"today in the bay's" damian trujillo live in alameda where police are trying to piece everything together. damian? >> reporter: good morning. that is a concern this morning here in alameda, and also in the city of berkley. they believe a green van has been cruising around schools in both cities over the last week and trying to lure those children into the van. so the alert is out this morning. the driver of that green van was allegedly trying to lure the kids inside. the latest incident here at bridges elementary happened last week. police say the green van cruised by the school on september 18th. 20 minutes later, similar reports from two other schools in berkley. these were described as attempted kidnappings near willard elementary. alameda police are still trying to verify if the two incidents are related in both cities, but detectives want families to keep their guard up and look out for a green van. >> it makes you more cautious. you know, keep an eye out. yeah. not just for my kids, but other kids. >> reporter: berkley police describe their suspect as latino between 30 and 40 years

damian trujillo, good morning. >> reporter: good morning. deputies now have a lawyer assigned to them, paid for by their union, and they'll need nose lawyers. this has turned into a criminal investigation, according to our sources here at the main jail in san jose. we obtained a court document yesterday and it lists victim's name as michael tyree. sources tell us, tyree was badly beaten in his jail cell, several sources tell our investigative unit tyree had lacerations to his liver and spleen. the coroner has yet to release the autopsy report. as we first reported on friday, in an unusual move, the sheriff put the three correctional deputies on administrative leave after the incident. according to the court document, tyree was waiting to be transferred to a bed at momentum crisis residential treatment center. he had earlier appeared before a mental health court judge but sources tell us, some argument ensued in his jail cell and for the last four days, the sheriff's office has only said guards found tyree unresponsive in that cell. >> deputi

live in san jose, i'm damian trujillo. >>> let's get back to our coverage of the valley fire.out the destruction of property, the weather and the firefight, but one thing we haven't really discussed is the schools. the schools are in tact, but the schools still of course aren't allowed to go back to school. and that's the big question going forward. >> they were delayed one week from the jerusalem fire. they've missed school again. jessica, you talked to school officials in lake county today? >> reporter: we did. they were in a big meeting all day long trying to figure out how to fast track getting these kids back in school. the issue is whether the schools are safe. inspectors will be going up there on friday to go through and see the infrastructure, how to get to school, how many houses are surrounding it and figure out a game plan for getting the kids back in school. on friday, there's also supposed to be a meeting with parents, this camp has about 150 kids not in school. and those are just school-age kids. they're going to have a meeting to determine what happens next in t

nbc bay area's damian trujillo was there. >> reporter: these documents are the reason the people say the jail guards should be denied bail at tomorrow's hearing. they show an alleged pattern of troubling conduct by the guards. juan via hid behind his lawyer in court today. prosecutors say the three jail guards accused of beating inmate michael tyree to death also beat him minutes before. he suffers from mental health issues. >> the jail facility does not have people the that are properly trained to teal with people with serious mental health issues. >> reporter: the sheriff reports almost after the inmates in jail suffer from a mental illness. in these documents filed with the court prosecutors allege the three accused jail guards texted each other. one text sent months before rafael rodriguez allegedly texted guard matthew farris saying, quote, he was surprised about me slapping him, he sat on his bed with hand on his cheek, hahaha. i told him i bet your parents never spanked you but i will, haha. in another text, he told rodriguez about his cell block assignment on the sixth floor,

. >> nbc bay area's damian trujillo is live. some staff members arrived on campus, damian, but they wouldn't answer our questions. >> reporter: we had the understanding school would resume again today, but we just got a letter late this morning from the county office of education saying that spark academy charter schools would remain closed at least for now. the county office of education tells us that the charter school has not satisfied the requirement for backgrounding and fingerprinting of staff. the county office offered the charter school had it closed after the arrest of one school aide last week. the superintendent later revealed none of the staff at spark had undergone required background checks and the fingerprinting. 18-year-old jonathan chow is behind bars this morning. he spoke exclusively with nbc bay area yesterday from jail where he asked for privacy for the 8-year-old he is charged with molesting. we understand there are two other staff members who are not returning when and if classes rum here at spark. and the
