplied the law and focused more on the crime and less so on the child or the kid and prop 57 wants to give more kids who commit serious crimes treatment and rehabil

nbc bay area's damien trujillo joins us with the details. damian?reporter: the chief here has not hidden his thoughts about young offenders. he thinks the criminal justice system is too lenient on kids. last night we mentioned it was a 13-year-old and 14-year-old who found themselves inside of a stolen car on the wrong side of the law. the stolen car came to a stop in front of the bridges academy heart school in san jose. a 13-year-old was behind the wheel, along with three passengers, all 16 or younger. that age might be shocking to many, but for san jose police it's becoming all too common. >> yeah, right now it's kind of becoming more and more prevalent. >> last year police arrested an 11-year-old believed to be the getaway driver of a stolen car and a burglary and robbery spree. the d.a. says juvenile crime increased countywide last year, especially residential burglaries, carjackings and auto thefts. >> all our
